Abstract

Penelitian ini membahas tentang Pertanggungjawaban Pidana Dokter Yang Melakukan Perbuatan Malpraktik Ditinjau Dari Pasal 360 KUH Pidana, penelitian ini didasarkan pada kasus malpraktek yang terjadi di Indonesia yang di dalam Pasal 360 KUHP tidak mengenal istilah malpraktek sehingga menimbulkan ketidakpastian hukum dalam hal batasan dan pertanggungjawaban pidana malpraktek medis. Penelitian menggunakan metode penelitian hukum normatif dengan analisis yang bersifat deskriptif. Bahan hukum yang di gunakan adalah perundang-undangan, studi kepustakaan, dan pendapat-pendapat para sarjana. Hasil penelitian ini menunjukkan; 1) Malpraktik jika dihubungkan juga dengan pengertian tindak pidana beserta unsur-unsurnya, dihubungkan dengan medikolegal dalam pelayanan medik serta dasar pemidanaan malpraktik dalam Pasal 360 KUHP maka batasan malpraktek terdapat pada bentuk kesalahan / kealpaan yang mengakibatkan orang lain luka berat. Dalam hal ini penekanannya adalah dari akibat yang ditimbulkan kepada orang lain (berupa luka berat) karena kesalahan/kealpaan orang tersebut. 2) Seorang dokter dapat diminta pertanggungjawaban secara dipidana melanggar Pasal 360 KUHP apabila memenuhi beberapa unsur diantaranya unsur kemampuan bertanggungjawab, unsur kesalahan, dan unsur tidak adanya alasan penghapus pidana, Akan tetapi, sebelum merujuk pada unsur-unsur pertanggungjawaban pidana terlebih dahulu harus dilihat kelalaian yang dilakukan oleh dokter baik mengenai resiko dalam pengobatan (risk of treatment) dan kesalahan penilaian (error of judgement).

Abstract

Business growth in Indonesia has resulted in an increase in civil disputes, particularly those resulting from breaches of business agreements. Many small and medium enterprises (MSMEs) experience difficulties accessing legal services due to financial constraints and limited legal knowledge. In this context, Legal Consultation and Aid Institutions (LKBH) play a strategic role in providing legal assistance and ensuring access to justice. This study uses a juridical-sociological method with a qualitative descriptive approach. The results indicate that LKBH's role in handling business breaches includes litigation and non-litigation assistance, legal consultation, and mediation. The main obstacles faced by LKBH include limited human resources and operational funds. This study recommends strengthening LKBH's capacity through institutional support and synergy with the government and business actors.

Abstract

This study aims to analyze the role of labor unions in achieving industrial relations justice in Indonesia and to identify whether the legal issues that arise stem from weaknesses in the norms or from the effectiveness of implementing the norms of freedom of association. This study uses a normative-conceptual legal method by examining constitutional provisions, labor laws and regulations, ILO conventions, as well as industrial relations theory and theories of justice. Data were obtained through a literature review encompassing primary, secondary, and tertiary legal sources, and were then qualitatively analyzed to assess the effectiveness of trade unions’ role within the national labor law system. The novelty of this research lies in the assertion that the primary issue in achieving industrial relations justice does not stem from a lack of legal norms, but rather from the gap between the normative guarantees of freedom of association and their implementation in industrial relations practice. The results of the study indicate that, normatively, the legal framework regarding freedom of association and the role of labor unions is adequate. Trade unions serve as providers of legal protection, balancers of bargaining power in collective bargaining, and facilitators of tripartite social dialogue. However, the effectiveness of these roles still faces obstacles in the form of limited institutional capacity, organizational fragmentation, increasing flexibility in employment relationships, and suboptimal law enforcement. The conclusion of this study is that efforts to improve industrial relations justice must be directed toward strengthening the effectiveness of the implementation of freedom of association norms through institutional strengthening of labor unions, consistent labor oversight, and the state’s commitment to ensuring substantive protection of the right to organize.
