Abstract

Topik dalam penelitian ini adalah mengenai bagaimana cara menentukan suatu karya cipta music telah melakukan plagiat berdasarkan teori dan doktrin yang ada dan tercipta dengan adanya permasalahan yang sama, undang-undang hak cipta di Indonesia tidak secara komplek mengatur bagaimana suatu karya dapat dikatakan melakukan tindakan plagiarisme, oleh karena itu penulisan ini mengkaji bagaimana teori orisinalitas dalam suatu karya cipta menentukannya, dengan contoh kasus lagu rock legendaris asal amerika yaitu Stairaway to heaven milik Led Zeppelin yang di tuntun melakukan tindakan plagiarisme oleh skidmore wakil dari band Spirit dengan musiknya Taurus, Penelitian ini bertujuan agar dapat memberikan informasi mengenai cara menentukan unsur yang bisa disebut plagiat dalam dunia music atau terhadap karya cipta musik, metode penelitian yuridis normative dengan pendekatan case approach dan conseptual approach, dengan beberapa teori dan doktrin seperti Sweat of the Brow (Industrious Collection); Skill, Judgment, And Labour; The Idea-Expression Dichotomy; The Theories of Circumstantial Evidence; Extrinsic and Intrinsic Tests. Maka tindakan plagiat dapat di teliti lebih cermat dan ditentukannya nilai-nilai plagiarisme. The topic in this research is about how to determine a music copyrighted work has done plagiarism based on existing theories and doctrines and was created with the same problem, copyright law in Indonesia does not complexly regulate how a work can be said to commit acts of plagiarism, Therefore, this writing examines how the theory of originality in a copyrighted work determines it, with the example of the legendary rock song from America, namely Led Zeppelin's Stairaway to Heaven which was led to commit plagiarism by Skidmore, a representative of the Spirit band with his music, Taurus. can provide information on how to determine elements that can be called plagiarism in the world of music or music copyrighted works, normative juridical research methods with a case approach and conceptual approach, with several theories and doctrines such as Sweat of the Brow (Industrious Collection); Sk ill, Judgment, And Labor; The Idea-Expression Dichotomy; The Theories of Circumstantial Evidence; Extrinsic and Intrinsic Tests. Then the act of plagiarism can be examined more carefully and the values ??of plagiarism are determined.

Abstract

In an effort to encourage business actors to create fair and ethical business competition, the Business Competition Supervisory Commission (“KPPU”) recently issued a new regulation regarding the Competition Compliance Program. The core of this program is expected to be a tool to ensure companies comply with Competition Laws, and to detect any violations of Competition Laws in business. The need to influence behavior and motivate individuals or business entities to comply with regulations related to business competition is in line with one of the objectives of the theory Carrot and Sticks. This theory is based on the assumption that rewards and punishments can be effective instruments to encourage compliance and prevent fraud.

Abstract

Abstract Currently, Indonesia has not provided adequate protection of intellectual property rights (IPR) in the implementation of the Material Transfer Agreement (MTA). In providing the protection of the Indonesian nation's intellectual property on Genetic Resources (SDG) —especially those derived from genetic material in the form of biological material (DNA/RNA), clinical specimens, and non-biological material (related to human health), the Indonesia's Material Transfer Agreement (MTA) standard is still far from perfect. A Commercial Material Transfer Agreement (CMTA) is required which not only contains clauses on the exchange of genetic material but also contains more detailed provisions on Intellectual Property Rights such as Patents and Benefit Sharing. In this Journal, the author proposes a new framework for the Commercial Material Transfer Agreement (CMTA) which contains additional clauses from the current MTA, which is expected to further protect and encourage of new patentable invention in the future.

Abstract

This article aims to analyze Intellectual Property Rights, particularly Trademark Rights, as a form of protection for individuals who create creative works. This research uses a doctrinal approach in the field of law. The data is collected through qualitative analysis. This analysis focuses on the transition of the Lauw Ping Nio Portrait (Nyonya Meneer) from the “Jamu Cap Nyonya Meneer” brand to the “Minyak Telon” brand owbned by PT Bhumi Empon Mustiko. The results of this study conclude that the transition is legally valid, based on the state of bankruptcy of PT Nyonya Meneer.

Abstract

Sepak bola merupakan olah raga yang memiliki sejarah cukup panjang dan memiliki penggemar dari berbagai latar belakang dan juga usia, baik sebagai penonton dan/atau sebagai suporter. Sepak bola di Indonesia, diantaranya kompetisi profesional dan amatir, bernaung di bawah organisasi Persatuan Sepak bola Seluruh Indonesia (“PSSI”), sementara PSSI itu sendiri bernaung di bawah Fèdèration Internationale de Football Association (“FIFA”) sebagai organisasi pusat sepak bola secara global. Dalam perjalanan sejarah kompetisi sepak bola di Indonesia, pernah diwarnai oleh beberapa kasus yang begitu menyita perhatian, terutama kasus yang berkaitan dengan tindak kekerasan yang dialami konsumen sepak bola. Selain itu, yang juga tidak luput dari perhatian adalah standarisasi keselamatan, keamanan, dan ketertiban dalam stadion. Dalam hal ini, standarisasi tersebut merupakan tanggung jawab dari penyelenggara pertandingan. Kelalaian atau kesengajaan terhadap pelanggaran standarisasi keselamatan, keamanan, dan ketertiban dalam stadion oleh penyelenggara pertandingan juga dapat menimbulkan potensi terjadinya tindak kekerasan terhadap konsumen. Artikel ini akan menguraikan lebih lanjut mengenai doktrin Caveat Emptor dan Caveat Venditor dalam pertandingan sepak bola pada tragedy Kanjuruhan.

Abstract

Natural gas is a very important non-renewable natural resource that controls the lives of many people. Therefore, the exploitation and utilization of natural gas must be carried out wisely and for the greatest prosperity of the people. This is mandated in Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia that "Earth, water and the natural resources contained therein are controlled by country and used for the greatest prosperity of the people". With the promulgation of Law Number 22 the Year 2001 concerning Oil and Gas, there has been restructuring in the implementation of natural gas exploitation through pipelines in Indonesia. The law provides more space for private entities to engage in gas exploitation with the purpose to create healthy competition, transparency, improving national development, efficiency in exploiting natural gas and to develop competitive price so that the end consumer can enjoy the benefits. By its implementing regulations, namely, the Regulation of the Minister of Energy and Mineral Resources Number 19 of 2009, natural gas exploitation through pipelines is carried out through an “unbundling” and “open access” mechanism.

Abstract

A bankruptcy application can be submitted by the debtor or creditor with a minimal prerequisite, namely having at least 2 (two) creditors and having a debt that has fallen due and is payable in accordance with the provisions of Article 2 paragraph 1 of Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (“The Bankruptcy Law”). The ease of filing bankruptcy petitions has raised concerns about its potential to disadvantage debtors and perpetuate malpractices among bankruptcy petitioners. This concern is particularly evident in cases where debtors possess assets that exceed their outstanding debts, rendering them solvent rather than insolvent. A prime example of this issue is the landmark case of Putusan Pengadilan Niaga 48/Pailit/2012/PN.Niaga.Jkt.Pst, where the Commercial Court declared PT Telkomsel bankrupt without first establishing or obtaining evidence that PT Telkomsel's assets were less than its debt to PT PJI, thereby placing it in a state of insolvency. Based on this, the Author will examine the necessity of implementing an insolvency test whose provisions are currently adopted in Government Regulation Number 74 of 2020 regarding the Investment Management Institution.

Abstract

Actio pauliana is a legal remedy provided by law to annul the actions of a debtor that may harm creditors in the process of bankruptcy. One form of debtor actions that obstruct the fulfillment of creditors’ rights is found in the Supreme Court Decision No. 211 K/Pdt.Sus-Pailit/2019, which involves an unlawful act committed by the wife a mortgage to settle her debt. Based on this issue, the author conducts research to determine the legal position of join assets after being declared bankrupt duet o actio pauliana. The purpose of this research is to understand the legal standing of joint assets after bankruptcy is declared duet o actio pauliana and how bankruptcy law resolves joint assets issues as reflected in the decision under study. The research findings show that the actio pauliana action is the appropriate step to annul the unlawful transfer of property under the law, which is then returned to the bankruptcy estate to esnurethe fair fulfillment of creditors’ rights. The property involved in the transation must be returned to the trustee for the management and settlement of the bankruptcy estate. Additionally, the legal status of join assets resultig from actio pauliana must be borne by both the husbang and wife as long as they remain married, because during the marriage, both spouses share the responsibility for the payment obligations.
