Abstract

Dalam rangka pemberian jaminan kepastian hukum tersebut, kepada yang mendaftarkan tanahnya akan diberikan satu dokumen tanda bukti hak yang berfungsi sebagai alat pembuktian yang kuat. Dalam ketentuan Hukum Tanah Nasional dalam hal ini Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah (selanjutnya disebut PP No.24/1997) hanya setifikat hak atas tanah yang diakui secara hukum sebagai bukti kepemilikan hak atas tanah yang menjamin kepastian hukum dan dilindungi oleh hukum.Permasalahan dalam penelitian ini adalah 1). Bagaimana Kekuatan Hukum Surat Keterangan Tanah Adat (SKTA) yang dikeluarkan oleh Damang Kecamatan Rungan Hulu, Kabupaten Gunung Mas? 2). Apa Dasar Kewenangan Damang Dalam Membuat Surat Keterangan Tanah Adat (SKTA)? 3). Apakah Surat Keterangan Tanah Adat (SKTA) bisa ditingkatkan statusnya menjadi sertifikat ?Dari masalah tersebut menunjukan kekuatan hukum Surat Keterangan Tanah Adat (SKTA) yang dikeluarkan oleh Damang adalah memiliki kekuatan Hukum secara Hukum Adat berdasarkan Perda Kabupaten dan Pergub nomor 13 tahun 2009 tentang adat dan Hak-hak Adat diatas Tanah di Provinsi Kalimantan Tengah dan diperkuatkan dengan Peraturan Pemerintah Nomor 24 Tahun 1997 dan Undang-undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria ditugaskan kepada Pemerintah, merupakan sarana dalam memberikan jaminan kepastian hukum

Abstract

This article explores and explains the customary sanctions (singer) of the divorce case of the adat law community in Sigi Village, Central Kalimantan. Problems that occur in society need to be appropriately resolved by prioritizing a sense of justice and a sense of peace by considering the legal provisions that apply in society. Divorce cases that occur are resolved by customary law as an option for the community, especially those who experience problems directly for both parties. The problems discussed in this article are related to the factors that cause divorce and the customary sanctions applied to the parties that cause divorce. The method used is through a qualitative approach, which seeks to understand and describe in-depth matters relating to the phenomenon of research or research, which intends to understand what is experienced by the research subject by describing it in the form of words and language. This particular context is natural and makes use of various scientific methods. The conclusion from the results of this individual research is that the factors that cause divorce in Sigi Village, Central Kalimantan are the existence of an affair or the presence of a third party in the household and sanctions in the form of the singer or customary fines, which refer to the previous customary marriage agreement letter, besides that the customary fine is imposed. Abstract

Stunting remains a critical public health issue in Gunung Mas, Central Kalimantan. This article aims to analyze the implementation of integrated legal policies in addressing stunting in Kurun Subdistrict using a juridical-empirical approach. The study highlights that despite various intervention programs such as community health posts (Posyandu), nutrition counseling, and the involvement of women’s groups (PKK), there is no local regulation that specifically governs stunting reduction. Research findings indicate that weak intersectoral coordination, limited access to health services, and low nutrition literacy are major obstacles. Conversely, the engagement of traditional leaders and local innovations like Jaga Huma Lewu hold great potential if formally integrated into policy. This study contributes to strengthening the legal perspective within child health policies and emphasizes the urgency of participatory and socially just local legislation. Thus, an adaptive and responsive legal approach is crucial for realizing children's rights protection and ensuring the sustainability of stunting reduction programs in underdeveloped regions.
