Abstract

The value of moral education contained in Surah Al-An'am verses 151-153 and Al-Isra' 23-39 The Koran is the word of Allah SWT has instilled character values ​​in Q. S. al-An'am verses 151-153 and Al-Isra 23-39 in the form of an education, namely the value of faith, the value of piety, devotion to parents, the value of responsibility, the value of love for peace, the value of justice, giving rights to relatives, prohibition of extravagant behavior, prohibition of being stingy, and prohibition of arrogance. 2) Application of the value of moral education in Al-An'am verses 151-153 and Al-Isra' 23-39 in life there needs to be a habituation interaction relationship carried out by the family by behaving by giving assistance to relatives, giving sodaqoh, gifts, not to waste wealth in a wasteful manner and then supported by the school in inculcating 18 personality or character values ​​in the form of tolerance, discipline, hard work, religious, love for the homeland, appreciating achievement, communicative, honest, creative, independent, democratic, fond of reading, caring environment, social care, curiosity, national spirit, love of peace, and responsibility.

Abstract

ABSTRACTA judge's legal reasoning is the main foundation in providing public service policies related to religion. Whether a judge actually gives a fair verdict or not, whether he is a person who understands very well the case to be decided or not, and whether he is religiously alim so that he is worthy of being a representation of religion and state or vice versa. Here the researcher examines one case as a representative of the picture, namely 1) What is the judge's consideration in the determination of marriage certificates in Judgment Number: No.3422/Pdt.G/2021/PA. Kab.Kdr? 2) Is there a religious basis that has been used as a handle (compilation of dalils) by the Religious Court as a basis for giving legal decisions? The results obtained are 1) The judge has given an exact verdict from the evidence that has been collected and is strong, only it is still weak in providing a foundation of religious rules. 2) The judge gives his ijtihad with the arguments that are curated so that each basis of the arguments used by the judge must differ between one judgment of the petitioner and the other petitioner in one similar case. From this research, at least there is a compilation of religious law arguments that are used as a basis by judges so that it will maintain the marwah of judges appointed by the state if they have limited time to find a basis for arguments to strengthen judges' decisions. Keywords: Marriage Certificates, Legal-Religious Propositions, Judges' Rulings, Religious Courts. ABSTRAKNalar hukum seorang hakim merupakan pondasi utama dalam memberikan kebijakan layanan publik terkait keagamaan. Apakah seorang hakim benar-benar memberikan putusan adil atau tidak, apakah dia seorang yang mengerti betul terkait kasus yang hendak diputus atau tidak, dan apakah ia memang benar-benar alim dalam agama sehingga layak menjadi representasi dari agama dan negara, atau sebaliknya. Di sini peneliti mengkaji satu kasus sebagai perwakilan gambaran, yakni 1) Bagaimana pertimbangan hakim dalam penetapan isbat nikah dalam Putusan Nomor: No.3422./Pdt.G/2021/PA.Kab.Kdr? 2) Adakah dasaran agama yang sudah dijadikan pegangan (kompilasi dalil-dalil hukum) oleh Pengadilan Agama sebagai landasan memberikan putusan hukum? Hasil yang diperoleh adalah 1) Hakim telah memberikan putusan yang tepat dari bukti-bukti yang telah dikumpulkan dan kuat, hanya saja masih lemah dalam memberikan landasan kaidah agama. 2) Hakim memberikan ijtihad sendiri dengan dalil-dalil yang dikuasai, sehingga setiap landasan dalil yang digunakan oleh hakim mesti berbeda antara satu putusan pemohon dengan pemohon lainnya dalam satu kasus serupa. Dari penelitian ini, setidaknya ada kompilasi dalil-dalil hukum agama yang dijadikan landasan oleh para hakim, sehingga akan menjaga marwah para hakim yang diangkat oleh negara apabila mereka memiliki keterbatasan waktu untuk mencarikan dasaran dalil sebagai penguat putusan hakim. Kata Kunci: Isbat Nikah, Dalil Hukum-Agama, Putusan Hakim, Pengadilan Agama.

Abstract

This research was motivated by Government Regulation Number 9 of 1975 concerning requirements that must be fulfilled by prospective brides and grooms who will carry out marriage registration. Namely Chapter II Article 3 Paragraph 3 PP No. 9 of 1975 The exception to this time period is due to an important reason, given by the District Head on behalf of the Regent, This means that there is still a gap provided if the waiting period of ten working days before the marriage takes place cannot be implemented for an important reason, namely by speeding up the registration of marriages, which should be recorded in 10 working days to less than that. Note that you must obtain written permission from the local sub-district head on behalf of the regent Research problem formulation, this is the reason why prospective brides and grooms propose to accelerate the acceleration of marriage registration and legal implementation of Republic of Indonesia Government Regulation Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974 Chapter II concerning Marriage Registration Article 3 Paragraph 3 at the Religious Affairs Office, Diwek District, Jombang Regency. This research is a type of research using field research, namely the researcher makes KUA, sub-district heads and candidates the bride and groom who applied for acceleration (dispensation) from the sub-district head. The data collection techniques use techniques. interviews, observation and documentation. The conclusion from the results of this research is that there are several factors that cause prospective brides and grooms to request accelerated marriage registration. Namely the economic factor. The prospective bride and groom will carry out a wedding which is used as an event moment along with their proposal in order to save financial expenses but are late in submitting their will or registering the marriage which must be more than 10 working days (more than two weeks) before the event. The cultural factor is that the marriage was registered and it took more than 10 working days and suddenly someone in the family died and asked for the marriage to be expedited before the body was buried. There is also the phenomenon of getting pregnant first which is included in the benefit factor, namely that prospective brides who become pregnant first will have their marriage registration expedited for an important reason, namely easing the moral burden on the family and saving the fetus in the womb. Implementation of accelerated marriage registration in PP No. 9 of 1975 Chapter II Article 3 Paragraph 3 in the KUA of Diwek District is in accordance with applicable regulations, but many people do not know about these procedures.

Abstract

Considering that parenting patterns are so important for children's development, it is necessary to conduct research on the application of parenting patterns, so here the researcher took the object in Sumbermulyo Village, where parents who married early did not seem ready to care for children, so they provided full care to them. his grandmother. In fact, it is not necessarily the case that the care provided by the grandmother is in accordance with the needs of today's children, especially since it is also found that parents easily give gadget freedom to their children, which then results in the child becoming addicted and cognitively declining. So the process of parenting children in the family must be supported by attention and encouragement from both parents.The type of research the author uses is qualitative, applying a qualitative descriptive approach. The data collection methods used are interviews, observation, documentation. And the data is analyzed by reducing the data, explaining the data, and drawing conclusions.The results of this research show that in practice, early married couples apply 2 parenting patterns for their children, such as a democratic parenting pattern and a permissive parenting pattern, which, if seen from the principles of hadlonah, they have indeed fulfilled, such as looking after, protecting, nurturing and caring for the child from the womb until the moment. This, and it has been fulfilled that he gives custody to his grandmother, but this has an impact on parents who apply a permissive parenting style to their children because implementing a permissive parenting pattern has the potential to make children unsupervised in their social interactions.

Abstract

The phenomenon of divorce in early married couples is not something that usually occurs in society, generally the factors that cause divorce among early married couples are economic, but in the Ngawi Religious Court, especially in Beran sub-district, there are several points that are the cause of the divorce, as in the problem formulation which the author has created will explain first what are the factors that cause the divorce of early married couples at the Ngawi Regency Religious Court? secondly, what are the efforts of parents and the efforts of the Ngawi Regency Religious Court to prevent divorce among early married couples? This research uses qualitative field methods, where the data obtained will be reduced using a descriptive method This research concludes that the first factor causing divorce in early married couples is a lack of mental readiness in couples who marry early, the second is economic factors, and the third is the lack of parental education regarding marriage, as for parents' efforts to prevent divorce in couples. The first is to give children time to ask questions about what is going on in their household, the second is to teach couples in early marriage how to earn a living. And the Ngawi Regency Religious Court's efforts to prevent divorce in early marriage couples, firstly rejecting the lawsuits of early marriage couples, secondly providing education to parents to advise children about facing marriage.

Abstract

Harmony in the household is the dream of every married couple. Harmony itself can be seen through harmony in the household, a sense of happiness, the rare occurrence of conflict in the household, and mutual feelings of love and affection. However, the reality that occurs in society is that marriages carried out before the age of majority/underage can have an impact on harmony in marriage, but early married couples themselves have strategies to create a harmonious household. The focus of the issues discussed are 1) What are the challenges and obstacles in realizing household harmony. 2) How harmonious are early marriage couples in Sodo Village, Pakel District, Tulungagung Regency. This research aims to find out the problems faced by early married couples and what methods early married couples use to create a harmonious household. This research uses research methods through field research which is descriptive qualitative in nature and data collection through observation, interviews and documentation. The conclusions of this research are as follows: 1) Challenges that occur in the households of early marriage couples in Sodo Village, sub-district. Pakel, District Tulungagung due to several reasons: emotional maturity, financial responsibility, poor communication, changes in roles and family and community pressure. And the obstacles that occur in the households of early marriage couples in Sodo Village, District. Pakel District Tulungagung due to several reasons: dependence of husband and wife on their parents, husband and wife's family interfering too much in their children's affairs, husband and wife not giving each other freedom, inner and outer living that is not fulfilled and differences in cultural and socio-economic backgrounds. Overcoming challenges and obstacles in the household requires awareness, patience and commitment from both parties to grow together and build a solid foundation for a harmonious relationship. 2) Early marriage couples in the village. Sodo District. Pakel District Tulungagung, always strives to make its household a harmonious household by: religious life in the household, creating an atmosphere of peace and feeling of comfort, having good communication between family members, respecting each other and accepting the shortcomings of husband and wife and working together with each other. have a sense of responsibility.

Abstract

The problem of unregistered polygamous marriages is an interesting issue. Marriages are carried out in accordance with the pillars and conditions, the presence of witnesses and guardians as determined by religion, but are not carried out in the presence of a marriage registrar (PPN). For those who are Muslim, both at the Kua and at the civil registry office for non-Muslims. Many polygamists are carried out only to satisfy their husband's desires. So there is a lack of public knowledge regarding unregistered marriages, especially polygamous unregistered marriages, with the aim of understanding the rights given to polygamists to be fair. This happened to the perpetrators of a polygamous serial marriage in Mojotengah village, Bareng district, Jombang district. Even though they are currently still living together, there are many problems occurring in their families, which is due to unfair factors in providing fair qualities to their wives. For this reason, the aim of this research is to explain the wife's rights in a polygamous serial marriage, and to explain the wife's rights in the complications of Islamic law. This research is qualitative field research with an empirical normative approach. In obtaining data, the author used three data collection techniques, namely interviews, observation and documentation. The author uses data analysis techniques in the form of objective interpretations. Based on the results of research in Mojotengah Village, Bareng District, Jombang, it can be concluded that this alternative requirement is an absolute requirement, meaning that one of the conditions must be present to be able to apply for polygamy. Meanwhile, the cumulative requirements for polygamy are requirements that must be fulfilled in a polygamy application. The rights of wives from sirri polygamy according to Islamic law, the rights of wives emerge from the time the marriage agreement is completed and Islam requires both parents to protect and provide for their children.

Abstract

Anak merupakan generasi masa depan bangsa yang mempunyai hak asasi untuk dilindungi, dipenuhi, dan dikembangkan mengacu pada prinsip-prinsip Konvensi Hak Anak yang telah diratifikasi oleh Indonesia berdasarkan Keppres No. 36 Tahun 1990. Namun, realitas di lapangan banyak anak masih menghadapi beberapa tantangan, seperti contoh kekerasan, eksploitasi anak, dan keterbatasan akses terhadap dunia pendidikan, yang seharusnya Lembaga pesantren sebagai institusi pendidikan berbasis keagamaan, Gerakan kaderisasi ulama serta keilmuan Islam yang juga mencerminkan protes terhadap kebijakan pemerintahan Belanda yang memiliki potensi signifikan untuk berperan dalam memenuhi hak-hak anak. Penelitian ini bertujuan untuk pengoptimalisasian perlindungan hak anak melalui lembaga pesantren anak studi kasus di pondok pesantrn miftahul mubtadiin nganjuk dengan menggunakan kacamata undang-undang. Penelitian ini menggunakan pendekatan kualitatif dengan metode penelitian lapangan. Teknik pengumpulan data dilakukan melalui observasi, wawancara, dan dokumentasi, sedangkan analisis data dilakukan dengan langkah-langkah reduksi data, penyajian data, dan verifikasi. Hasil penelitian ini menunjukkan:1) pelaksanaan perlindungan hak anak di pondok pesantren Miftahul Mubtadiin nganjuk terdiri dari tiga tahapan: perencanaan, pelaksanaan, evaluasi. 2) pengoptimalisasian menggunakan empat aspek: preventive (pencegahan), aspek represif (penangan kasus), aspek rehabilitatif (pemulihan), sinergi dengan orang tua dan masyarakat. 3) sesuai prespektif undang-undang di indonesia optimalsasi perlindungan hak anak yang ada di pondok pesantren miftahul mubtadiin nganjuk sudah memenuhi siklus mutu pendidikan yang dikenal dangan PPEPP (Perencanaan, Pelaksanaan, Evaluasi, Pengendalian, Peningkatan) meskipun kurang menjalin kemitraan dengan lembaga pemerintah dan LSM untuk memberi tambahan sosialisasi , pelatihan, dan penyediaan fasilitas ramah anak.

Abstract

Abstract. The Tepak Sirih tradition is a mandatory offering in the Malay customary marriage in Nongsa, Batam, viewed from the perspective of Islamic law. Tepak Sirih is an important symbol in Malay customs that is usually presented by the groom's side to the bride's side during the wedding ceremony. This tradition is believed to be a manifestation of respect, politeness, and a serious commitment to building familial relationships. Nevertheless, the indigenous community believes that a marriage without Tepak Sirih does not fulfill the values of tradition, even though it remains valid according to religion and state law. The Tepak Sirih tradition is classified as 'urf fi'li, which means a habitual practice continuously performed by the community and not in conflict with the principles of Islamic law. Therefore, although this tradition is not obligatory according to Islamic law, its implementation is still permitted and appreciated as part of preserving local cultural values. Abstrak. Tradisi Tepak Sirih merupakan seserahan wajib dalam pernikahan adat Melayu di Nongsa, Batam, ditinjau dari perspektif hukum Islam. Tepak Sirih merupakan simbol penting dalam adat Melayu yang biasa diserahkan oleh pihak mempelai laki-laki kepada pihak mempelai perempuan dalam prosesi pernikahan. Tradisi ini diyakini sebagai wujud penghormatan, sopan santun, serta komitmen serius dalam membangun hubungan kekeluargaan. Meskipun demikian, masyarakat adat menganggap bahwa pernikahan tanpa Tepak Sirih tidak memenuhi nilai-nilai adat, meskipun tetap sah menurut agama dan hukum negara. Tradisi Tepak Sirih digolongkan sebagai ‘urf fi’li, yaitu kebiasaan perbuatan yang dilakukan terus-menerus oleh masyarakat dan tidak bertentangan dengan prinsip-prinsip syariat Islam. Oleh karena itu, meskipun tradisi ini tidak bersifat wajib menurut hukum Islam, pelaksanaannya tetap diperbolehkan dan dihargai sebagai bagian dari pelestarian nilai budaya lokal.
