<![CDATA[The existence of various cases of tender conspiracy decided by the Business Competition Supervisory Council shows that there are various construction work contracts formed by the practice of bid rigging. Therefore, the validity of a construction work contract that is proven to have been formed from a tender conspiracy should be tested academically. This research uses normative research and conceptual approach methods. The results of the study concluded that bid rigging is a form of fraud and causes construction work contracts to experience defects of will. Bid rigging signifies a collusive and deceptive provider selection process. Tender conspiracy that is not in accordance with the norms and principles in the selection of providers and the procurement of government goods/services. The provider selected from the tender conspiracy is the provider with bad intentions because he obtained his position in an unprocedural manner. Agreements formed through collusive tenders result in the formation of imperfect agreements and can be cancelled. The procedural step that can be taken if a construction work contract is formed through tender conspiracy is the termination of the contract by the Committing Officer.Key Words: Validity; bid rigging; construction work contractAbstrakAdanya pelbagai kasus persekongkolan tender yang diputus oleh Majelis Komisi Pengawas Persaingan Usaha menunjukan bahwa ada pelbagai kontrak kerja konstruksi yang dibentuk dari praktik persekongkolan tender. Oleh karenanya keabsahan kontrak kerja konstruksi yang terbukti dibentuk dari persekongkolan tender patut diuji secara akademis. Penelitian ini menggunakan jenis penelitian normatif dan metode pendekatan konseptual. Hasil penelitian menyimpulkan bahwa persekongkolan tender merupakan bentuk penipuan dan menyebabkan kontrak kerja konstruksi mengalami cacat kehendak. Persekongkolan tender menandakan proses pemilihan penyedia yang kolusif dan penuh tipu muslihat. Persekongkolan tender yang tidak sesuai asas dan prinsip dalam pemilihan penyedia dan pengadaan barang/ jasa pemerintah. Penyedia yang terpilih dari persekongkolan tender adalah penyedia yang beritikad buruk karena memperoleh kedudukannya dengan cara yang tidak prosedural. Kesepakatan yang terbentuk melalui tender yang kolusif mengakibatkan pembentukan kesepakatan yang tidak sempurna dan dapat dibatalkan.
