Abstract

Terbitnya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UUCK) memunculkan norma baru mengenai hak atas tanah di atas hak pengelolaan berupa hak guna usaha, hak guna bangunan, atau hak pakai. Hak-hak atas tanah di atas hak pengelolaan tersebut secara substansi merupakan hak pengelolaan, bagaimana jika hak-hak atas tanah di atas hak pengelolaan dibebani hak tanggungan sebagai jaminan hutang piutang. Padahal hal tersebut tidak masuk dalam Pasal 4 Ayat (1) UUHT. Penelitian ini merupakan penelitian yuridis normatif mengenai kepastian pembebanan hak tanggungan terhadap hak atas tanah di atas hak pengelolaan. Sebagaimana Pasal 13 Ayat (1) PP 18/2021 tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun, dan Pendaftaran Tanah bahwa hak atas tanah di atas hak pengelolaan dapat dibebani hak tanggungan. Tetapi, atas dasar rekomendasi dari pemegang hak pengelolaan dan diperjanjikan dalam perjanjian pemanfaatan tanah sebegaimana Pasal 13 Ayat (2). Ketentuan ini perlu disikapi secara cermat dan hati-hati terutama mengenai jangka waktu pemberian hak atas tanah di atas hak pengelolaan karena jangka waktu tersebut terkait langsung dengan pembebanan hak tanggungan dan jangan sampai memunculkan masalah di kemudian hari. Maka, perlu adanya pengaturan yang pasti mengenai jangka waktu dan perlu adanya sinkronisasi antara ketentuan UUCK dan PP 18/2021 dengan UUHT.The issuance of Law Number 11 of 2020 concerning Job Creation (UUCK) has created a new norm regarding land rights over management rights in the form of cultivation rights, building use rights, or use rights. The land rights above the management rights are substantively management rights, what if the land rights above the management rights are encumbered with mortgage rights as collateral for debts. Even though this is not included in Article 4 Paragraph (1) UUHT. This research is a normative juridical research regarding the certainty of the imposition of mortgage rights on land rights over management rights. As Article 13 Paragraph (1) PP 18/2021 concerning Management Rights, Land Rights, Flat Units, and Land Registration, that land rights over management rights can be encumbered with mortgage rights. However, on the basis of a recommendation from the holder of the management right and agreed in the land use agreement as referred to in Article 13 Paragraph (2). This provision needs to be addressed carefully and carefully, especially regarding the period of granting land rights over management rights because this period is directly related to the imposition of mortgage rights and should not cause problems in the future. Therefore, there is a need for definite arrangements regarding the time period and there is a need for synchronization between the provisions of UUCK and PP 18/2021 with UUHT.
