Abstract

As it stated in the considering provision of Law number 32 year 2004 on Local government that “regional administration aimed to accelerate the realization of public welfare through improvement, services, empowerment, and community involvement, as well as enhancing regional competitiveness with underlined to the principles of democracy, equality, justice, privilege and specificity of a region within the system of the Republic of Indonesia”. To realize these goals, cooperation between local governments is needed, it is given that many regional affairs cannot be done by themselves unless in cooperation with other local governments. According to existing legal regulation, the inter-regional government cooperation is stated in various legal forms. Article 195 of Law Number 32 year 2004 choose Joint Decree as the legal form of inter-regional cooperation, while article 5 of the Government Regulation Number 50 year 2007 regarding Local Cooperation establish the cooperation in the form of Agreement. Besides those two legal form of inter-regional cooperation, Ministerial Regulation No. 22 of 2009 on the Technical procedure on inter-regional cooperation stipulate “memorandum of understanding” as form of understanding between two parties before the agreement is signed. Memorandum of understanding and agreement as the legal form of the inter-regional government cooperation is not recognized as legislation product of local government as it promulgated in Article 3 of Ministerial Regulation No. 53 of 2011 on the Establishment of the Regional Legislation Products. This paper aimed to identify the legal form of inter regional cooperation, such legal form is an important to bring legality principle for government action in creating cooperation.

Abstract

ABSTRACTThe regional administration based on autonomy often can not be done alone, butmust be undertaken in collaboration with other local governments. In the area of intergovernmental cooperation sometimes born disputes relating to the implementation of the agreed cooperation. To settle disputes born of cooperation among local governments are expected to finalize the parties amicably, but if consensus fails, then the settlement is done through the Governor or the Minister of the Interior. The dispute resolution emphasizes aspects of monitoring or politics. For the settlement of disputes which were born as a result of cooperation among local governments need to go through the courts, through the Supreme Court after deliberation and efforts through the Governor or the Minister of the Interior has been taken, but there are parties to a dispute can not accept the verdict.Keywords: Cooperation between local governments, Authority

Abstract

Indonesia’s target of achieving net-zero emissions by 2060 requires a massive energy transition, which must be implemented starting at the village level. Green energy independence at the village level will significantly contribute to the national energy mix target. Given that the energy transition entails a substantial financial burden, private sector participation is imperative. Green bonds have emerged as a viable financing instrument, with Village-Owned Enterprises serving as strategic entities for implementation. This study examines the challenges of accessing green financing to strengthen village capacity in undertaking energy transition initiatives. Employing a normative juridical approach—encompassing statutory, conceptual, and comparative analyses—the research highlights the critical role of green bonds, as one of the key financial mechanisms, in advancing village-based energy transition. The findings indicate that while green bonds are recognised as an important financing tool, their legal framework remains underdeveloped, thereby limiting their potential as an effective instrument of green financing

Abstract

Desa Gunungsari, Kabupaten Madiun, memiliki potensi yang sangat besar untuk dikembangkan menjadi desa wisata hijau (Green tourism-village). Di setiap akhir pekan Pasar Punden di desa Gunungsari ramai pengunjung dari desa-desa lainnya. Sistem perdagangan yang unik dengan menggunakan token dari bambu berwarna-warni menambah ketertarikan desa ini. Melihat geliat perkembangan yang ada saat ini, desa Gunungsari dapat dijadikan desa percontohan wisata edukasi lingkungan. Salah satu isu yang utama adalah pemilahan sampah. Kegiatan sehari-hari di desa Gunungsari, dan utamanya kegiatan akhir pekan di pasar punden menyisakan banyak sampah baik berupa sampah plastik dan nonplastik. Belum dilakukannya upaya untuk memilah sampah serta masih minimnya tempat pembuangan sampah menjadikan pentingnya edukasi bagi masyarakat mengenai pengelolaan sampah. Mendasarkan pada analisa kebutuhan tersebut, maka pendampingan ini digagas untuk memberikan pemahaman dan pendampingan atas potensi desa Gunungsari sebagai Desa Edukasi Lingkungan melalui pemilahan sampah dari tahap awal. Pemahaman ini penting untuk menghapuskan pandangan bahwa sampah hanyalah sampah dan tidak bermanfaat bagi masyarakat secara ekonomi. Dengan melakukan pendampingan atas potensi desa ini sebagai Desa Edukasi Lingkungan, diharapkan akan memberikan efek domino bagai desa-desa lain di sekitarnya, juga bagi masyarakat pengunjung mengenai pentingnya melakukan pemilahan sampah.
