Abstract

This study aims to seek and find legal certainty regarding the flow of the labelless snack trade licensing system through an online shopping platform in the city of Surabaya. This research uses normative research methods, namely research that examines the study of documents and archives, using secondary data such as legal theory, statutory provisions, and opinions from undergraduate graduates. This research was conducted by analyzing the principles, theories and legal concepts as well as statutory provisions related to the online licensing system in terms of trading of unlabeled snacks through online shopping platforms. The problem in this research is that there are still many unlabeled snacks that have the potential to harm consumers. The researcher uses a concept that has been designed in such a way as to find legal certainty regarding the management of a labelless snack trade licensing system, in which in this case the rights of consumers are not fulfilled and the obligations of business actors are not carried out properly and correctly

Abstract

ABSTRAK Penelitian ini mengkaji tentang pembebanan hak tanggungan dalam akad pembiayaan pada bank Syari’ah dan kesesuaian terhadap eksekusi hak tanggungan tersebut dengan prinsip Syari’ah. Penelitian ini merupakan penelitian normative yang dilakukan dengan cara meneliti dengan bahan pustaka atau bahan hokum sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan- peraturan khususnya KUHP Perdata, Peraturan tentang jabatan PPAT, Undang Undang Hak Tanggungan, Undang Undang Perbankan, Undang Undang Perbankan Syari,ah dan Kompilasi Hukum Ekonomi Syari,ah serta Putusan dan Fatwa DSN yang berkaitan dengan objek penelitian selain itu sebagai pendukung digunakan pendekatan analisis konsep hokum dan pendekatan kasus yaitu dengan cara melakukan tela,ah terhadap akta PPAT dalam bentuk SKMHT maupun APHT yang dibuat sebelum dilakukan Pembebanan Hak Tanggungan di kantor pertanahan setempat. Hasil penelitian menunjukkan pembebanan Hak Tanggungan dalam akad pembiayaan syari,ah tidak tepat karena tidak memenuhi syarat sah nya akad berupa bertentangan dengan undang undang yang berkaitan dengan syarat sahnya perjanjian yaitu kausa yang halal, maka pembebanan hak tanggungan terhadap akad pembiayaan pada bank syari,ah dapat dikatakan tidak sah dan mengakibatkan pembebanan Hak Tanggungan tersebut batal/ batal demi hokum. Kata Kunci: Hak Tanggungan, dan Bank Syari’ah

Abstract

Employers often ignore the rights of outsourced employees. Companies that use the services of workers often hire or deliberately outsource to lower labor costs, but the protection and working conditions offered are far from what is usual, which can put workers and the outsourced workers at risk. Unrest among employees is no doubt caused by this happening. Outsourcing is not specifically recognized as a practice under Law Number 13 of 2003 concerning Manpower. Law Number 11 of 2020 concerning Job Creation, which was recently passed, revised some of the provisions of Law Number 13 of 2003 concerning Manpower, one of which relates to provisions regarding outsourcing workers. However, it must be determined whether these structures provide sufficient legal protection for outsourced employees. Therefore, the authors are of the opinion that in order to fully understand the principle of legal certainty which will be discussed in this article, it is necessary to carry out analysis and research related to legal protection for outsourced workers
