<![CDATA[ABSTRAK Dalam pembentukan pengawasan terhadap peraturan Bupati oleh DPRD belum ditemukan bagaimana pembentukannya dan bagaimana mengontrol supaya yang didelegasikan sama dengan yang dikehendaki oleh Perda, bagaimana cara untuk mengawasinya. Dalam hal ini harus ada pengawasan terhadap peraturan Kepala Daerah. Isu yang perlu dijawab adalah bagaimana seharusnya sistem pengawasan terhadap Peraturan Kepala Daerah. Untuk menemukan jawaban atas isu tersebut, maka penulisan ini menggunakan pendekatan yuridis normatif, dengan pendekatan perundang-undangan. Pentingnya bagi Indonesia untuk membentuk lembaga independen yang secara aktif memberikan pengawasan terhadap keseluruhan kebijakan pengaturan Pemerintah dan menumbuhkan regulasi yang berkualitas. Rekomendasi OECD ini didasarkan atas pertimbangan sebagai berikut : 1. Tidak ada lembaga yang memiliki tanggung jawab formal untuk menyediakan perspektif yang menyeluruh di Pemerintah tentang pelaksanaan kebijakan regulasi yang lebih baik 2. Sejumlah lembaga publik yang ada menunjukkan tumpang tindih tanggung jawab dalam keputusan membuat regulasi ( termasuk pengembangan alat untuk mendukung manajemen peraturan dan review formal atas proposal regulasi). Menurut OECD, dibanyak negara, pendirian a central oversight body (sebuah badan pengawas pusat) telah terbukti sangat membantu untuk memberikan fokus pada proses dan koherensi penyusunan regulasi. Kata Kunci : Delegasi, Kepala Daerah, Pengawasan, Sistem ABSTRACT In establishing the supervision of the Bupati regulation by the DPRD, it has not been found how it is formed and how to control it so that what is delegated is the same as what the Perda wants, how to monitor it. In this case, there must be supervision of regional head regulations. The issue that needs to be answered is how the oversight system should be towards Regional Head Regulations. To find answers to these issues, this paper uses a normative juridical approach, with a statutory approach. It is important for Indonesia to form an independent institution that actively provides oversight of all Government regulatory policies and fosters quality regulations. This OECD recommendation is based on the following considerations: 1. No agency has a formal responsibility to provide a comprehensive perspective in the Government on better implementation of regulatory policies 2. A number of existing public institutions show overlapping responsibilities in regulatory decisions ( including the development of tools to support regulatory management and a formal review of regulatory proposals). According to the OECD, in many countries, the establishment of a central oversight body has proven to be very helpful in focusing on the process and coherence of regulatory drafting.
