Abstract

Globalization has an influence on the implementation of relations between countries, between peoples, and between individuals become closer, influenced and dependent so as to create a condition of the borderless world. This is reinforced by the emergence of a crime phenomenon that crosses the borders of a country, known as Transnational Organized Crime. One form of transnational crime that became the main discussion in this journal is Smuggling of Migrants or Human Smuggling conducted in the territory of Indonesia. The cases raised are implementation and handling, especially those that have been implemented by the Police of the Republic of Indonesia in Dumai in 2017 which will be based on the point of view of immigration enforcement.

Abstract

The large potential for transnational crime in Indonesia is a problem that needs to be addressed. In this case it is a problem of human trafficking, these problems are very complex and complicated to solve. This trafficking is usually aimed at children and women. There are so many modes used by these perpetrators, one of them is through sending illegal Indonesian Workers. The government began to move specifically in the field of immigration in carrying out efforts to combat human trafficking in violation of human rights, because immigration is the front guard in examining people who leave or enter Indonesian territory. Selective policy helps immigration parties in the Immigration Examination Site in selecting foreigners who enter the territory of Indonesia. And immigration also supervises the sending of Indonesian Workers abroad. This supervision is intended to avoid sendingillegal Indonesian Workers.

Abstract

At immigration checkpoints, immigration officials usually place an immigration stamp both on manual and electronic immigration stamps, so that this paper uses a normative juridical approach which is research in this case conducted deductively starting with an analysis of the provisions in the laws and regulations governing problems related to the understanding of entry signs with make the one-door system (autogate) at one of the immigration checkpoints, for that reason it is needed to solve the problem in relation. The sign will not be separated from the stamp. The immigration seal itself translate in the Republic of Indonesia Minister of Law and Human Rights regulation number 28 of 2018 about the Immigration Stamp. Autogate is a means system that greatly helps the process of crossing people, with security on this system itself. However, the understanding of entry signs has deficiencies in explaining or describing the provisions and legal basis on autogate. Every policy in carrying out and even implementing a system.

Abstract

The problem of illegal immigrants has threatened the security and sovereignty of the Indonesian state. Even in 2013, the trend of illegal immigrants entering Indonesia increased by 12%. Most of them come from conflict-affected countries. Therefore, to prevent the increasing number of illegal immigrants from entering Indonesian territory, Indonesian immigration needs to strengthen border controls at the immigration checkpoints by continuing to implement immigration policy, namely selective policy. This policy only allows foreigners who provide benefits and does not endanger security and public order to be allowed to enter and reside in Indonesian territory. This policy supports the implementation of the immigration function, namely law enforcement and state security, particularly in preventing illegal immigrants who intend to enter Indonesian territory. The research method used is qualitative normative legal research with data analysis sourced from books, writings, scientific papers, and laws and regulations that are related to research.
