Abstract

Cultural heritage is the cultural heritage of the nation that should be preserved its existence. Makassar City Government has issued a policy as an effort to preserve cultural heritage as stated in Regional Regulation No. 2 of 2013 concerning Preservation of Cultural Heritage. The purpose of this study is to find out the effectiveness of the role of the Makassar City Government in preserving cultural heritage by using siyasah syar'iyyah analysis knives. This research is field research with data sources in the form of primary and secondary data. The results showed that the preservation of cultural heritage carried out by the Makassar City Government through the Makassar City Cultural Office was quite effective by looking at several indicators of performance effectiveness in Islam known as al-Fauz. The effectiveness of the role of the government is one of the elements of the principle of good governance or good governance that is in line with the principles of siyasah syar'iyyah.

Abstract

The natural disaster that occurred in Buakkang Village, Bungayya District, Gowa Regency in 2019 affected the damage to residents' homes and various village infrastructures. This study aims to describe the role of village governments in overcoming and restoring their territories after natural disasters. This type of research is qualitative research with a juridical and normative approach to syar'i. As the spearhead of the government, the Buakkang Village Government has carried out emergency technical measures in an effort to recover after a natural disaster, such as collecting data on the impact of damage, opening access to isolated roads through mutual aid actions and distributing assistance to affected residents. The limited recovery budget, caused the village government to classify the beneficiaries based on the level of economic ability of the residents. The responsiveness of the village government in the event of a natural disaster is the application of one of the principles of al Maqasih al Syariah, which is an effort to save the human soul (hifdz nasf).

Abstract

Regional financial management is an inseparable part of the implementation of government affairs which becomes regional authority as a result of the autonomous handover of government affairs. This study aims to find out how the role of internal supervisors in optimizing the financial management of the Bulukumba Regency Government. This research is field research. Optimization of financial management of the local government of Bulukumba Regency is carried out through tax intensification, the use of finance with the principle of accountability, conducting guidance and supervision in revenue management, the use of technology-based information systems, implementing a reward and punishment system to the regional revenue management apparatus, collaborating with the legislature, as well as conducting expenditure efficiency and supervising expenditures that have been included in APBD.

Abstract

This study aims to determine the effectiveness of supervising the construction of buildings with a one-stop integrated service system in Bulukumba Regency. This type of research is empirical legal research with a juridical and normative Shari'a approach. The results of the study show that the building construction supervision concept is applied by DPMPTSP Bulukumba with a system of building administration supervision, technical supervision, and imposing sanctions on development violations. In reality, supervision of building construction in Bulukumba Regency is still not running effectively due to the lack of Human Resources and public awareness. In the view of Islamic law, supervision of building construction in Bulukumba Regency does not contradict Islamic law, DPMPTSP has carried out its obligations as a supervisory institution based on applicable legal rules.

Abstract

This study aims to analyze the implementation of Regional Regulation No. 3 of 2003 concerning Muslim Clothing and Muslim Women in Bulukumba Regency. The type of research used is qualitative research with a normative juridical and normative theological approach. The results showed that formally, Regional Regulation Number 3 of 2003 as the basis for the enforcement of Muslim clothing and Muslim women is still valid today because it has not been revoked, but its existence needs to be evaluated. Because it has been valid for decades, so it needs to be observed whether its existence is still relevant, or needs to be substantially improved by following the times.

Abstract

Legal protection of the rights of women workers is the fulfillment of basic rights inherent and protected by the constitution, this is regulated in Law Number 13 of 2003 concerning Manpower which includes protection for women workers who are entitled to be accepted and must be provided by employers. This study aims to determine the legal protection provided and received by female workers in Indomaret Swalayan, Somba Opu District, Gowa Regency. This research is a field research conducted with a juridical approach, data collection methods in the form of primary data and secondary data obtained through observations, interviews, documentation, collected data are analyzed qualitatively. The results of the study are that legal protection for women workers in accordance with the mandate of Law Number 13 of 2003 has not been fully implemented because there are still unfulfilled rights of women workers, such as payment of overtime and leave wages, provision of menstrual leave, and shuttle services for female workers who work after 23.00. The fulfillment of rights should be an integral part of legal protection efforts, and should be the domain of supervision from the government.

Abstract

Sexual violence against women continues to increase. Komnas Perempuan recorded that there were 226,062 cases of sexual violence against women in 2020 increasing to 338,496 cases in 2021. Through Law Number 31 of 2014 concerning Protection of Witnesses and Victims, it contains rights that women should receive as victims of sexual violence. This study aims to reveal the implementation of the rights of women victims of sexual violence in the city of Makassar. This type of research is a qualitative field research with normative juridical and normative theological approaches. The results of the study show that sexual violence in Makassar City is still relatively high. In addition, the protection of the rights of women victims of sexual violence has not been implemented properly due to the lack of capacity of law enforcement to understand victims' rights, impunity for perpetrators, limited escort staff, culture of siri' society, and limited access to legal aid in the regions are obstacles in protecting and fulfilling the rights of victims of sexual violence.
