Abstract

Mewujudkan keterpaduan antara pelaksanaan rencana tata ruang dengan tidak mengabaikan kepentingan perorangan, berarti mencegah perbenturan kepentingan yang merugikan kegiatan pembangunan antar sektor, daerah dan masyarakat dalam penggunaan sumber daya manusia dan sumber daya buatan melalui proses koordinasi, integrasi dan sinkroniksasi perencanaan tata ruang, pemanfaatan ruang dan pengendalian pemanfaatan ruang. Penggantian yang layak diberikan kepada orang yang dirugikan selaku pemegang hak atas tanah, hak pengelolaan sumber daya alam seperti hutan, tambang, bahan galian, ikan dan atau ruang yang dapat membuktikan bahwa secara langsung dirugikan sebagai akibat pelaksanaan kegiatan pembangunan sesuai dengan rencana tata ruang dan oleh perubahan nilai ruang sebagai akibat penataan ruang. Sebagai penjawaban dari kebijaksanaan pembangunan perlu disusun rencana tata ruang wilayah di tiap Propinsi dan Kabupaten/Kota ternyata tidak semua Kabupaten/Kota menyusun dengan segera Rencana Tata Ruang Wilayah untuk wilayahnya. Bagi pemerintah daerah yang telah mempunyai Rencana Tata Ruang Wilayah ternyata masih banyak pelanggaran dan penyimpangan yang dilakukan oleh Pemerintah Daerah sendiri. Kurangnya partisipasi masyarakat dan kurangnya kesadaran dari masyarakat tentang pentingnya rencana tata ruang wilayah. Perubahan fungsi lingkungan untuk digunakan dan dikelola termasuk peruntukkan taman dan pantai harus tetap memperhatikan kebijakan sektor maupun kebijakan pembangunan yang berorientasi pada kelestarian fungsi lingkungan termasuk pula keserasian pada masyarakat sebagai pemegang kedaulatan publik. Dalam penelitian ini metode penelitian yang digunakan adalah normatif dengan menggunakan data sekunder dan data primer dan analisis datanya secara kualitatif sebagai penutup dari penelitian, peneliti menyarankan sebaiknya untuk mencegah dan/atau mengurangi pelanggaran terhadap RTRW yang telah ditetapkan PEMDA hendaknya konsekwen dalam penerapan RTRW dan terhadap pelaku pelanggaran penataan ruang dikenakan sanksi yang tegas.

Abstract

Many multi-storey buildings in the Special Capital Region of Jakarta have been constructed in violation of building setback lines, resulting in conflicts with surrounding communities. The issues examined in this study are: how is the regulation of building setback lines for multi-storey buildings in Jakarta governed under Regional Regulation Number 7 of 2010, Regional Regulation Number 1 of 2014, and Governor Regulation Number 128 of 2012? and what measures have been taken by the Provincial Government of Jakarta to address violations of these setback line regulations? The legal research method used is normative juridical research with a descriptive approach, relying on secondary data analyzed qualitatively. Based on the discussion, it is concluded that non-compliance with building setback lines in multi-storey buildings in Jakarta has led to conflicts that negatively affect the surrounding communities. The provisions set forth in Regional Regulation Number 7 of 2010, Regional Regulation Number 1 of 2014, and Governor Regulation Number 128 of 2012 have not been effectively enforced. Therefore, enhanced legal enforcement efforts, oversight, and coordination among relevant stakeholders are required to halt ongoing violations and prevent further losses.

Abstract

Regency or city governments have an important role in supervising mining activities in accordance with the Regional Government Law and the Mineral and Coal Law. However, with the enactment of the new Minerba Law, this role has undergone significant changes. This research aims to analyze the role of district or city governments in mining supervision before and after the enactment of the new Minerba Law, which revoked some regional authorities. The research results show that previously, regional governments had the authority to grant permits and supervise mining activities. However, with the presence of the new Minerba Law, this authority shifted to the central government, causing district/city governments to lose most of their responsibilities. However, local governments still play a role in aspects of environmental monitoring and law enforcement at the local level.

Abstract

Kuningan is targeted in PTSL zone. In 2021, The Kuningan District Land Office has set a goal of 70,000 fields for PTSL. The issue is whether land registration through the PTSL program already implemented in Linggasana Village, Cilimus District, Kuningan Regency based on the ATR/Ka.BPN Ministerial Regulation No. 6 of 2018 about PTSL, and what the challenges in implementation. The type of research is descriptive analytic study, normative law is applied, and secondary data is the sort of data used. The research result is analyzed by qualitative and examined by a deductive perspective. As a research and observation result, it has been determined that Linggasana Village's PTSL implementation is experiencing obstacles due to some of people did not want to participate in PTSL. The conclusion is the PTSL Program in Linggasana Village, Cilimus District, Kuningan Regency still has obstacles and it is decrease the performance of the land office in implementing the PTSL Program.

Abstract

Changes in the conversion of paddy fields in Indonesia often turn into non-agricultural land such as residential development or are designated as strategic projects. This has a serious impact and threatens national food security which is no longer able to meet food needs as the population increases every year. The formulation of the problem is whether the Spatial Plan for Protected Paddy Fields is in Accordance with Presidential Regulation Number 59 of 2019. The research method is normative with the nature of analytical descriptive research using secondary data types and primary data qualitative data analysis, drawing conclusions using deductive logic. The research discussion, not all determination of Paddy Fields is Protected in accordance with the Spatial Plan, miscommunication related to land data that is not reported is a form of obstacle so that the efforts that can be made by the Ministry of ATR/BPN are to provide guidance to stakeholders. Can be concluded that the designation of protected paddy fields associated with spatial planning is still not in accordance with Presidential Regulation Number 59 of 2019 because there are still obstacles in determining LSD where the Central Government and Regional Governments have their own authority which limits the space

Abstract

The land that the villagers lived on was simply lost due to the loss of land due to natural events. The problems is Regional Regulation Number 12 of 2011 concerning the Regional Spatial Plan of Bekasi Regency for 2011-2031, the efforts of the Regional Government to restore land rights lost due to the widening of the Bekasi river border. This research uses descriptive normative legal research methods, uses secondary data supported by primary data, and is studied qualitatively. The discussion that the status of land lost due to the widening of the Bekasi river border has been lost, the cause of which is the result of a natural phenomenon that makes the soil erode on the river border land. Local authorities can conduct additional research and address this issue in accordance with relevant laws. The study findings show that there are no regulatory provisions governing the status of lost land on riverbanks in Perda No. 12/2011 on the Bekasi District Spatial Plan 2011-2031. This means that efforts to recover lost land on riverbanks must be carried out in accordance with other regulations. The local government can help by developing policies to check and stop this problem from occurring further losses.

Abstract

The availability of green open space (RTH) is an obligation that must be fulfilled by every region, namely 30% as stipulated in the Spatial Planning Law. Regarding this RTH, it turns out that it does not correspond to the reality in the city of Pekanbaru. Therefore, this research will analyze two main problems. First, whether the availability of RTH in the city of Pekanbaru has complied with the Spatial Planning Law. Second, what are the constraints in fulfilling the availability of RTH and what efforts have been made by the Pekanbaru City Government to overcome these constraints. This research applies normative legal research methods. The results of this study reveal that Pekanbaru City has not met the 30% availability of green open space (RTH), facing obstacles such as limited land, budget constraints, and high land prices. Efforts that can be made by the Pekanbaru City Government include collaborating with investors and the private sector. In conclusion, Pekanbaru City has not met the RTH availability standards set by law due to these challenges. Collaboration with investors and the private sector is expected to address this issue and enhance RTH for the welfare of the environment and the community.

Abstract

Settlements located in the river basin area are often found in some urban areas. These settlements are not far from standing on the border area of the river flowing, especially those that occur in residential settlements around the border area of the Ciliwung River. This problem has occurred for a long time, causing various effects felt by the community. Of course, because of these identification problems, whether the implementation of settlement control in the Ciliwung River Basin, Manggarai Village, South Jakarta City is by the Jakarta Regional Regulation No. 1 of 2012 regarding the 2030 Regional Spatial Plan and how the efforts of the South Jakarta Administration City government can be made against the establishment of buildings in the Ciliwung River basin area based on the Jakarta Regional Regulation No. 1 of 2012 concerning the 2030 Regional Spatial Plan. In answering these problems, this study is executed using the Normative Juridical method of Descriptive Analysis, sourced from secondary data made from primary law and secondary legal materials, which are analyzed qualitatively so that conclusions can be drawn deductively. According to result the research and the conclusion that the Ciliwung River border area does not comply with the Jakarta Regional Spatial Plan, and for now, it is impossible to arrange the area in the area because there is no location determination from BWSCC.
