AbstractSoediman Kartohadiprodjo was one of few Indonesian legal scholars taking interest in Pancasila, the state ideology  promulgated by Soekarno. Soediman believe that social justice, the core concept of Pancasila corresponds with the âkekeluargaanâ principle as found in the constitution.  However, he used the the term welfare or happines rather than social justice since the latter, according to him, tends to adopt liberalist and individualist principles, which according to him contradicts with Pancasila.  He also endorsed the idea of âlegal revolutionâas a mean to increase the Indonesian populaceâ awareness about recent legal development post independence. This article discusses and critizes Soedimanâs idea on social justice and legal revolution. Keywords: Pancasila, social justice, welfare state, law revolution.

Street vending always becomes one of main problems in many big cities like Jakarta if the existence of street vendors is perceived as a burden and never comprehensively addressed. It is the main concern raised in this article . A more comprehensive perspective can be applied by using philosophical and legal approaches . This article provides two points of view in term of the phenomena, i.e. legal philosophy and consumer [legal] protection. The first relates the subject matter to the universal legal values known as the legal objectives. The second one includes two perspectives, i.e. the proctection for consumers of street vendor’s products and that for street vendor as consumer of [legal] public policy.

Legal language must follow the laws of language (grammar) that widely known and commonly used by the public, including groups of the scientist. Legal language on the other hand also recognizes specific terminologies. These terminologies were introduced by jurists or by legislative power holders. Accordingly, legal language became the product of legal doctrines or political decisions. The problems arose when a number of compositions and legal terms turned out to be elusive, convoluted, and ambiguous due to the pattern of writing that was once done and because of certain considerations. This article proposed reviewing the factors that result in problems. The author presented a solution to observe using hermeneutic methods of law and legal reasoning. The author argued that the text of the law was not neutral since it was trapped not only by the laws of language but also by the perspective of the interpreters as they believed such a perspective was based on the guidance of legal science. By using legal hermeneutics can be checked the depth of the meaning of the law; while over the legal reasoning can be seen its rationale according to legal science.

Abstract Constitutional Court decision No. 003/PUU-IV/2006 has construed the connotation of Article 2 paragraph (1) of Law No. 31 Year 1999 by shifting the concept of ‘malum in se’ to that of ‘malum prohibitum’ in term of the element of ‘unlawfulness’ in that article. Is such an interpretation relevant enough amid the current corruption battle in this country? This article discusses this question by using the perspective of legal philosophy. The author of this article concludes that in the meantime, truth and justice values as constantly underlined by legal philosophy should be upheld as the strategy to strengthen the collectivity rather than the individuality principles in the Indonesian legal system. In this point of view, the shifting of the ‘malum in se’ to ‘malum prohibitum’ concepts can affect the principle of authority in the effort of corruption erradication in Indonesia. Abstrak Putusan MK Nomor 003/PUU-IV/2006 memberi penafsiran yang mengubah konsep ‘malum in se’ menjadi ‘malum prohibitum’ terhadap makna melawan hukum dalam Pasal 2 ayat (1) Undang-Undang Nomor 31 Tahun 1999. Persoalannya adalah: apakah pergeseran makna ini dapat dianggap tepat? Tulisan ini menjawab pertanyaan tersebut dengan menggunakan perspektif filsafat hukum. Dalam kondisi kekinian iklim pemberantasan korupsi di Indonesia, asas kebenaran dan keadilan yang digarisbawahi oleh filsafat hukum itu harus dibaca sebagai sebuah strategi untuk lebih memperkuat asas persekutuan (kolektivitas) dalam sistem hukum dibandingkan dengan asas kepribadian. Dalam konteks ini, maka pergeseran konsep ‘malum in se’ ke ‘malum prohibitum’ dapat dipandang sebagai pelemahan asas kewibawaan hukum dalam upaya pemberantasan korupsi di Indonesia. Kata kunci: malum in se, malum prohibitum, tindak pidana korupsi.

This legal study, using a social-functional approach, underscores the importance of developing a viable social consumer protection system. Through it the government should promote a more effective consumer protection system in which any obstacle hampering consumer’s ability to obtain information necessary to make rational choices can be prevented. In short, a system protecting consumer’s right to obtain information. In this context, business enterprises are still expected to participate and support consumer protection movements at the national as well as regional level in which the end goal is to develop a fair business competition climate.

This article is a commentary to President Joko Widodo’s message in a speech given at the celebration of the UNPAR’s dies natalis in 2022, i.e. that manager of higher education institutions should adequately anticipate global uncertainty caused by the advance of industrial society 4.0 and the resulting technological disruptions. The comments given is made based on two different perspectives: legal scholars or academics n and practicing lawyers. In any case, those responsible for the management of higher education should respond to global uncertainty by developing skills to manage big data and other strategic steps.
