Abstract

ABSTRACTStrict Liability is a principle in the settlement of environmental disputes. The dispute caused by environmental pollution or destruction. The principle is contained in the Act No. 32 of 2009 on the Protection and Management of the Environment. This principle raises issues in terms of its application. Nevertheless, strict liability is important in protecting all victims of environmental pollution or destruction.Keywords: strict liability, environmental pollution, environmental disputeINTISARITanggung jawab mutlak adalah sebuah prinsip dalam penyelesaian sengketalingkungan, khususnya sengketa karena pencemaran dan perusakan lingkungan. Prinsip ini terdapat dalam Undang-Undang No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Meskipun ada dalam undang-undang tersebut, prinsip ini menimbulkan persoalan dalam hal penerapannya. Meskipun demikian, strict liability penting dalam hal perlindungan semua korban pencemaran atau perusakan lingkungan hidup.Kata kunci: tanggung jawab mutlak, pencemaran lingkungan, sengketa lingkungan

Abstract

AbstractSatjipto Rahardjo’s Progressive Law (Hukum Progresif) is intended to be an antithesis to the modern law, but the philosophical foundation of this law is not so clear. This article, based on literature research, try to find out the philosophical basis for this kind of law. With research methods and particular approaches, the possibility of philosophical foundation are exlplored. First, in the basic ideas of Progressive Law such as “law for human, sociology oriented law, liberation law, etc.” we can see the philosophical direction of this law. Second, based on certain philosophy, we can say that the metaphysical anthropology, realism, process philosophy and “postmodernism” are the roots of philosophy of Progressive Law.Keywords :progressive law, philosophical foundation,postmodernismIntisariHukum Progresif dari Satjipto Rahardjo dimaksudkan sebagai antitesis terhadap hukum modern. Meskipun demikian, belum jelas landasan filosofis hukum ini. Dengan metode penelitian dan pendekatan tertentu dicari kemungkinan landasan filosofis bagi hukum ini. Pertama, berdasarkan ide-ide dasar Hukum Progresif seperti “hukum untuk manusia”, “orientasi sosiologis” dan “pembebasan”, arah dari filosofis hukum ini dapat diketahui. Kedua, berdasarkan filsafat tertentu dapat dikatakan, bahwa antropologi metafisika, realisme, filsafat proses dan postmodernisme merupakan akar filsafat dari Hukum Progresif.Kata Kunci : hukum progresif, landasan filosofis, paska modernisme

Abstract

This research is motivated by legal problems/issues related to the position of natural law related to the application of the principle of legality. The emergence of the principle of legality which later developed into a fundamental principle and is firmly held in the enforcement of criminal law is in line with the development of the flow of positivism. The principle of legality has a close relationship with positivism, if positivism emphasizes that outside the written legislation there is no law, then the principle of legality also determines that outside the rules of criminal law there is no criminal law. The close relationship between the principles of legality and positivism has given birth to a legal certainty in providing protection to criminals so that they are not treated arbitrarily by the rulers (kings) and judges. However, a problem arises that cannot be answered with positivism and the principle of legality which puts forward the written form of law as the only legal basis for convicting someone, namely when the development of crime is faster than the development of the law. Based on these conditions, it would be necessary to re-examine natural law, which actually contains general principles for the application of a more basic law, not only emphasizing the written aspect of the law. This research is a normative legal research that examines the legal principle, namely the principle of legality against natural law. This study of the principle of legality uses a conceptual approach by studying the doctrines/theories regarding the principle of legality to find out the study of natural law on the principle of legality, in order to provide a critique of the limitations of the principle of legality in accommodating the development of criminal acts. The results of this research are prescriptive, namely answering the problem by providing a proper solution (das sollen) to the formulation of the ideal legality principle to accommodate the development of criminal acts.

Abstract

Abstract Legal philosophy in Indonesia has the biggest role in the formation of law in Indonesia. Pancasila as a source of law contains the meaning of all regulations and laws, starting from our constitution and all regulations apart from our constitution, of course, Pancasila is the basis and foundation of the law. Pancasila is the Indonesian legal system. Therefore, Pancasila is not only known as a philosophy but also known as written law in Indonesia which contains living laws. The problem is how big is the role of Legal Philosophy in influencing the formation of the legal system in Indonesia. This question must be very important to answer. The author tries to examine this problem with normative law in the legal method. The approach taken by the author is taken from several books that contain related problems. Abstract

The problem with law enforcement for environmental crimes is that in prosecuting perpetrators of environmental crimes, the emphasis is still on the element of error. The implication of this problem is that it is difficult to prove environmental crimes, considering that the perpetrators of environmental crimes are not only people (natuurlijk person) but also include corporations (recht person). Legislation regarding the environment, especially Law Number 32 of 2009, has determined responsibility for perpetrators of environmental crimes using the strict liability theory. This article will discuss the implementation of strict liability theory to find the ideal concept for dealing with environmental crime. The method used in writing this article is normative legal research with a statutory approach. The results of this research are the ideal concept of corporate responsibility for the occurrence of environmental crimes in the form of payment of compensation (civil) and punishment of perpetrators (criminal sanction).
