Abstract

AbstrakPenelitian yang diterapkan adalah penelitian yang bersifat deskriptif analitis yang berarti mendeskripsikan mengenai permasalahan yang ada dan menganalisis masalah yang ada dengan mendasarkan kepada teori dan peraturan-peraturan yang berlaku. Pembuatan Akta PPAT yang berisi penghadap yang tidak sesuai dengan fakta yang ada akan menimbulkan sengketa pertanahan. Salah satu kasus pertanahan yang terjadi adalah terdapat seorang PPAT yang membuat Akta Jual Beli tanpa persetujuan dan sepengetahuan ahli waris. Akta Jual Beli tersebut kemudian digunakan untuk balik nama atas nama pembeli dan dilakukan penjaminan terhadap tanah tersebut kepada pihak ketiga. Oleh karena itu penelitian yang akan dihasilkan berupa analisis akibat hukum terhadap Akta Jual Beli dan upaya hukum yang dapat dilakukan ahli waris atas tindakan yang dilakukan oleh PPAT. Akta Jual Beli yang dibuat tanpa persetujuan dan sepengetahuan ahli waris mengakibatkan Akta Jual Beli dapat dibatalkan dan upaya hukum yang ditempuh oleh ahli waris atas kerugian yang dialami yaitu dengan mengajukan gugatan atas dasar perbuatan hukum terhadap PPAT.   Kata Kunci: Tanpa Persetujuan, Akibat Hukum, Upaya Hukum AbstractThe research applied is descriptive-analytical research, which describes the existing problems and analyzes the current issues based on the theory and applicable regulations. The making of the PPAT Deed, which contains an appearance that is not by the existing facts, will lead to a land dispute. One of the land cases that occurred was a PPAT who made a Sale and Purchase Deed without consent and knowledge of the heirs. The Sale and Purchase Deed is then used to transfer the name on behalf of the buyer and guarantee the land to a third party. Therefore, this study will produce an analysis of the legal consequences of the Sale and Purchase Deed and legal remedies that the heirs could reach for the actions taken by PPAT. The Sale and Purchase Deed made without consent and knowledge of the heirs resulted in the Sale and Purchase Deed being canceled and legal remedies that the heirs could take, namely by filing a claim for compensation based on legal actions against PPAT.Keywords: Without Consent, Legal Consequences, Legal Remedies

Abstract

The purpose of this study is to find out how the judge's consideration in revoking the Delay of Debt Payment Obligation on the request of the debtor who has been determined to be Debt Payment Suspension, but there are findings of the calculation of the management team of Debt Payment Delay which states that the assets (Activa) of the debtor are still larger. of obligations (liabilites) so as to ask the Court to revoke the Suspension of Debt Payment Obligations. In addition, it is necessary to know how the legal impact that will be received by debtors and creditors on Decision Number: 53/Pdt.Sus-PKPU/2021/PN.Niaga.Jkt.Pst. This study applies a normative juridical research method that makes court decisions as primary legal material and occupies a position after legislation. The primary legal data or materials analyzed in this study are court decisions, namely Decision Number: 53/Pdt.Sus-PKPU/2021/PN.Niaga.Jkt.Pst dated April 12, 2021 and Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations. Based on this research, it can be concluded that the application submitted by the debtor in the revocation of the Suspension of Debt Payment Obligations is appropriate because the revocation of the Suspension of Debt Payment Obligations is carried out by the Court based on the provisions stipulated in Article 295 Paragraph (1) of Law Number 37 of 2004 concerning Bankruptcy and Postponement Obligation for Payment of Debt, so that the Central Jakarta District Court has the authority to revoke the Suspension of Obligation for Payment of Debt at the request of the debtor.Keywords: Postponement of Debt Payment Obligations; Revoke PKPU; Bankruptcy; Commercial Court.
