Abstract

The position case originated from a gold trading agreement in which Eksi Anggraeni sold gold weighing 7 tons below the official price of a company named PT ANTAM to Budi Said. However, Eksi Anggraeni is not an employee of PT ANTAM. When there was a shipment of gold from Eksi Anggraeni to Budi Said, it turned out that the weight of gold sent by Eksi Anggraeni was not in accordance with what had been promised in the beginning. Then, Budi Said sued PT ANTAM with a lawsuit of Unlawful Acts. PT ANTAM should not be liable for the non-fulfillment of achievements by Eksi Anggraeni to Budi Said.

Abstract

Tujuan penelitian ini adalah untuk membahas hak-hak pekerja akibat pemutusan hubungan kerja dengan alasan telah memasuki usia pensiun menggunakan metode penelitian normatif. Berdasarkan hasil penelitian ini ditemukan bahwa terdapat celah hukum pasca berlakunya UU 11/2020 dimana ketentuan sanksi atas pelanggaran pemenuhan hak pensiun pekerja yang diputus hubungan kerjanya dihapuskan sehingga pengusaha dapat melakukan pemutusan hubungan kerja dengan alasan pekerja telah memasuki usia pensiun tanpa memperhatikan hak-hak pekerja tersebut. Penelitian ini menggunakan dua pendekatan yaitu pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini adalah memberikan formulasi perlindungan hukum terhadap pemenuhan hak pensiun buruh yang terkena pemutusan hubungan kerja sebagai Implikasi Hukum Atas Berlakunya UU 11/2020. The objective of this research is to discuss employee’s rights as consequence of termination of employment relationship due to entering retirement age by using normative legal research method. Based on the results of this study, it was found that there is a legal loophole after the enactment of Law 11/2020 where the provisions for sanctions for violating the fulfillment of the retirement rights of employers who are terminated were abolished so that employers could terminate their employment on the grounds that workers had entered retirement age without regard to the rights of the workers. This research was conducted using two approaches, the statutory approach and conceptual approach. The results of this study are to provide a formulation of legal protection for fulfilling the pension rights of workers affected by termination of employment as a Legal Implication for the Applicability of Law 11/2020.
