Abstract

Tujuan: Artikel ini bertujuan untuk mengelaborasi nilai Pancasila secara substansial dalam wujud Perjanjian terapeutik dengan tujuan memberikan penghormatan tertinggi pada harkat dan martabat manusia yang bermuara pada keadilan dalam dunia kesehatan khususnya pelayanan medisMetodologi: Tulisan ini merupakan hasil penelitian hukum normatif dengan pendekatan undang-undang dan pendekatan konseptual. Pendekatan Undang-undang dilakukan terhadap Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran, Peraturan Menteri Kesehatan Nomor 290 tahun 2008 tentang Persetujuan Tindakan Kedokteran. Pendekatan Konseptual dilakukan pada pengkajian nilai Pancasila sebagai dasar untuk  membangun model perjanjian terapetik dalam rangka pembaharuan hukum kesehatan.Temuan: Urgensi rekonstruksi yang memuat tentang prasyarat, bentuk formal versi digital, dan sanksi, yang keseluruhan disusun dan ditetapkan dalam bingkai nilai Pancasila, sebagai wujud pembaharuan hukum kesehatan di era digital.Kegunaan: Perjanjian terapeutik pada era Revolusi Industri 4.0 menggeser metode manual ke arah digital, sehingga perlu adanya pembaharuan hukum untuk meletakan nilai kemanusiaan, permufakatan, dan keadilan, melalui formulasi kontrak yang tepat dan dapat memberikan  perlindungan hukum bagi pelaku dan pengguna layanan kesehatanKebaruan/Orisinalitas: Keberadaan Tenaga Advokasi medis, merupakan novelty dari Perjanjian terapeutik yang kiranya dapat dikonstruksi sebagai hukum positif, dalam rangka pembaharuan hukum kesehatan.

Abstract

Children are the successors of the nation who will later make changes which are when they are in the womb until they are 18 years old. At this time there are many children who carry out criminal acts, for example violence as contained in decision No. 18/Pid.Sus-Anak/2022/PN Jkt.Brt which in this case the children used acts of violence simultaneously in the form of stabbing and kicking the victims which resulted in the victims suffering serious injuries and death. This writing uses the literature study method, this type of research is normative, this research is descriptive analysis in nature, and in drawing conclusions using deductive logic. The children's actions have met the qualifications of the articles charged against them and there are specific inclusions in Article 76C of Law no. 35 of 2014 concerning child protection, which is only specifically for each person to apply violence against children.

Abstract

Narcotics crimes have various kinds of sanctions that can be imposed on the perpetrator, one of which is the crime of abusing narcotics for oneself. In this case, the most appropriate sanction for perpetrators of narcotics abuse for themselves is action sanctions in the form of rehabilitation sanctions. However, often perpetrators of criminal acts of narcotics abuse for themselves are considered to be narcotics dealers because there are still no clear boundaries regarding the boundaries between the actions committed by narcotics abusers for themselves and narcotics dealers. For example, in the case where the defendant Hendra bin Zainuri committed a class 1 narcotics abuse crime for himself in Decision No. 522/Pid.Sus/2021/PN Mgl, it was decided under Article.

Abstract

Under Indonesia’s Anti-Corruption Law, asset confiscation is treated as a civil and in personam matter, further impeded by parliamentary opposition to the Asset Forfeiture Bill. This article examines deficiencies in Indonesia’s asset recovery framework through a comparative legal analysis with Islamic jurisprudence. Employing a critical–comparative approach, the study conducts a normative analysis of Law No. 20 of 2001 on Corruption Eradication, Law No. 8 of 2010 on Money Laundering, the Draft Asset Forfeiture Bill, and Law No. 1 of 2023 (the new Criminal Code), alongside Islamic legal sources. Anchored in the Islamic principle of radd al-maẓālim (the restitution of unjustly acquired wealth), the findings reveal that corruption encompasses both criminal and civil aspects. The study contends that the adoption of a non-conviction-based forfeiture mechanism—underpinned by a calibrated reverse burden of proof and robust judicial safeguards—could substantially improve Indonesia’s capacity for asset recovery. In practical terms, this research highlights the imperative of enacting comprehensive asset confiscation legislation as a fundamental component of Indonesia’s anti-corruption reforms.
