Abstract

Abstract: This research was  motivated by the  reality on the  ground  that there  was  a traditional  ceremony in Rejang tribe “Punjung Nasi Sawo”. The Rsearcher assumed that this tradition had a religious or moral message. The formulation of the problem in this study was what the symbolic meaning contained from the “Punjung Nasi Sawo” at the wedding of Rejang tribe in Batiknau  district of North Bengkulu,  what the ethical was contained in the procession of Punjung  Nasi Sawo at the wedding of Rejang tribe in Batiknau  district of North Bengkulu and how the manufacturing process and materials used  in presenting the “Punjung  Nasi Sawo”. This research had the goal was  to determined and  analyzed  the symbolic  meaning contained from the “Punjung  Nasi Sawo” at the wedding of Rejang tribe in Batiknau  district of North Bengkulu, to analyze the meaning of ethical contained in procession of “Punjung Nasi Sawo” at the wedding of Rejang tribe in Batiknau district of North Bengkulu and to determine and  analyze  the manufacturing process and  materials used  in the presentation of the “Punjung Nasi Sawo”?.  To obtained information on  the  ground,  the  researcher used  a  type  of field research with  a qualitative  approach. Based  on the results  of the study “Punjung  Nasi Sawo” on the Marriage Event of Rejang tribe in Batiknau district of North Bengkulu revealed that the activity was performed at the time of Raja Penghulu Consensus (madeak kutai),  the event  was attended by community leaders that consists  of traditional  leaders, religious  leaders, government of the  village and  the  general  public.  The activity of Raja Penghulu Consensus (madeak kutai)  included several  items  of rejang  tribe, one  of them  was  “Punjung  Nasi Sawo” and  the  event was held in the outdoors (taruf). Besides, these activities showed that the implementation of the Raja Penghulu Consensus (madeak kutai) which included one of rejang tribe “Punjung Nasi Sawo” that had some moral values, ethical,  social, anthropology and religion. In addition,  Punjung  Nasi Sawo symbolized as a noble  hope  against both  the bride  and  groom,  as a form of guarantee, as a form of application for license to community leaders, religious leaders and the surrounding communities and to establish with nurture event Silahturahim rope. This is in accordance with the customary slogan of Rejang tribe “ adat bersendikan syara’’, syara’ bersendikan kitab Allah. It means that the culture  remains preserved all relied on the law and the provisions of Islamic Sharia.

Abstract

Abstract :The purpose of this study is: to analyze and describe the procedures for resolving waqf land disputes in the Selebar District of Bengkulu City, then to analyze and describe the procedures for resolving waqf land disputes in the Selebar District of Bengkulu City in terms of the perspective of Islamic law and positive law. In exploring and obtaining information in the field, the researchers used field research with a qualitative descriptive approach. This research was started from May to June 2021, which was located in Selebar District, Bengkulu City, Bengkulu Province, Indonesia. In the study, it was found that the parties had taken steps to resolve waqf land disputes including through Deliberation, Arbitration, Mediation and Litigation, the implementation of which was adjusted to the situation and conditions at the time of the dispute. Furthermore, in the settlement of waqf land disputes in Selebar District, Bengkulu city, Nazir and the disputing parties prefer to use the peaceful way. From several cases and data obtained that the settlement of waqf land disputes in Selebar District, Bengkulu City, the authors can conclude that: Settlement of disputes through non-litigation and litigation channels is in accordance with Islamic law and positive law. The settlement of waqf land disputes in the Selebar District of Bengkulu City has been in accordance with the provisions of Islamic law and positive law.Keywords: Waqf Land Dispute, Broad, Positive Law and Islamic Law.Abstrak : Tujuan penelitian ini adalah: untuk menganalisis dan mendeskripsikan tata cara penyelesaian sengketa tanah wakaf di Kecamatan Selebar Kota Bengkulu, selanjutnya untuk menganalisis dan mendeskripsikan tata cara penyelesaian sengketa tanah wakaf di Kecamatan Selebar Kota Bengkulu ditinjau dari perspektif hukum Islam dan hukum positif. Dalam menggali dan mendapatkan informasi dilapangan maka peneliti menggunakan penelitian lapangan (field research) dengan pendekatan deskriptif kualitatif. Penelitian ini dimulai bulan Mei sampai dengan bulan Juni 2021 yang berlokasi di Kecamatan Selebar Kota Bengkulu Provinsi Bengkulu Indonesia. Dalam penelitian ditemukan bahwa para pihak telah melakukan cara dalam menyelesaikan sengketa tanah wakaf diantaranya melalui Musyawarah, Arbitrase, Mediasi dan Litigasi yang pelaksanaannya disesuaikan dengan situasi dan kondisi pada saat terjadi sengketa. Selanjutnya dalam penyelesaian sengketa tanah wakaf di Kecamatan Selebar kota Bengkulu, Nazir dan para pihak yang bersengketa lebih memilih menggunakan jalan damai. Dari beberapa kasus dan data yang didapat bahwa penyelesaian sengketa tanah wakaf di Kecamatan Selebar Kota Bengkulu, dapat penulis simpulkan bahwa: Penyelesaian sengketa melalui jalur non litigasi dan litigasi sesuai dengan hukum Islam dan hukum positif. Penyelesaian sengketa tanah wakaf di Kecamatan Selebar Kota Bengkulu telah sesuai dengan ketentuan hukum Islam dan hukum Positif.Kata kunci : Sengketa Tanah Wakaf, Selebar, Hukum Positif dan Hukum Islam.

Abstract

Abstract: Commerce is a human activity to fulfill their needs. With the development of science and technology, commerce has progressed very rapidly according to the needs and demands of the times. Human commerce also varies, ranging from small industry to large industry, goods and service companies, agricultural businesses, and others. Humans are seen to be so in love with wealth, that problems, disputes and disputes often occur which give rise to fierce and unhealthy competition that harms each other. The Al-Qur`an and hadith as guidelines for Muslims have provided rules for how humans can acquire wealth, because in fact human activity in obtaining wealth is not only related to fellow human beings, but in essence is also related to Allah SWT.Keywords: Business Ethics, Islamic Law Abstrak: Perniagaan merupakan aktivitas manusia untuk memenuhi kebutuhan hidupnya. Dengan berkembangnya ilmu pengetahuan dan teknologi, perniagaan mengalami kemajuan yang sangat pesat sesuai dengan kebutuhan dan tuntutan zaman. Perniagaan yang dilakukan manusia pun bermacam- macam, mulai dari industri kecil sampai industri besar, perusahaan barang dan jasa, usaha pertanian, dan lain-lain. Manusia dipandang begitu cinta kepada harta, sehingga sering terjadi permasalahan, perselisihan, dan persengketaan yang menimbulkan persaingan sengit dan tidak sehat yang saling membahayakan. Al-Qur`an dan hadits sebagai pedoman umat Islam telah memberikan aturan bagaimana manusia dapat memperoleh harta, karena sesungguhnya aktivitas manusia dalam memperoleh harta tidak hanya berhubungan dengan sesama manusia, tetapi hakikatnya juga berhungan dengan Allah SWT.Kata kunci : Etika Berniaga, Hukum Islam
