Abstract

Studies on the constitutionality of criminal threats against the Attorney General's Office (Head of the State Prosecutor's Office) in determining the status of confiscated narcotics and narcotic precursors, based on the Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics, it is very necessary to do so. The regulation has an over-criminalization nuance that is detrimental to the constitutional rights of the Kejari. The research aims to analyze the role of the state in protecting the constitutional rights of the Kejari within the rule of law framework. The scope of the research describes the structure of values or norms in statutory regulations and the principles it adheres to. Legal principles are used in interpreting the Narcotics Law by linking it to the rule of law framework. The research method is normative legal research using secondary data. The results of the research revealed that the provisions in Article 141 and Article 91 paragraph (1) of the Narcotics Law have the potential to violate the constitutional rights of the Kejari. because it is not in accordance with the protection of constitutional rights in the institutional structure of the prosecutor's office, which may not be intervened in criminal law enforcement. In conclusion, the state plays a major role in implementing the protection of the constitutional rights of citizens and Kejari officials. The state is obliged to fulfill, respect and protect the constitutional rights of citizens. Institutionally, the state synergizes with the prosecutor's office must affirm the ethical and administrative areas concretely and limitatively, so as not to cause obscurity of norms and excessive criminalization of non-criminal acts to become criminal acts.

Abstract

Banyak masyarakat yang belum mampu membeli rumah secara tunai menjadikan mereka membelinya secara kredit pada bank. Terkadang pembayaran secara kredit tersebut mempunyai kendala, yaitu terjadinya penunggakan. Hal ini dapat menjadikan nasabah melakukan  pengajuan permohonan pembiayaan Refinancing Syariah pada bank. Dengan demikian, penelitian ini membahas Refinancing Syariah pada produk pembiayaan aset di Bank Syariah Indonesia Kota Palembang dengan Akad Musyarakah Mutanaqishah. Adapun pokok permasalahannya yaitu apakah hal tersebut sudah sesuai dengan fatwa MUI tentang Refinancing Syariah. Metode penelitian ini menggunakan pendekatan studi kasus yaitu penelitian lapangan (Field Research) dengan memiliki akses langsung ke lapangan, seperti wawancara dengan pihak yang terkait, dan data yang diperoleh di Bank Syariah Indonesia yang diteliti, sehingga dapat dipertanggungjawabkan. Kemudian di analisis dengan cara deduktif yaitu menarik suatu kesimpulan dari suatu pertanyaan-pertanyaan yang bersifat umum kepada pernyataan yang bersifat khusus. Hasil penelitian menyimpulkan bahwa Refinancing Syariah dapat melakukan pembiayaan dengan Take Over/Top Up dimana nasabah mempunyai aset di bank lain kemudian tidak dapat membayar cicilan nasabah kepada bank tersebut. Oleh sebab itu,  nasabah mengajukan pinjaman ke bank lain untuk melakukan pembiayaan aset tersebut yang dinamakan dengan pembiayaan ulang (Refinancing Syariah). Dari segi rukun dan syarat, mekanisme serta ketentuan pada Refinancing Syariah telah sesuai dengan Fatwa MUI Nomor 89/DSN-MUI/XII/2013. Nasabah diperbolehkan dengan mengikuti rukun dan syarat, mekanisme serta ketentuan yang telah ditetapkan dimana dalam pembiayaan tersebut aset yang akan di Refinancing di beli oleh bank kemudian menjual kembali kepada nasabah kemudian nasabah membayar ke bank dengan cara mengangsur atau mencicil dalam jangka waktu tertentu yang telah disepakati, diakhir masa perjanjian maka dilakukan pemindahan kepemilikan aset dengan cara dihibahkan kepada nasabah.

Abstract

Procurement of goods and services in the public sector requires special attention to compliance with applicable laws and regulations, especially in terms of implementing procurement methods. One method used is direct appointment, which allows the Selection Working Group to appoint service providers without going through an open auction, with certain conditions. This study aims to analyze the authority of the Selection Working Group in implementing direct appointment in the procurement of consulting services at the Palembang Aviation Polytechnic, as well as to examine its implementation from the perspective of applicable law. This study uses a normative legal method with a statutory approach and case studies, involving an analysis of related laws and regulations, procurement documents, and interviews with related parties. The results of the study indicate that although direct appointment can be applied under certain conditions, its implementation at the Palembang Aviation Polytechnic often experiences obstacles in terms of transparency and accountability. This study also found that the authority of the Selection Working Group needs to be strengthened with stricter supervision to ensure that legal principles are maintained. The recommendations put forward are the need to improve understanding and training for members of the Selection Working Group and improvements in internal oversight mechanisms to optimize the implementation of procurement in accordance with legal provisions.
