Abstract

Tujuan dilakukannya penelitian ini adalah untuk mengetahui apa saja kelebihan dan kekurangan dalam penyelesaian masalah melalui arbitrase dan bagaimana proses penyelesaian sengketa melalui arbitrase.  Denagn menggunakan metode penelitian yuridis normatif, maka dapat disimpulkan, bahwa: 1. Arbitrase adalah cara penyelesaian suatu sengketa perdata di luar peradilan umum yang didasarkan pada perjanjian arbitrase yang dibuat secara tertulis oleh para pihak yang bersengketa. 2. Adanya perjanjian tertulis meniadakan hak para pihak untuk mengajukan penyelesaian sengketa atau beda pendapat yang termuat dalam perjanjiannya ke pengadilan negara. Abstract

This study aims to provide an overview of the role of law enforcement and government in business competition to prevent predatory pricing practices using the Buy One Get One Free (BOGO) method and cheap redemption under Law Number 5 of 1999 concerning the prohibition of monopolistic practices and unfair business competition in modern retail markets. This research employs empirical legal methods focusing on the modern retail market, specifically on minimarket operators such as Alfamart, Indomart, and Alfamidi. The findings indicate that the competition authority (government) plays a significant role in preventing predatory pricing practices through: 1) market supervision, including monitoring market and business activities to detect signs of predatory pricing; 2) conducting thorough investigations into allegations of predatory pricing; 3) enforcing laws with decisive actions against businesses found guilty of predatory pricing; and 4) raising public and business awareness about the risks associated with predatory pricing practices. The research concludes that predatory pricing practices using the BOGO method can distort business competition and harm consumers, highlighting the crucial role of competition law in prevention.

Abstract

Fraud undermines public trust in the national banking system and causes financial losses to customers. Despite regulations like Law No. 10 of 1998 on Banking and Financial Services Authority (OJK) provisions, fraud enforcement in Indonesia remains suboptimal due to case complexity, weak oversight, and enforcement challenges. This study explores legal enforcement mechanisms for banking fraud by directors and contributing factors. Using a normative approach, the research analyzes laws, principles, and case studies. Data sources include the Banking Law, Limited Liability Company Law, OJK regulations, academic literature, and reports on fraud cases. Qualitative analysis links regulations to enforcement practices and identifies barriers. Findings show Indonesia's legal framework is comprehensive but inadequately implemented. Weaknesses include limited monitoring of directors abusing authority and difficulties in proving fraud involving complex data manipulation. Key obstacles include weak internal controls, minimal inter-agency coordination, and ineffective application of Good Corporate Governance (GCG) principles at the director level due to a lack of transparency and accountability. To address these gaps, the study recommends strengthening synergies between supervisory institutions and law enforcement, improving internal audits through independent reviews, and specialized training for handling financial cases. Instilling GCG principles among directors is crucial to prevent fraud. This study highlights the need for improved regulation and effective enforcement to enhance banking sector integrity.
