Abstract

Abstract PMNA No.5 Ka. BPN of 1999 can actually provide a legal coverage by implementing article 3 of the UUPA. The criteria used to determine whether the above-mentioned rights exist or not tend to be more detrimental to this particular society and have not yet reflected the legal justice. To provide the strong legal status of ownership rights has to regulated in the form of law. As such, the legalisation of ownership rigts of Traditional Law-based Society becomes a conditio sine gua non as a certain solution of the implementation Article 3 of the UUPA. Kata Kunci: Hak Ulayat, Eksistensi, dan Legalisasi Abstrak PMNA/Ka.BPN No. 5 Tahun 1999 dapat menjdi merupakan payung hukum dalam melaksanakan ketentuan Pasal 3 UUPA. Kriteria yang digunakan dalam menentukan eksistensi hak ulayat cenderung merugikan Masyarakat Hukum Adat itu dan belum mencerminkan keadilan hukum. Pemberian kedudukan hukum yang kuat kepada hak ulayat perlu diatur dalam bentuk undang-undang. Dengan demikian, legalisasi hak ulayat masyarakat hukum adat merupakan coditio sine qua non sebagai suatu solusi dalam pelaksanaan Pasal 3 UUPA.
