Abstract

In the eyes of the law, the Baha’i religion does not exist in this country, as it is not included in the six religions recognized in Indonesia’s constitution: Islam, Protestantism, Catholicism, Hinduism, Buddhism and Confucianism. As a result, it is considered an “unofficial “ or “unrecognized “ religion. In fact, in Article 29 Paragraph 2 of the 1945 Constitution and Article 1 of Law No. 1 / PNPS / 1965, the term “unofficial” and “unrecognized” religion is not even used. The only term used are “followed and serviced” religions. From this perspective, Baha’i is not considered an independent religion, but a splinter group of other religions. This given rise to systemic losses, i.e the unfulfilled civil rights of Baha’is, as part of Indonesian citizens who actually entitled to rights.

Abstract

The purpose of this research are understanding the existence of the teaching of Kampung Dukuh Dalam community in Garut and knowing the fulfillment of their civil rights as stated in constitution, UU No. 23, 2006 . This research was conducted using a qualitative approach to data collection, interviews, observation, and study documents data collection, interview, observation and documents review. It was held on April to May 2013 in Cikelet, Ciroyom, Garut District. The results showed that the religious values in Cikelet is still preserved and practiced through reflective actions. The retained values are experiencing dynamics, although the main principles for the perfection of worship is still maintained . In term of their relationship, their position always in unequal position with the people outside. Some issues regarding to civil rights, marriage records, limited health and reproductive health services, etc. One of reason are the lack of law awareness and the lack of socialization from the government.

Abstract

The purpose of the research is to understand the phenomena of the unregistered marriage, comprises the causes, effects, responses and efforts to minimize unregistered marriage. The method is qualitative method with the strategy of case study. The data collecting technique are through deep interview, focused group discussion, document examination and observation. The location of the research is Cianjur and the field data collection occurred on August 2012. Causal factors of the unregistered marriage are the lack understanding of religion, that does not require the registration, the religion figure’s influence and role, law factor, and or administration issue. The unregistered marriage has bad effects to the women, as their position as wives is legally unconsidered. Muslim’s leader and the society give various responses to the unregistered marriage, some say that the registration is not something that is eligible for Islam, while some other say that it is a positive endeavor related to its law status as well as its cause and effect. Efforts to avoid unregistered marriage have been done by the society as parents and the government collaborating with self-supporting institutions. Parents do it through education and family resuscitation while the government does it through isbat nikah and the socialization of how important the registration is.
