Abstract

As a “lex generalis”, matters that are not regulated shall refer to the Bill of Indonesian Criminal Code. Whereas the stipulations within the Bill of Indonesian Criminal Code are not yet mature in manifesting corporate criminal liability. The problem raised in this thesis is on the status quo of corporate criminal liability in the Anti-Corruption Law in Article 49 and 50 of the Bill of Indonesian Criminal Code and its prospects in the future. The result of this thesis is that the formulation of Article 49 results in overlapping criminal liability, thus it is necessary to see whether there is independence in giving commands. Meanwhile, Article 50 related to criminal abolition applied to corporations cannot be equated with persons so it requires to be further formulated in detail.

Abstract

Kitab Undang-Undang Hukum Pidana Indonesia yang berasal dari warisan kolonial Belanda masih menggunakan pendekatan keadilan retributif yang menekankan pada aspek pembalasan, sehingga terjadi pergeseran perspektif ke arah pendekatan keadilan restoratif. Keadilan restoratif berorientasi pada pemulihan keadilan dengan keterlibatan pelaku, korban, keluarga korban, atau pihak terkait. Khusus terhadap perkara tindak pidana kekerasan seksual, Pasal 23 Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual mengatur bahwa perkara tindak pidana kekerasan seksual tidak dapat dilakukan penyelesaian di luar proses peradilan. Sehingga penelitian ini menelisik secara mendalam terkait keadilan restoratif yang dikonsepsikan dalam Undang-Undang Tindak Pidana Kekerasan Seksual. Metode penulisan yang digunakan adalah yuridis normatif dengan mengkaji peraturan perundang-undangan yang dibantu dengan artikel, buku, dan literatur lain yang berkaitan dengan permasalahan a quo. Hasil kajian menunjukkan bahwa Undang-Undang Tindak Pidana Kekerasan Seksual menganut asas primum remedium sebagaimana dipertegas dalam Pasal 23 Undang-Undang a quo sehingga konsep keadilan restoratif yang diterapkan tidak berupa mediasi atau perdamaian antara pelaku dengan korban, melainkan dengan cara pemulihan hak-hak korban melalui restitusi, kompensasi, serta rehabilitasi dengan tanpa menghentikan proses hukum yang berjalan.

Abstract

Big Data brings new challenges in terms of competition law and data protection. The intersection of data regulation with competition law is due to the fact that most digital products are paid for by users and consumers online by providing their personal data. The author will discuss whether data breaches can be considered a violation of competition law, in light of the German Facebook case in which the Bundeskartellamt investigated whether alleged violations of data protection provisions could mean that Facebook abused its dominant position in the digital market. The research uses a normative legal method with a literature study. The results of the research show that abuse of the digital market cannot be drawn from mere dominance or unfair contract terms, but rather there needs to be a combination of market power and the absence of other options for contract terms. If Facebook users are given more choices regarding how their data is collected, they will be deemed to give voluntary consent under data protection law. This research can serve as a guideline for Indonesian lawmakers and competition authorities to adjust competition regulations, especially in the era of digitalization.
