Abstract

The discussion of polygamy is always interesting to peel. Both groups pro or reject polygamy “as if ” race to show the public the reasons and rationale for them. Not infrequently “war” clause (more precisely) the interpretation of polygamy verses (Surah An-Nisa ‘: 3) coloring the debate discourse above. Sahrur is regarded as one of the leaders who is in passing considered the anti-polygamy and doing a lot of criticism of the dirty practices of polygamy among Moslems. However, if further research is inconsistency in the logic of his interpretations. On the one hand, Sahrur is against polygamy, even if it is only allowed for those who can penetrate the boundaries and strict rules of polygamy. However, on the other hand the logic of interpretation, identify the opposite direction. In addition, it seems that in the interpretation of paragraph polygamy (Surah An-Nisa ‘: 3) Sahrur exclude asbabun Nuzul or revelation causes, so it is impressed it is pulled out from the roots of the verse contextuality

Abstract

Hermeneutika adalah perangkat pemahaman teks. Ia bias digunakan sebagai alat untuk memahami segala teks, termasuk al- Qur’an yang diasumsikan oleh sebagian besar umat Islam sebagai teks sentral sebagai rujukan dan panduan hidup. Sudah barang tentu, keberadaan al-Qur’an haruslah bisa diterapkan dalam segala ruang dan waktu. Pesan Tuhan yang dibakukan dalam mushaf al-Qur’an harus selalu didialekkan dengan pemahaman intelegensi manusia. Jika tidak, maka al-Qur’an hanya akan menjadi lembaran kertas kuno hasil dari warisan budaya masa lampau. Muhammad Sahrur dan para pemikir Islam kontemporer yang lain melihat banyak kelemahan dalam metodologi penafsiran yang dikembangkan oleh mufassir-mufassir klasik yang memberlakukan teks al-Qur’an secara pasif dan rigid, tidak menempatkan teks dalam dialektika konteks dan kontekstualisasinya. Sehingga kenyataan ini menyebabkan pemahaman umat Islam akan pesan Tuhan tidak bisa menyeluruh. Oleh karenanya, menurut Sahrur diperlukan metode, pendekatan, prosedur, dan pisau analisa baru yang bisa mengisi celah-celah kebuntuan metodologis umat Islam ketika hanya berpegang pada seperangkat ilmu tafsir tradisional. Tidak berlebihan, jika hermeneutika ala Sahrur kemudian menjadi alternatif baru model pembacaan dalam upaya menggali dan memahami pesan Tuhan yang tertera dalam al- Qur’an dan teks-teks keagamaan yang lain.

Abstract

This article aims to examine the method of ijtihad (independent reasoning) that is applied in constructing the fatwas issued by the National Sharia Council (DSN) under the Indonesian Ulema Council (MUI) as well as its philosophical values by deeming the use of fiqh (Islamic jurisprudence) rules in terms of maslahah (benefits). A qualitative approach was employed in the study by exploring the DSN-MUI fatwas enacted ranging from 2000 to 2017. This present study highlights that the DSN-MUI used three approaches in establishing its fatwas, namely: naṣ qaṭ’i (definitive Islamic law in the Qur’an and Hadith), qauli (Muslim scholars’ perspectives), and manhaj (methodological interpretation). Additionally, the DSN-MUI completely concerned maṣālih ‘āmmah (public interests) and the objectives of Islamic law (maqāsid ash-shari’ah). Another finding promotes that 37 different types of fiqh rules were applied in the DSN-MUI fatwas, which were repeated 242 times. The Islamic jurisprudence rule that was widely implemented covered “the legal origins of muamalat (transactions) are permissible as there are no Islamic sources (dalil) that forbid them”. The quantity of use was 78 times with a percentage of 32.2. Furthermore, it can be noticed that 11 fiqh rules internalizing philosophical values were repeated 112 times. This study also offers that it is noteworthy to provide more norms of maqāsid ash-shari’a since there are lots of current issues in muamalat that have no legal considerations in the naṣ qaṭ’i.

Abstract

When the name of philosophy is juxtaposed with Islamic law, the question is how to study and understand Islamic law contemplatively. What to look for and find in Islamic law, how to search and find it, what is it for searched and found? Philosophical understanding of Islamic law will has an impact on a deeper understanding of Islamic law systematic and logical, by interpreting the philosophy of Islamic law, right? as philosophical material, but rather as Islamic legal material which is studied in detail philosophical. Thus, the critical nature of philosophy is indicated by three approaches in philosophy, namely approaches to ontology, epistemology, and axiology. If philosophy is coupled with Islamic law, then law Islam will be criticized for its essence, source of knowledge and function pragmatics as well as ethics and aesthetics. This article focuses on Hasbi ash Shiddieqiy's main thoughts on Legal Philosophy Islam by criticizing the methodology it uses in equates Islamic legal philosophy with wisdom. In fact, with see the main foundations of philosophy, namely ontology, epistemology, axiology, then Islamic Legal Philosophy covers it as a whole from the scope of fiqh, ushul fiqh, legal secrets, wisdom, and maqashid as shari'ah.
