Abstract

Sejak pertama kalinya bergulir, isu perubahan iklim atau global warming telah menjadi trend setter tersendiri dalam wacana diskusi multidisipliner, termasuk dalam konteks hukum. Dalam diskursus ilmu hukum sendiri, isu perubahan iklim berkembang dalam sekian aspek pembahasan, terlebih dengan masih adanya banyak perdebatan yang terjadi mengenai penyebab maupun lingkup dampak dari perubahan iklim tersebut. Sebagai sebuah masalah global, tiap negara memiliki karakter tersendiri pada model kebijakannya dalam adaptasi dan mitigasi perubahan iklim. Penelitian ini bersifat normatif dan bertujuan untuk dapat memaparkan secara garis besar konsep kebijakan nasional Indonesia dalam adaptasi dan mitigasi perubahan iklim. Secara garis besar, Indonesia telah memberikan kontribusi cukup signifikan dalam rezim perubahan iklim, terutama pasca Bali Action Plan 2007.

Abstract

Tulisan ini hendak memaparkan penggunaan pendekatan kehati-hatian dalam pengaturan sumberdaya genetik. Utamanya membahas secara normatif pentingnya penerapan pendekatan kehati-hatian dalam pengaturan organisme transgenik di Indonesia. Pembahasan paper diawali dengan mendeskripsikan konsep pendekatan kehati-hatian, terutama dari sudut pandang CBD; konsep pengelolaan sumberdaya genetik Indonesia dan isu krusial yang ada; serta penerapan pendekatan kehati-hatian untuk pengaturan organisme transgenik di Indonesia.

Abstract

As archipelagic country comprising about 17,000 islands and spreading over a total area of 191 million hectares, the prospect of carbon projects in Indonesia are massive. Aside present carbon project activities, the chances to initiate more small scale carbon project are abundant. However, most of the attentions are given for large scale carbon projects as carbon reduction itself still considered as an exclusive interest only. Several lessons can be learn by Indonesian from other developing countries on the implementation of smallholders carbon project. This article aims to briefly describe this issue and purposedly explore the chance of promoting smallholders carbon projects in Indonesia.

Abstract

Aside the Nagoya Protocol on Access and Benefit Sharing, which is already ratified by Indonesian government with Law No. 11 Year 2013, the Nagoya–Kuala Lumpur Supplementary Protocol on Liability and Redress (NKL Supplementary Protocol) offers great benefits for “megabiodiversity” country like Indonesia. Despite the lack of awareness of this supplementary protocol, the need for ratifying is urge. This legal-normative research aims to seek the existing regulation in Indonesia to support the implementation of the Nagoya–Kuala Lumpur Supplementary Protocol on Liability and Redress, and to explore the readiness of the national legal system on liability and redress for biodiversity. Based on the several existing regulation, Indonesia, to some extent has the readiness to implement the Nagoya–Kuala Lumpur Supplementary Protocol on Liability and Redress. This finding should be supported with more intens discussion on the protocol.

Abstract

Presidential Regulation Number 21 of 2019 concerning the National Action Plan for Mercury Reduction and Elimination (RAN-PPM) became the strategy for reduction and elimination of Mercury, then later revealed in the Regional Action Plan for Mercury Reduction and Elimination (RAD-PPM). According to it, a comprehensive monitoring method is urgently needed, neither only related to the elimination of mercury in the ASGM sector, but also for regional development potential. This research is a Research and Development research, which is a type of research that aims to develop applications, which are used as a tool for decision making-a Decision Support System (DSS). Using a descriptive qualitative method, to analyse related documents, interviews with related actors, and calculate System Usability Scale to analyse and see the usability and the level of user acceptance to the WebGIS. The case study is the development and preparation of a WebGIS related to the ASGM sector in Kokap, Kulon Progo. The result of the study shows that an information system with geospatial-based analysis could facilitate data integration, implementation and monitoring of the regulation of mercury elimination, especially in the ASGM sector. As a result of the WebGIS System Usability Scale for Small-Scale Gold Mining in Kulon Progo Regency, it is included in the category of applications that can be accepted by users and is quite appropriate. Nevertheless, synergy and cooperation between various agencies are necessary. Moreover, the data related to socio-economic which is an important information system for regional development can also be mapped in a GIS.
