Abstract

The problem of asylum seekers and refugees in Indonesia has become a national problem that needs to be addressed seriously by relevant institutions such as: Immigration Law Human Rights Ministry, Ministry of Foreign Affairs, The Coordinating Ministry for Political, Legal, and Security Affairs of the Republic of Indonesia, Ministry of Home Affairs, local government, TNI, Polri as well as various International and National Organizations, religious leaders, community leaders and so on . Apart from being able to cause a situation that is not conducive to society so that it can create its own unrest, this situation can also threaten the country's sovereignty and security. Supervision and law enforcement have begun to be drafted in clear regulations as well as solid governance and institutional management so that there is clarity regarding the supervision and presence of refugees from entering Indonesia to become refugees, resettlement and final reject in real action.

Abstract

the development of information technology, communication and transportation are tendency in terms of increasing relations between nations globally which drives human traffic between countries, giving rise to the complexity of the problems of human mobility between countries. Based on selective policy that upholds the value of human rights, regulated entry of foreigners into the territory of Indonesia, so also for foreigners who obtain a residence permit in the territory of Indonesia must be in accordance with the intent and purpose of being in Indonesia. Immigration crime is basically in addition to its nature as an international and transnational crime and is carried out individually or in an organized manner, it is also very detrimental and endangering to the community so that a severe criminal threat is needed in order to provide a deterrent effect for foreigners who commit violations. forms of supervision of foreigners, namely, supervision of foreigners, field supervision, immigration detention centers, and prevention and deterrence.

Abstract

The mobility of foreigners in Indonesia is very numerous and varied. One of them is an asylum seeker who entered Indonesia without immigration documents. In handling immigration violations and to accommodate the asylum seekers, an Immigration Detention Center was formed to provide them with the fulfillment of human rights. This study aims to identify and analyze the Semarang Immigration Detention Center in fulfilling human rights for asylum seekers and to identify and analyze the supporting and inhibiting factors faced. This type of research uses sociological juridical and data analysis using a qualitative approach method. The research data were obtained through interviews and documentation. Meanwhile, the data processing is done through data collection, data presentation, data analysis, and conclusions. The Semarang Immigration Detention Center itself in fulfilling human rights for asylum seekers is carried out by providing structured programs, namely health check services, providing food needs and providing access to education for asylum seekers. Supporting factors are the Semarang Immigration Detention Center in collaboration with related parties, namely PKBI and the Hospital to provide human rights fulfillment for asylum seekers and the enthusiasm of asylum seekers who always participate in the programs and activities given. The inhibiting factors are the absence of medical personnel who are on standby 24 hours, the unavailability of a warehouse for storing medicines, and the language used in communication as well as the different tastes of the food menu for each detainee there.

Abstract

ABSTRACT This research is motivated by the main problem in asylum seekers and refugees in Indonesia, namely the distribution of asylum seekers and independent refugees who are not recorded by the Directorate General of Immigration so that many of their existence and activities are not monitored. This study aims to explore the efforts that have been made by the Directorate General of Immigration in optimizing cooperation with IOM and UNHCR in handling asylum seekers and independent refugees in Indonesia and to establish an ideal form of cooperation between the Directorate General of Immigration with IOM and UNHCR in optimizing the handling of asylum seekers. and independent refugees in Indonesia. This research method uses Normative-Empirical which is essentially a combination of normative legal approaches with the addition of empirical elements. The normative-empirical legal research category used is Live Case Study. State Sovereignty Theory and International Cooperation Theory are used in this study. The results of this study found the problems faced by the Directorate General of Immigration both from the UNHCR, IOM, and internal DITJENIM itself in handling asylum seekers and independent refugees in Indonesia and forming an ideal cooperation agreement because previously there had never been between the Directorate General of Immigration with IOM and UNHCR in optimizing the handling of asylum seekers and independent refugees in Indonesia. Keywords: Cooperation, Handling, Independent Refugee ABSTRAK Penelitian ini dilatarbelakangi oleh permasalahan utama dalam pencari suaka dan pengungsi di Indonesia yaitu persebaran pencari suaka dan pengungsi mandiri yang tidak terdata oleh Direktorat Jenderal Imigrasi sehingga banyak dari keberadaan serta kegiatan mereka yang tidak terawasi. Penelitian ini bertujuan untuk mendalami upaya yang telah dilakukan oleh Direktorat Jenderal Imigrasi dalam mengoptimalkan kerja sama dengan IOM dan UNHCR dalam penanganan pencari suaka dan pengungsi mandiri di Indonesia dan membentuk bentuk kerja sama yang ideal antara Direktorat Jenderal Imigrasi dengan IOM dan UNHCR dalam optimalisasi penanganan pencari suaka dan pengungsi mandiri di Indonesia. Metode penelitian ini menggunakan Normatif-Empiris yang pada hakikatnya penggabungan antara pendekatan hukum normatif dengan adanya penambahan unsur-unsur empiris, kategori penelitian hukum Normatif-empiris yang digunakan ini adalah Live Case Study. Teori Kedaulatan Negara dan Teori Kerja Sama Internasional digunakan dalam penelitian ini. Hasil dari peneltian ini menemukan permasalahan-permasalahan yang dihadapi oleh Direktorat Jenderal Imigrasi baik dari sisi UNHCR, IOM, dan internal DITJENIM itu sendiri dalam melakukan penanganan pencari suaka dan pengungsi mandiri di Indonesia serta membentuk perjanjian kerja sama yang ideal dikarenakan sebelumnya belum pernah ada antara Direktorat Jenderal Imigrasi dengan IOM dan UNHCR dalam optimalisasi penanganan pencari suaka dan pengungsi mandiri di Indonesia.
