Abstract

Latar belakang: Dalam pembiayaan bermasalah pihak bank perlu melakukan penyelamatan, sehingga tidak akan menimbulkan kerugian, pnyelamatan yang dilakukan apakah dengan memberikan keringanan berupa jangka waktu atau angsuran terutama bagi pembiayaan terkena musibah atau melakukan penyitaan bagi pembiayaan yang sengaja lalai untuk membayar. Tujuan penelitian: Tujuan dari penelitian ini adalah untuk mengetahui bagaimana penanganan pembiayaan bermasalah pada Bank BNI Syariah Cabang Cirebon, bagaimana strategi penyelesaian pembiayaan macet pada Bank BNI Syariah Cabang Cirebon serta penyebab terjadinya pembiayaan macet dan bagaimana solusi pembiayaan macet pada Bank BNI Syariah Cabang Cirebon. Metode penelitian: Penelitian ini menggunakan metode deksriptif kualitatif. Penelitian ini dilaksanakan di Bank BNI Syariah Cabang Cirebon, karena penelitian ini untuk menguji strategi penyelamatan pembiayaan bermasalah pada Bank BNI Syariah Cabang Cirebon. Hasil penelitian: Pembiayaan berdasarkan prinsip syariah adalah penyediaan uang atau tagihan yang dipersamakan dengan itu berdasarkan persetujuan atau kesepakatan antara bank dengan pihak lain yang mewajibkan pihak yang dibiayai untuk mengembalikan uang atau tagihan tersebut dalam jangka waktu tertentu dengan imbalan atau bagi hasil. Mengenai pembiayaan itu telah diketahui Negara dan sudah diatur pula dalam peraturan menteri keuangan. Mekanisme pembiayaan bermasalah itu dari unit cell untuk melakukan penginputan data nasabah yang mengajukan pembiayaannya. Jika terjadi kemacetan pembiayaan. Strategi untuk mengurangi pembiayaan macet, Bank BNI Syariah itu harus membentuk divisi atau bidang penyelamatan dan penyelesaian pembiayaan bermasalah. Bank-bank syariah juga harus meningkatkan kompetensi SDM agar bisa mengatasi pembiayaan bermasalah dan mampu melakukan restrukturisasi pembiayaan secara syariah. Kesimpulan: Berdasarkan penelitian didapatkan kesimpulan bahwa pembiayaan adalah sebuah kegiatan yang mampu membantu masyarakat dalam melaksanakan kegiatan sebagai sarana untuk bisa memenuhi kebutuhan dalam kehidupan sehari-hari.

Abstract

The development of the world situation, actors, and information technology make the direction of diplomacy traditional diplomacy shifts to more modern diplomacy, in this case public diplomacy. The development of information technology makes the choices of diplomacy tools become diverse. Previously, diplomacy was colored by related issues with 'war', now that's the issue increasingly shifting. War is not non-existent, but emergence of other issues such as the environment, tourism, terrorism, health, human rights are the targets of public diplomacy. The purpose of this research is to know the role of public diplomacy as an instrument of foreign policy and conclude the role of public diplomacy as a strategy for achieving foreign policy . The research specification used in this research is descriptive type of analysis and literature review which focuses on searching for both primary and secondary data. Public diplomacy is interpreted as a process of government communication to the public foreign countries which aims to provide an understanding of the country, attitudes, institutions, culture, national interests, and the policies taken by the country . Impact caused include the political, economic, social, and in its implementation no longer monopolized by the government . This study focuses on the problems of why public diplomacy is used as an instrument of foreign policy (conceptual ), how is the communication strategy in public diplomacy to determine foreign policy and how Soft Power influences the framework of public diplomacy in foreign policy. The results of the study indicate that public diplomacy has a major influence on the decision to determine foreign policy.

Abstract

The development of digital technology has encouraged the emergence of digital activism as a new means for citizens to voice opinions and fight for socio-political rights. However, in Indonesia, this space for digital expression is often faced with repressive regulations, particularly through the use of rubber articles in the Electronic Information and Transaction Law (ITE Law). This research aims to critically analyze the legal boundary between freedom of expression and hate speech in the context of digital activism, identify potential abuses of digital law against activists and citizens, and offer a just and democratic juridical framework. Using a descriptive qualitative approach with a case study method, data was collected through documentation of legal regulations, interviews with key figures, and netnographic observations on social media. The results show that ITE Law is often used as an instrument to silence political expression, with the trend of reporting against activists increasing in the last four years. The unclear definition of hate speech and the absence of explicit protection for political expression worsen the conditions for digital democracy. This research recommends digital regulatory reforms, including the establishment of an independent oversight body and affirmation of the legal boundary between criticism and hate speech, to guarantee civil rights in the cyber era.
