Abstract

Women are one of the legal subjects who also influence the law enforcement in society. Currently, many women also play a role in the public sector and organizations, in addition to carrying out their roles as mothers and wives in their families. Women currently have a decisive position in both companies and professions in various fields, so that women have roles as mothers, wives, members of the community or co-workers who have dominant power, one of which is in terms of eradicating corruption in Indonesia. This research is a normative juridical method, namely legal research that refers to written regulations or other legal materials, including statutory approaches, case approaches and conceptual approaches, while the results of the study explain that, corruption is a systemic crime. and endemic, besides that corruption also has a gender dimension, where if there is no comprehensive handling and prevention efforts, it is certain that a country can suffer enormous losses. Women with all the resources that exist in themselves play an important role in the continuation of the life of the generation, women are the closest figures who shape the character of children and give color to their domestic life. Currently, the facts show that women are in the circle of corruption. The powerlessness of women in the public sphere with a corrupt system or accusations of women being one of the causes of corruption in the domestic sphere has increasingly cornered women's position. However, women also have rights and should be involved in every activity related to acts of corruption, considering that Indonesia is one of the countries in the world that has the highest corruption cases compared to several other countries, the participation of women should also be given the opportunity. the same and even more specifically in dealing with every corruption case in Indonesia. The problem of women and corruption has nothing to do with gender identity itself, because the problem of corruption is solely the duty of all citizens and the law has guaranteed it, it cannot be denied that women can also be the spearhead of a country in terms of eradicating corruption.

Abstract

Gender equality is something that women really want. In existing social constructions, gender roles cannot stand alone, but their existence has been influenced by the characteristics that society has assumed for men and women. From the gender injustice that arises in the midst of our society, especially those that are still thick with patriarchal culture, it certainly causes women not to have strong freedom as well as men. The problem that often occurs is the double workload in the family, especially the social assumption that has applied the position that women are individuals who are suitable for doing domestic work is the trigger for the double workload. Though housework should not only be a woman's obligation but the responsibility is the responsibility of every family member, in particular, this study will examine the problems experienced by women. The research method used is a descriptive method of analysis, which uses a normatic juridical approachF is legal research conducted by conducting research on literature materials consisting of primary, secondary and tertiary materials.

Abstract

Domestic abuse is a subject of public law, thereby transcending the private sphere of the marital relationship and necessitating official intervention in its resolution. Domestic violence falls under criminal law, although divorce pertains to civil family law, resulting in two distinct legal processes in the divorce settlement that follow incidents of domestic abuse. Law Number 23 of 2004 addresses the Elimination of Domestic Violence, serving as the inaugural legislative framework that explicitly safeguards victims of domestic violence offenses. This study employs a descriptive-analytical research methodology. This study employs a normative juridical approach, utilizing literature and secondary data as the foundation for research, which involves an examination of relevant laws, regulations, and literature pertinent to the research process. Simultaneously, the analysis employed in this study methodology is qualitative legal.  This study concluded that the Religious Court lacks the authority to adjudicate domestic violence cases, as it does not possess jurisdiction over public law matters. In addressing community needs, the majority of domestic violence cases are promptly adjudicated for divorce in the Religious Court without prior resolution in the District Court. Consequently, harmonization between the Religious Court and the District Court is necessary for the resolution and adjudication of divorce cases involving domestic abuse. Immediate formulation of clear and tangible regulations is necessary to address divorce cases stemming from domestic abuse, namely by granting the Religious Court the competence to adjudicate matters pertaining to public law, particularly those involving domestic violence.

Abstract

PAUD instructors typically work with a female student body. This is because, from a societal standpoint, women are viewed as kind, meticulous people, making this work appropriate for them. PAUD instructors are entitled to a wage structure that guarantees their economic and social well-being until their earnings are insufficient. In terms of norms, the government has established laws that ensure the rights of all workers; nonetheless, social differences in women's earnings continue to exist. It would, therefore, remain challenging to address the issue of PAUD teachers' low pay if the regulations are set solely by statutory regulations and no steps are taken to ensure its implementation.

Abstract

Penelitian berjudul Implementasi Pasal 34 Ayat (2) Undang-Undang Dasar 1945Dikaitkan Dengan Penangkapan Petani Di Madiun Dan Stigma Inovasi Di Indonesia, membahas adanya ketidakharmonisan regulasi inovasi di dalam sektor pertanian dengan praktik penegakan hukum terhadap petani di Indonesia. Regulasi di Indonesia telah mendukung kegiatan inovasi, namun implementasi di lapangan terhambat oleh pendekatan hukum yang formalistik, maka amanat konstitusi pada Undang-Undang Dasar 1945 Pasal 34 ayat (2) tidak terwujud. Penelitian ini menggunakan pendekatan yuridis normatif dengan spesifikasi deskriptif-analitis serta metode analisis yuridis kualitatif. Hasil penelitian menunjukkan ketidakjelasan definisi “petani kecil” dalam Undang-Undang Nomor 22 Tahun 2019 tentang Sistem Budi Daya Pertanian Berkelanjutan, berdampak pada penerapan pasal pengecualian administratif yang tidak konsisten, sehingga membuka ruang kriminalisasi terhadap inovasi petani. Tindakan kepolisian dalam kasus ini dianggap lalai menjalankan fungsi pengayoman sesuai Pasal 13 huruf c Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian. Diperlukan harmonisasi regulasi dan pendekatan hukum yang lebih humanistik untuk menjamin perlindungan HAM serta mendukung tercapainya tujuan Indonesia Emas 2045.

Abstract

Domestic violence committed by husbands against wives in the perspective of human rights is a form of action that violates the basic principles of international human rights declaration. The desire for gender equality is expected to apply to the level of the smallest group, namely family life, especially the existence of the family has a very large influence on people's lives so as not to create gender bias. In this case, the family is the first unit and the smallest unit in forming a foundation to form individuals who have qualities so as not to commit violence. The research method used is a descriptive method of analysis, which is a method that has a function to describe or provide an overview of the object being studied either through data or through samples that have been collected as they are, then a form of analysis is carried out and makes a conclusion that applies to the public. The material used in this study is literature material.
