Abstract

The rise of corporate crime cases has become a major catastrophe for environmental sustainability in Indonesia. However, the trial process takes a long time and it is not oriented towards recovery. Therefore, the authors use a juridical-normative research method to provide a comprehensive description of the Deferred Prosecution Agreement (DPA) with the paradigm of restorative justice and make the implementation of DPA in England and the United States as a benchmark. The implementation of DPA in Indonesia can create an effective and efficient environmental criminal law enforcement.

Abstract

The Indonesian Civil Code still refers to Burgerlijk Wetboek (BW), a legacy from the Dutch colonial era which inaugurated from Staatsblad 1847 No. 23. Since then, BW has become the main reference for civil law in Indonesia and remains in effect even after Indonesia’s independence. Based on Article 1 Transitional Rules of Indonesian Constitution. However, until now there has not been a new Civil Code Act as a substitute for the Dutch East Indies Civil Code which has been ratified. As the main legal basis, there are several problems such as the lack of clarity regarding the status of the Civil Code, difficulties in translation, and several articles in it that are not in accordance with the times. This article argues that the renewal of the Civil Code in Indonesia is an urgent matter by combing through articles that are still relevant and in accordance with the times.

Abstract

Dalam beberapa tahun terakhir, meningkatnya cuaca ekstrem, bencana alam, dan kerusakan ekosistem akibat perubahan iklim telah membawa ancaman bagi kelangsungan hidup manusia. Salah satu pihak yang berkontribusi terhadap hal ini adalah aktivitas korporasi yang memicu reaksi dari pihak-pihak tertentu untuk menuntut tanggung jawab perusahaan terhadap perubahan iklim di pengadilan. Untuk itu, tulisan ini akan membahas prospek dan tantangan litigasi perubahan iklim terhadap korporasi di Indonesia. Dengan menggunakan metode penelitian yuridis normatif yang bersifat deskriptif-analisis, tulisan ini menemukan bahwa penggunaan argumen hak asasi manusia dapat memperkuat argumen gugatan terhadap korporasi atas perubahan iklim. Tulisan ini berkesimpulan bahwa terdapat peluang keberhasilan litigasi perubahan iklim melawan korporasi di Indonesia.
