Abstract

Education is the most important key in human life. Without education, in the formation of character, character and personality of a good person it is impossible to happen. The public has recently been shocked by the world of education, where the Minister of Education and Culture of the Republic of Indonesia, Nadiem Makarim, sparked the concept of independent learning. The concept of independent learning is an effort to deal with the changing times, where the goal is that students are given comfort in taking education, for example, the nuances of learning that are usually only in the classroom are now outside the classroom, so students can learn with the outside environment. In addition, they will not only listen to the teacher's explanation but can also shape the character of students who are more courageous, independent, and easy to get along with. Then what about Islam itself? Actually Islam from the beginning has given freedom in learning, this can be seen in the lives of the prophets, where they can learn under any conditions and are not limited by anything including time. This research uses secondary data sources to obtain relevant information from existing sources. The approach used in this research is qualitative using documentation, observation, and triangulation techniques

Abstract

The background of this research is the existence of a "bettonan" contract that occurs among the Indonesian farming community. This contract is carried out with a distribution of 80%:20% of agricultural products; 80% for land owners and 20% for tenant farmers. This contract is a legacy from a long time ago that until now has not been touched by the government, resulting in the absence of regulations. This article tries to explore the legal nature of the “bettonan” contract and whether the distribution is in accordance with justice by considering the obligations of both parties to the contract (land owner and tenant farmers). The results of the study indicate that the "bettonan" contract transaction is in accordance with the concept of Islamic law and is included in the category of musyarakah muzaraah contract, and the distribution of results is in accordance with the principle of justice because the risk of tenant farmers is very small. In the end, this “bettonan” contract really needs to get a touch from the government law because it is very helpful in poverty alleviation efforts.

Abstract

On the muamalah side, Islamic law has changed due to social changes. Muamalah activities that consist of cooperation in experiencing changes in line with the needs of the time and place where it was inhabited by a group of humans. In cooperation, especially in the form of syirkah wujuh, from the beginning the main capital in this cooperation consists of “trust” as stated in Article 140 paragraph (1) compilation of Sharia Economic Law (KHES). In the development of parties that include Trust Capital there is a tendency to dominate other parties that include capital assets or goods. For this reason, it modifies by repositioning parties that include “Trust” Capital with the aim of realizing justice, namely balance in terms of profits and losses. This research method is in the form of Juridical-normative which emphasizes literature review (lebrari research) with a legislative and conceptual approach. The results of this study concluded that the party with the Capital “Trust” is positioned as a guarantor of cooperation dalan management of agricultural products. The repositioning is allowed in muamalah activities in accordance with the rules of jurisprudence made by fuqaha: “the change of fatwa due to changes in time, place, circumstances (intention) and Customs.” By repositioning, Islamic law becomes dynamic within the scope of muamalah, and is able to adapt, so that Islamic law is op tu date in accordance with the Times and needs of the community.

Abstract

One of the Islamic economic discourses that is often claimed to be the consensus of scholars (ijma') is the prohibition of bank interest, as evidenced by several statements and writings of contemporary Islamic economic experts. However, it is also a fact that there are many differing opinions among scholars regarding the law on bank interest. This raises several questions: Is the claim of ijma' on the prohibition of bank interest in accordance with the theory of ushul fiqh? Can it be considered ijma' when some scholars have different opinions? These questions can only be answered through an ushul fiqh approach by researching and understanding the normative study on the concept of ijma', which is extensively explained in ushul fiqh books. The conclusion derived from this study is that the ijma' on the prohibition of bank interest does not align with the principles of ushul fiqh. Therefore, it is more prudent not to dismiss the opinions of some scholars who justify bank interest. In other words, we can say that the prohibition of bank interest is the opinion of the majority of scholars, but it is not an ijma' as many people believe.
