Abstract

This article examines the dynamics of family law in the Islamic Republic of Iran where there are upheavals and struggles between the secular elites and ulama from 1927 to the present day. This study applied a library research by digging up information related to the theme of the study. The results of this study indicate that the Islamic Republic of Iran is dominantly Shia Imamiyyah (Jafari) but it also accommodates the Hanafi (Sunni) School in the field of marriage law. Iranian family law has gone through many changes. Since 1928 the issue of divorce and marriage which was originally regulated in Irans Qanun Madani came into force in 1930, the Marriage Law was then enacted in 1931. After three decades, in 1967 there was a reformation, the Marriage Law was replaced by the Family Protection act, then it was replaced with the Protection of Family in 1975. These laws are a combination of Islamic Law and French civil Jurisprudence, though they seem more secular. However, since the Iranian Revolution in 1979, these laws have been abolished and all laws in Iran have been returned to sharia law. As a result, the laws become repressive against women, except in the field of inheritance which provides gender equality. While there have been many highly educated women in Iran, since 2006 many women have filed for divorce. On the other hand, the practice of mutah marriage has begun to be abandoned and polygamy is opposed by the community.

Abstract

Artikel ini menelaah asal penciptaan perempuan dan mitos menstrual taboo, di mana merupakan akar historis pemahaman misoginis dalam Islam. Metode penelitian ini menggunakan kajian pustaka dengan pendekatan kajian tematik tafsif bi ar-ra’yi dalam perspektif gender dan analisis deskriptif-eksploratif. Hasil penelitian menunjukkan pemahaman tentang mitos-mitos di luar Islam pada era Jahiliyyah yang berpengaruh pada penafsiran ulama klasik yang terkesan misoginis terhadap perempuan. Kajian teks suci ini menunjukkan perempuan tidak diciptakan dari tulang rusuk bengkok. Hal ini melihat makna نفس (nafs) dalam berbagai konjugasi kata yang terulang 295 kali dalam al-Qur’an. Kata tersebut tidak hanya memiliki makna Adam secara spesifik, tetapi punya arti luas sebagai bangsa (ras). Sementara, mitos menstrual taboo memunculkan pemahaman menstrual creations. Hal ini dulu nampak tabu dan mendiskriditkan perempuan, berbeda dengan masa kini yang menjadikan bagian dari mode dan gaya hidup sehingga living ibadah sebagai bagian dari menstrual taboo. [The article talks the creation of women and the menstrual taboo myth that is the misogynistic understanding in al-Qur’an and Hadis interpretation. The method uses a library document with a gender issue and descriptive-exploratory analysis on tafsir bi al-ra’yi. The paper finds the history of pre-Islamic myths era in taking effect for classical scholars on exegeses of Misogynist perspective. The study of exegeses for al-Qur’an and hadis is not talking about the creation women from a crooked rib. It puts the meaning of the word ‘نفس’ (nafs) in 295 various conjugations. The word is not in meaning man “Adam” on specifically but has a big meaning in people generally sex. Meanwhile, the menstrual taboo myth sees for living menstrual creation. The era took the menstrual taboo for discrimination issue. Today the menstrual taboo changes for living religion practices with live style mode.]
