Abstract

In its position as sovereign state, the possession of definite territory is a must for Indonesia; as a consequence of its status as an archipelagic state therefore Indonesia has the responsibility in determining the border of its territory in map forms with sufficient scale in affirming its position. In the year 1987, Government of Indonesia submitted a list reporting the increasing amount of island from 13.667 to 17.508 when attending United Nations Conference on Standardization of Geographical Names (UNCSGN) in Montreal, Canada. At that time, United Nations responded in asking Indonesian Government to submit list of the islands to United Nations. Based on December 2007 data, reported that, from 17.504 islands scattered all around, only 6900 islands has name standardization in accordance with international standard. While the rest around 10.600 islands without standardization name which internationally recognized. The paper is aimed to raise the urgency of name standardization for Indonesia’s islands in accordance with the rules of international law and the Indonesian Government’s efforts in standardizing islands names in Indonesia. It is concluded that the efforts in standardization of island names in Indonesia ought to do, so that the remaining islands that become the part of Republic of Indonesia territorial sovereignty has an international recognition. Though there are few constraints faced by the Indonesian government in conducting islands names standardization in Indonesia, such as: lack of coordination between relevant authorities, various numbers of tribes and local languages and limited funds.

Abstract

Jurnal ini bertujuan untuk menganalisis konsekuensi hukum bagi Indonesia tentang pengendalian kabut asap pasca ratifikasi ASEAN Agreement on Transboundary Haze Pollution serta langkah-langkah yang harus dilakukan sebagai wujud asas itikad baik. Jenis penelitian yang digunakan dalam tulisan ini adalah penelitian hukum normatif dengan menggunakan pendekatan aturan hukum tertulis (statute approach). Hasil penelitian yang diperoleh yaitu Indonesia wajib mengambil tindakan di bidang legislatif, administratif serta tindakan teknis lain untuk mencegah kebakaran lahan dan hutannya supaya tidak menimbulkan pencemaran asap wilayah negara lain serta sebagai perwujudan asas itikad baik, Indonesia wajib mengambil langkah prioritas berupa penegakan hukum terhadap pelaku pembakar lahan dan hutan yang menyebabkan kabut asap.This journal aims to analyze the legal consequences for Indonesia on preventing and monitoring transboundary haze pollution after the ratification of ASEAN Agreement on Transboundary Haze Pollution and actions that should be taken by the Republic of Indonesia as a form of principle of good faith. This study is a normative legal research by using regulation of written law approach (statute approach). The result of this journal showed that Indonesia shall take legislative, administrative and other steps, as aprinciple of good faith, to prevent, control and mitigate land and forest fires that leads to trans boundary haze pollution. Indonesia also shall enforce the law as a main priority against the person or corporation that burns land and forest.

Abstract

AbstractThe aims of this journal is to analyze the legal status of private military company and its personnels involved in armed conflict under international humanitarian law.This paper based on normative legal research. The result shows that private military company and its personnel has various legal status which are civilian, civilian accompanying the armed forces and unlawful combatant based on their duties and activities. Key words: legal status, private military company, armed conflict and international humanitariaan law  AbstrakTulisan ini bertujuan untuk menganalisa status hukum anggota private military company yang terlibat dalam konflik bersenjata berdasarkan hukum humaniter internasional dengan mendiskripsikan fakta keterlibatan anggota dalam konflik bersenjata, kedudukan perusahaan militer swasta dalam hukum humaniter internasional. Tulisan ini didasarkan pada metode penelitian hukum normative, dimana para personil private military company memiliki beragam status diantaranya adalah penduduk sipil, penduduk sipil yang menyertai angkatan bersenjata dan unlawful combatant sesuai dengan tugas maupun aktivitas yang mereka lakukan.Kata kunci: status hukum, private military company, konflik bersenjata dan hukum humaniter internasional

Abstract

Penelitian ini mengkaji tentang legalitas penggunaan UAV sebagai senjata berdasarkan hukum internasional. Banyak negara telah mengembangkan teknologi UAV untuk berbagai kepentingan, dimana salah satunya digunakan sebagai senjata untuk menyerang target-target tertentu, sedangkan hingga saat ini belum ada ketentuan positif dalam hukum internasional yang mengaturnya. Tujuan dari penelitian ini adalah untuk menganalisis dampak yang ditimbulkan dari penggunaan UAV sebagai senjata dan urgensi adanya ketentuan hukum internasional tentang penggunaan UAV sebagai senjata. Jenis penelitian ini adalah penelitian hukum normatif. Hasil penelitian mengungkapkan bahwa penggunaan UAV yang mengakibatkan hancurnya obyek-obyek sipil dan terbunuhnya penduduk sipil merupakan bentuk pelanggaran terhadap asas-asas dalam hukum humaniter internasional, yaitu Asas Pembedaan, Asas Kehati-hatian, Asas Proporsionalitas, Asas Kemanusiaan dan Asas Kepentingan Militer. Demi adanya kepastian hukum terkait legalitas penggunaan UAV sebagai senjata serta terpenuhinya unsur filosofis, yuridis dan politis maka perlu adanya ketentuan positif dalam hukum internasional agar tidak terjadi lagi pelanggaran hukum terkait penggunaannya serta ada kejelasan bentuk pertangungjawabannya

Abstract

The jurisdiction of the International Criminal Court (ICC) over environmental crimes has become a critical issue in international criminal law, particularly concerning the potential recognition of ecocide as an international crime. Although the Rome Statute does not yet formally include ecocide within its scope, discourse surrounding its inclusion has intensified amid the worsening global environmental crisis. This study employs a normative legal approach to examine the development of international legal norms relating to environmental crimes and to evaluate the feasibility of expanding the ICC’s jurisdiction to encompass ecocide. The findings indicate that the inclusion of ecocide under the ICC’s jurisdiction could enhance global environmental protection and reduce impunity for those responsible for severe environmental harm. However, normative and practical challenges—such as the formulation of a clear legal definition and the establishment of constitutive elements of the crime—remain significant obstacles to implementation. This research contributes to the advancement of international legal discourse on environmental protection and accountability for environmental crimes.
