Abstract

Abstrak Indonesia adalah negara yang menjunjung tinggi hak asasi manusia. Hak untuk menyatakan pendapat, sebagai bagian dari hak asasi manusia, diatur secara khusus melalui Undang-Undang Nomor 9 Tahun 1998 tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum. Di tengah kontestasi dan polarisasi politik yang tengah terjadi, demonstrasi pun semakin marak terjadi. Hal ini turut menjadikan netralitas dan profesionalitas aparat kepolisian mendapatkan sorotan yang tajam dari berbagai kalangan masyarakat. Pembatasan kebebasan berpendapat di muka umum telah menimbulkan citra buruk bagi aparat kepolisian di mata masyarakat, akibat berbagai tindakan represif dan tidak terukurnya penggunaan diskresi yang kerap kali terjadi. Oleh karena itu, melalui metode yuridis normatif, tulisan ini akan menelisik bagaimana sejatinya negara menjamin akses dan keamanan atas seluruh bentuk penyampaian aspirasi masyarakat, termasuk dalam hal kebebasan memberikan pendapat di muka umum, serta menganalisis bagaimana seharusnya wewenang Kepolisian Negara Republik Indonesia terhadap penanganan unjuk rasa dilaksanakan. Kata Kunci: hak asasi manusia, kebebasan berpendapat, unjuk rasa, tindakan represif, aparat kepolisian. Abstract Indonesia is a country that upholds human rights. The right to express an opinion, as part of human rights, is specifically regulated through Law Number 9 of 1998 concerning Freedom of Expression in Public. In the midst of the ongoing political contestation and polarization, demonstrations were increasingly rife. This has helped to bring the neutrality and professionalism of the police to a sharp spotlight from various sections of the community. Restrictions on freedom of speech in public has created a bad image for the police in the eyes of the community, due to various repressive actions and unmeasurable use of discretion that often occurs. Therefore, through normative juridical methods, this paper will examine how the state truly guarantees access and security for all forms of public aspirations, including in terms of freedom of expression in public, as well as analyzing how the authority of the National Police of the Republic of Indonesia towards handling demonstrations implemented.
