Abstract

Sumenep Regency has thousands of hectares of land used as salt ponds. Therefore, many people in Sumenep make a living as salt farmers. The salting process is carried out by salt farmers independently or in groups, also by PT Garam. The status of salt farmers is seen from the number of Madura salt production actors consisting of owner farmers and sharecroppers or mantong. There is an interaction between parties which may consist of landowners and salt farmers/mantong as well as workers/laborers who work at PT. Garam forms a legal relationship. In this legal relationship, there are differences in the systems used by the parties, such as employment relationships and partnership relationships, so this becomes an ambiguity regarding the status and rights of the workers. This article explores the following research questions: how is the legal relationship between salt pond workers in Sumenep Regency and have the rights of salt pond workers in Sumenep Regency been fulfilled? The purpose of this study is to find out the legal relationship of salt pond workers in Sumenep Regency and to find out whether the rights of salt pond workers in Sumenep Regency were fulfilled. The research type is empirical research and the approach used was empirical juridical. The results of this study are the effectiveness of statutory policies regarding clarity of worker status and the fulfillment of the rights of salt pond workers.

Abstract

Legal maintenance concerning violence case within household as stated by Act Number 23, 2004 about Violence erasing within household, still poor. That case related with problem within Substance of Act Number 13, 2006 about both Witness and Victim Protection, which less accommodate legal need for both witness and victim (including reporting person) therefore both witness and victim were less braveness to reveal criminal case occurred. Besides that, include problem within structure (especially presence protection institution for both witness and victim and legal actor) and society legal culture who tend to solve by kinship way. Struktur (aparat penegak hukum termasuk LPSK), substansi UU dan budaya hukum masyarakat yang cenderung menyelesaikan kasus KDRT secara kekeluargaan, berpengaruh dalam mengungkap terjadinya tindak pidana. Eksistensi UU Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban serta Peraturan Pemerintah Republik Indonesia Nomor 44 Tahun 2008 tentang Pemberian Kompensasi, Restitusi, dan Bantuan Kepada Saksi dan Korban telah menunjukkan kemajuan negara dalam memberikan perlindungan pada saksi dan korban. Politik hukum di masa mendatang berupa regulasi peraturan harus mengakomodir kebutuhan hukum untuk memenuhi rasa keadilan bagi masyarakat, khususnya saksi dan korban (termasuk pelapor), dimana peran LPSK harus proaktif, professional serta proporsional.

Abstract

This study examines the legal protection of child victims of immoral crimes committed by TNI soldiers in Military Court III-12 Surabaya. This study focuses on the effectiveness of military law in protecting children's rights and the challenges that arise in these cases. Using a juridical-sociological legal research method, data was obtained through interviews with judges and legal counsel, as well as analysis of laws and regulations. The research findings show that the protection of children in the military context is still inadequate. The provisions of military law, especially the KUHPM, focus more on sanctioning perpetrators than on the welfare of victims. Child protection is generally regulated in Law No. 35/2014 on Child Profeatection. However, law enforcement by Military Courts remains limited. This study highlights the need to improve the military legal framework to ensure better protection for child victims, especially in cases involving TNI soldiers
