Abstract

Constitution 1945 has changed for times, however, there isno respect to the continuity of the district government which possess specific andspecial nature. Even the State recognizes and respects the Unity ofindigenous people including the living traditional rights and itis compatible with the development ofthe society and NKRI principle.

Abstract

The consequences of using these two chambers, it wipes out the district regulation/district representative and the composition of People's Consultative Assembly, so thatt here is no special position for the Indonesian National Armed Forces and The Indonesian Police Force at The People's Consultative Assembly. The Group Delegate and the representative of The Indonesian National Armed Forces and The Indonesian Police Force at The People's Consultative Assembly are deleted. It is taken because the apply of this people's representative system called bicameral as mentioned above namely Delegate and The Indonesian National Armed Forces/ The Indonesian Police Force can be manifestated through both Group two Legislative Board.

Abstract

Pilihan format politik Indonesia saat Ini adalah menjadikan stabilitas nasional di atas segalanya. Ini, mau tidak mau akan berakibat terjadinya dominasi kekuasaan atas hukum. Padahal, menurut Dahlan Thaib, dalam negara hukum Indonesia tidak boleh terjadi hukum berdiri pada satu sisi, sementara kekuasaan dengan angkuhnya seolah-olah menantang hukum di sisi yang lain. Maka sudah saatnya supremasi hukum untuk ditegakkan kembali, dan seharusnyalah pada era globalisasi ini hukum menjadi"panglima".

Abstract

Ide perubahan terhadap UUD 1945 selalu melahirkan kutub-kutub perbedaan antara yang pro dan yang kontra. Mungkinkah merubah UUD 1945? Pasal 37 UUD 1945 menegaskan bahwa wewenang untuk merubahnya ada di tangan MPR. Namun demikian, bagaimana cara atau sistem merubahnya? Pasal 37 UUD 1945 hanya memberii peluang untuk mengubah bukan mengganti UUD 1945. Karena itu dari sudut pandang Hukum Tata Negara, reformasi UUD 1945 dapat ditempuh dengan cara perubahan amandemen-amandemen bukan dengan cara mengganti UUD 1945

Abstract

The demand of reformation recently has opened the conscienceness of Indonesian people about their political rights that they didn't find and enjoy before, although those all are guaranteed by the constitution of Indonesia. The crowd of the discourse of democracy implementation has invited the participation of people in country organizing whether in the Center (Capital) or in the Territories (Provinces). These all according to the state structure constitution was very gladden for remaining the principle of teaching that open the opportunities to discourse forum to product the consensus to organize the democratic and justice in Indonesia. In territory autonomy contexts, the participation of people through house of territory representatives (DPRD) is very important for the principal that the territory autonomy policy must be put in front of the aspiration and the sake of people.
