Abstract

When ideological contestation in law is controlled by the logic of the majority. Then the consequences of the legal logic will be controlled by the logic of oppression. In this context, minorities whether based on religion, ethnicity, gender or sexuality are difficult to pursuit justice. Access to justice is possible as long as minority representation is also present in state law. This paper aims to examine the concept of legal pluralism in Progressive law. Thus, it will also provide alternative ideas for resolving the problem of discrimination of minority groups. Satjipto Rahardjo’s Progressive law has a philosophical basis that sees that the discourse of law is never be final and legal pluralism will provide justice. In the progressive law reasoning, legal pluralism will be discussed with recognition and redistribution political theory, so that it will tear down constellation of hierarchical structures and provides justice for minorities or “the others”. Therefore, state law is no longer the rule of majority.

Abstract

Artikel ini bertujuan untuk mengungkap tentang konsep hukum yang telah diinterpelasi oleh ideologi patriarki merupakan suatu kekerasan sistematik. Kajian ini menggunakan kritik ideologi a la Žižekian yang juga merumuskan suatu konsep tentang kekerasan sistematik. Dalam praktik kultural, patriarki telah menjadi suatu ideologi dominan yang menyebabkan normalitas keadaan sehingga praktik represi dan penindasan yang ada dalam masyarakat terselimuti sedemikian rupa. Slavoj Žižek mengkonstatasikan suatu konsepsi tentang kekerasan sistematik, yakni suatu kekerasaan yang berada dalam level ideologis yang dalam praktiknya menyublimasi suatu kekerasan yang pada akhirnya kekerasan ini tak dapat dilihat secara kasat mata dan menjadi pandangan yang lumrah bahkan kodrati. Konstelasi hukum yang ada dalam konfigurasi ideologi patriarki dalam praktiknya hadir sebagai alat kekuasaan yang represif dan diskriminatif. Dengan demikian, solusinya adalah melakukan destruksi atas proposisi ideologi patriarki adalah suatu keniscayaan untuk merumuskan kembali politik hukum yang berkeadilan gender yaitu dengan melakukan redefinisi gender dalam bentuknya yang jamak bukan gender dalam konstatasi biner.

Abstract

This article aims to study the identity politics embedded in local regulations in post-New Order Indonesia.  This study used Critical Discourse Analysis to uncover the configuration of identity politics embodied in law and local regulations. After the fall of the New Order regime, the Indonesian government chose decentralization of power, which led to a path to regional autonomy. In its dynamics, several regional policies and regulations tend to project local legal politics with primordialism and conservativism in forming social coherence. Many regulations were criticized because it tends to have a complex nuance for minorities. From the analysis of several regional regulations or policies, the most prominent trend was Islamic identity. This study showed that Islamic identity became popularized and intertwined with local populism because New Order's centralism repressed Islam in the political landscape. Thus, after the fall of the new order regime, decentralization becomes a channel to offer the repressed ideological fantasy of Islamic legality at an elevated level.

Abstract

This research analyzes the judicial implications of the Constitutional Court’s rulings on structured, systematic, and massive (TSM) violations in Indonesian elections, and their impact on democratic integrity. Using a socio-legal approach, it combines legal analysis with social science perspectives to examine how the Court interprets and applies TSM principles within a broader socio-political context. The study finds that while the Constitutional Court plays a pivotal role in upholding electoral integrity and safeguarding democratic values, significant challenges remain. Chief among these is the difficulty of proving TSM violations, which are often entangled with powerful political interests. These challenges can weaken public trust, hinder accountability, and contribute to a democratic deficit. The study concludes that more robust judicial mechanisms and clearer evidentiary standards are needed to ensure fair adjudication and strengthen Indonesia’s democratic institutions.

Abstract

This service was carried out with the aim of providing assistance to coffee processing MSME business actors in Pesantren Village in the form of business management skills and strengthening financial literacy in order to achieve competitive advantage. The methods used include observation, focus group discussion (FGD), and training activities. Initial observations generated data about Kopi Catra, a café in Batang Regency that still needs academic support to develop its business and maintain its existence. FGD activities were conducted by means of focused discussions on induction sources based on the alignment of science and understanding of business management skills, understanding and strengthening financial literacy, and trademarks. This activity involved stakeholders including MSME groups, village governments, community leaders and the Agriculture and Food Security Office. The results of the activity showed an increase in participants' understanding of business management, intellectual property protection (trademarks), and financial strategies that can be applied in their businesses.
