Abstract

The function of proof in law of criminal procedure is to find the truth andreinforces the conviction of judges to mistakes charged the defendant.In article 184paragraph (1) Indonesian law of criminal procedure, legal means of evidence shall be :the testimony of a witness, the testimony of an expert, a document, an indication, thetestimony of the accused. Age of increasingly sophisticated led to the rise of cyber crimeand in the process proving cybercrime requires electronic evidence, for exampleelectronic mail.

Abstract

In a criminal case such as the case of traffic accidents in practice or reality can be settled out of court by using police discretion in consultation mechanism through kinship or term often familiar with ADR (alternative dispute resolution), which in fact it is cleary deviate from the provisions of article 360 paragraph (1) of the Criminal Justice Act, and therefore are expected for the future in terms of discretion by the investigator to be more clearly set boundaries to avoid abuse of authority.

Abstract

This paper shall be entitled as “Consumer Protection Towards ExonerationClause In Freight Forwading Services Agreements By Companies". This paper shallapply normative legal research method combined with statutory approach. Agreementwhich uses exonerating clause had been widely spread throughout public usage due toits time and financial efficiency. As it further developed, the usage of such related termhad implied certain incompliance of requirements which latter exerted disadvantages tocertain party and otherwise. This paper shall illustrate regarding exonerating clauseused by agreements in freight forwarding services by companies from the perspective ofconsumer protection based on its respective Act.

Abstract

Principle of paritas creditorium, pari passu prorata parte and structuredprorata shall be considered as fundamental principles in debt settlement between debtorand its respective creditor. Principle of paritas creditorium (equality amongcreditors) shall determine equal rights of creditor over the properties belonged by thedebtor. In circumstances of default by debtor, all properties therein shall be in thepossession of the creditor. This writing shall illustrate the principle of paritascreditorium within Law Number 37 of 2004 concerning Bankruptcy and Delayment of DebtSettlement Obligation and its enforcement in Indonesia judgement of law. Method appliedin this research shall be normative legal research by analyzing statutory laws andrespective literatures. Principle of paritas creditorium guarantees the equality of creditorrights to the debtors in the matter of applying bankrupt claim and debt settlement claim.

Abstract

Stipulation of Article 23 paragraph (2) and Article 3 of law concerning legalprotection for creditor in case altering the fiduciary shall be registration or theobligation of the debtor to provide alternative substituting assurance which shares theequal value. Upon normative legal research analysis, it shall be concluded that theaction committed by the debtor in altering the fiduciary warrant object without anyconsent by the recipient of fiduciary shall be a breach of law, as it is prohibited by law.Hence, this writing shall explain the legal protection for creditor in case altering thefiduciary warrant object.

Abstract

Article 43 paragraph (1) the Act No. 1 Year 1974 Concerning Marriage determine that an illegitimate child only has a civil relationship with her mother and her mother's family. Though these provisions may result in various losses for the child. Until finally the various losses now can be minimized through the Constitutional Court Decision No. 46/PUU-VIII/2010, which is then reinforced with the Supreme Court Circular Letter No. 07 Year 2012. Therefore, this paper will describe the legal relationship between an illegitimate child with his biological father in accordance with the Constitutional Court Decision No. 46/PUU-VIII/2010 as well as the rights that can be obtained under the law relationships contained in the Supreme Court Circular Letter No. 07 Year 2012.
