Abstract

Study about the defense of women's rights was not only done by scholars today. Classical scholars who died in 310 H named Ibn Jarir At-Thabari has shown concern as well as defense of women's rights, even though he should at odds with the opinion of the majority of scholars at that time. Recorded two controversial fatwa in his time the priesthood of women's issues in front of the man and his status as court judges. His opinion that assessed syadz in his time was now beginning to be used and practiced in many Muslim countries Studi tentang pembelaan hak-hak perempuan tidak hanya dilakukan oleh para sarjana saat ini. Sarjana klasik yang meninggal pada 310 H yang bernama Ibnu Jarir AtThabari telah menunjukkan kepedulian serta membela hak-hak perempuan, meskipun ia harus bertentangan dengan pendapat mayoritas ulama pada saat itu. Tercatat dua fatwa yang kontroversial pada masanya imamat isu-isu perempuan di depan pria itu  dan statusnya sebagai hakim pengadilan. Pendapatnya yang dinilai syadz  pada masanya sekarang mulai digunakan dan dipraktekkan di banyak negara Muslim

Abstract

The government defined some norms on doing polygamy considering its negative effects. One of the requirements is a license for doing polygamy from the Religious Court. This letter of permission contains some benefits for the family especially protecting the right of the children and the wife.

Abstract

This text compares among three methods in Usul al-Fiqh: Hanafiyah, Shafi'iyah, and tariqah al-jami'. Hanafiyah has some strengths such as rich of examples in furu', close with the reality and concise in discussion. The weakness of this method is it causes a kind of fantastic and rich of argumentation. Shafi'iyah method is too narrow in philosophical point of view and lack for examples. Tariqah al-jami' generally could overcome the weakness of those two methods above.

Abstract

Marriage which is intended to buid a good and blased family sometimes gets a trouble such as disloyality. Disloyality might be done by husband, wife or both of them. Shiqaq therapy is usually applied to overcome disloyality by having two people (hakam) from both side to find the best solution such as reconciliation or a recommendation to get divorce.
