Abstract

وجدنا كثيرا من القضايا والفتاوى في المعاملات المالية المعاصرة تستند في إصدارها إلى الحاجة، فيقول المفتي: هذا العقد جائز لوجود الحاجة إليه، ويقول المفتي الآخر هذا العقد لا يجوز لانعدام الحاجة إليه. يقول هؤلاء المفتون بهذا الإطلاق دون أن ينظروا إلى ضوابط وشروط الحاجة. فالحاجة إجمالاً تفيد التيسير والترخيص، ولكن ليس كل حاجة تفيد التيسير والترخص بحيث هناك الضوابط والشروط للحاجة لتنزل منزلة الضرورة في تحليل المحرم. خلال هذا البحث وجد الباحث أن شروط إعمال الحاجة هي: أن تكون الحاجة بالغة درجة الحرج والمشقة غير المعتادة، وأن تكون الحاجة متحققة يقينا أو ظنا، وأن تكون الحاجة متعينة، وألا يكون في الأخذ بالحاجة مخالفة لقصد الشرع، وألا يعارض الحاجة ما هو أقوى منها. ثم قام الباحث بتحليل هذه الشروط على مسألة أثر الحاجة في المساهمة في الشركات المساهمة المختلطة فوجد أن هذه الشرو لم تتوفر في هذه المسألة.

Abstract

The ever-evolving science and technology provide new innovations for the development of money. This development gave birth to electronic money which was widely used by the public. One of the causes of polemic towards e-money is how the fiqh ulama approach fiqh to top up e-money. Fiqh approach is very important for contemporary problems to punish a problem and its derivatives. The purpose of this study is to analyze how contemporary ulama approach fiqh towards the e-money top up contract. There are at least four fiqh approaches to top up e-money, namely al-Ijarah al-Maushufah fi Dzimmah, Wadi'ah, Qard, and Sharf. The method used in this research is a qualitative method with the type of library research. From the research results, it is found that the more appropriate fiqh approach when a customer top up e-money is the sharf contract, namely the exchange of currency with electronic money. With this approach, the discount given by the publisher to the customer is not usury but a gift that is allowed by syara 'as a promotional step for e-money issued by the publisher.

Abstract

Hajj bailout funds have a positive impact as well as a negative impact. One of the negative impacts of haj bailout funds is obscuring the meaning of istitā'ah in the implementation of hajj. This study aims to analyze the multi-contract law contained in the haj bailout contract. The research method of this article is an analytical method based on qualitative data. The author seeks research data on related themes by reviewing articles and conducting interviews with the Muamalat bank unit hajj bailout marketers. From this process, the researcher found that there was a merger of two contracts in the hajj bailout contract, namely the qard contract and also the ijārah contract. One of the important conclusions from this research is that the law of origin of multiple contracts is permissible. However, there is a combination that is forbidden according to the hadith; namely the merger between the qard contract and the sale and purchase agreement. This prohibition also includes the merging of all mu'awwahdāt contracts and qarḍcontracts including ijārah contracts. So the conclusion of this research is the forbidden haj bailout contract; because if there is a merger between the ijarah contract and the debt contract, it becomes a means of usury.
