Abstract

Pendidikan nasional di Era Reformasi ini diarahkan kepada pencapaian tujuan tertentu sebagaimana tersurat dalam UU Nomor 20 Tahun 2003 Tentang SISDIKNAS, bahwa “pendidikan nasional bertujuan mencerdaskan kehidupan bangsa dan mengembangkan manusia Indonesia seutuhnya. Pendidikan Islam sebagai sub-sistem dari sistem pendidikan nasional mencita-citakan terbentuknya muslim seutuhnya, ya’ni seorang muslim Indonesia yang berkualitas dengan tetap menjaga budaya bangsa yang mulia. Dengan demikian pendidikan mengarah kepada pencapaian nilai–nilai yang luhur dan selaras bagi kehidupan muslim yang bercirikan Indonesia. Akan tetapi dalam perjalanannya, akhlak menjadi hanya sekedar adab atau tatakrama, kehilangan substansi filosofisnya; moralitas umat Islam Indonesia mengalami krisis akhlakul karimah, dan keshalihan ritual seringkali tidak berkorelasi positif dengan keshalihan sosial. Peran pesantren sangat dibutuhkan melalui pendidikan alterntif berupa Ilmu Tasawuf, karena ilmu tasawuf dapat meningkatkan akhlakul karimah, sebagaimana bukti bagaimana keberhasilan pesantren yang mendidik santrinya dengan mengintegrasikan ilmu tasawuf ke dalam kehidupan sehari-hari, sehinga akhlak santri benar-benar meningkat sebagai akhlakul karimah. Berdasarkan hal tersebut, penelitian ini dilaksanakan dengan fokus yakni Bagaimana Ilmu Tasawuf sebagai Alternatif Pendidikan Pesantren dalam Meningkatkan Akhlak Santri kepada Allah, Sesama, dan Lingkungan di Pondok Pesantren Miftahul Ulum Desa Glagahwero Kecamatan Kalisat Kabupaten Jember? Penelitian ini merupakan penelitian kualitatif, dengan obyek penelitian adalah Pondok Pesantren Miftahul Ulum Desa Glagahwero Kecamatan Kalisat Kabupaten Jember. Metode yang digunakan dalam penelitian adalah metode purposive sampling dengan teknik pengumpulan data menggunakan observasi, interview, dan dukomentasi. Setelah data terkumpul maka data tersebut dianalisis dengan analisa data reflective thinking. Berpijak pada kajian teroritis yang dilanjutkan dengan hasil paparan dan analisis data, maka diperoleh hasil penelitian bahwa, Ilmu tasawuf sebagai alternatif pendidikan pesantren dalam meningkatkan akhlak santri kepada Allah SWT, akhlak santri kepada sesama dan akhlak santri kepada lingkungan hidup, merupakan bentuk pendidikan yang kompleks melebihi pendidikan non-pesantren dengan ilmu tasawuf sebagai pendidikan alternatifnya. Dalam hal ini, ilmu tasawuf diajarkan melalui pengajian kitab-kitab kuning, melalui praktek akhlakul karimah, dan melalui amalan-amalan berupa tarikat/wiridan yang dibiasakan setiap waktu. Hasilnya, ilmu tasawuf sebagai pendidikan alternatif pesantren yang diajarkan di Pondok Pesantren Miftahul Ulum Glagahwero Kecamatan Kalisat Kabupaten Jember telah mengantarkan santri berakhlakul karimah lebih meningkat dari pada sebelum menerapkan ilmu tasawuf sebagai pendidikan alternatif pesantren.

Abstract

In 2019, the world was stirred by the outbreak of the COVID-19 virus, including in Indonesia, it had an impact on changes in the existing order, including marriage. Through Circular Number: P-001/DJ.III/HK.007/07/2021 Regarding Technical Instructions for Marriage Services at the Office of Religious Affairs During the Enforcement of Restrictions on Community Activities, with regard to the implementation of marriages, it is regulated in a different way than before the outbreak Corona virus, including the obligation of an antigen swab for the penghulu, prospective brides and witnesses 1x24 hours at the implementation of the marriage contract. This obligation is certainly a new and very interesting thing to do an in-depth study. This research includes normative legal research using qualitative methods, while the type of research includes literature research and is qualitative using descriptive analysis, the legal sources used include primary and secondary legal sources. The results of his research are the urgency of the antigen swab as a marriage requirement as a preventive measure. The antigen swab test is in accordance with the five main objectives of Islamic law, especially to protect the soul, so the antigen swab test is a process that must be carried out by the head of the bride and groom and witnesses in an effort to find out what is affected by the corona virus. In the category of protecting the soul, the pre-marital swab test process is included in the maqashid dharuriyyat category which is a primary need for humans because it will threaten the safety of life.

Abstract

In reality, the customary rules of marriage between one indigenous people are different from other indigenous peoples, between one tribe is different from another, between those who are Muslim are different from those of other religions, as well as there are differences in marriage customs between urban and rural communities. other. Customs that have become a customary law will be more difficult and stronger because violations of them will meet with a sanction in accordance with the regulations that apply and are obeyed in that society. Including the custom followed by the people of Tenggulun Village, Solokuro District, Lamongan Regency where there is a prohibition on marriage caused by mangku dalan and temu corner when it is not complied with, then in the future the family will experience bad luck in the household. The results of the study found that customs in marriage in the form of prohibitions on mangku dalan customary marriages and corner gatherings carried out by the people of Tenggulun Village, Solokuro District, Lamongan Regency according to 'urf are included in 'urf shahih because they are considered not to conflict with syara law'. Meanwhile, according to Islamic law and Law No. 1 of 1974 there are no prohibitions like the above, and the public's reason for these prohibitions is only to get safety, good luck, and blessings from Allah SWT.

Abstract

Poligami adalah seorang laki-laki yang mempunyai isteri lebih dari seorang. Dasar poligami sebagaimana yang termaktub dalam Al-Quran Surat An-Nisa’Ayat 3. Berawal dari perbedaan pandangan dalam menafsirkan QS An-Nisa’ Ayat 3 tersebut berdampak pada perbedaan hukum poligami. Perbedaan yang terjadi tidak hanya pada kalangan tokoh-tokoh pemikir Islam namun juga terjadi pada aspek penerapan hukum keluarga khususnya masalah hukum poligami di Negara-Negara Muslim. Secara eksplisit hukum poligami di berbagai Negara-Negara Muslim dibagi menjadi tiga, Pertama, Negara Muslim yang melarang keras praktek poligami, lebih-lebih bagi para pelaku poligami dikenai sanksi denda maupun kurungan penjara, dalam peraturan yang terdapat pada Negara tersebut sudah menutup rapat praktek poligami. Negara yang memberlakukan larangan poligami tersebut antara lain Negara Tunisia dan Turki. Kedua, Negara Muslim yang membatasi praktek poligami, poligami dibatasi melalui persyaratan-persyaratan tertentu yang harus dipenuhi oleh seorang suami ketika ingin melakukan poligami. Poligami diperbolehkan dengan ketentuan-ketentuan yang diatur dalam perundang-undangan yang berlaku, seperti hanlnya di Negara Indonesia dan Malaysia. Ketiga, Negara Muslim yang memberikan seluas-luasnya untuk poligami, seperti yang di praktekkan di Negara Arab Saudi.

Abstract

The emergence of differences of opinion in determining the age of marriage is due to the absence of definite provisions in its determination. This has an impact on differences of opinion that arise in the view of fiqh experts and also has an impact on existing legislation. In addition, regarding the handling of marital dispensation cases, at first there was no detailed regulation that had an impact on the number of decisions that gave permission to every case of marriage dispensation. Currently the author discusses determining the age of marriage after the birth of Law Number 19 of 2019 and the provisions of the Supreme Court Number 5 of 2019 concerning Guidelines for Adjudicating Applications for Marriage Dispensation. This research uses qualitative research with descriptive analysis method with normative juridical approach. as for the result as follows : The stipulation of the Religious Courts in determining the age of marriage was previously enshrined in the provisions of Article 7 Paragraph (1) of Law Number 1 of 1974 where the provisions for the marriage age of 19 years for men and 16 years for women were further amended by Law Number 16 of 2019 concerning Marriage with The age requirement for both male and female is 19 years. In the event that the application for a marriage dispensation case is specifically regulated in Perma Number 5 of 2019 concerning Guidelines for Adjudicating Applications for a Marriage Dispensation, the Religious Courts in handling the case must be based on the Perma, then must consider the benefits and harms in determining the application for a marriage dispensation.

Abstract

Every place or region must have a pent-up potential that if harnessed would have a tremendous impact on a place or region. Such potential can be used to develop and improve from a place or region, as can a village flooded with colddings. Today, the Javanese language in particular is falling significantly because of external influences and globalization that gradually push out Java. The Javanese language and its presence are so important, the Javanese language itself is an indigenous language that is an Indonesian national culture still spoken in everyday life. The Javanese language itself has its own level of language use, such as ngoko, alus manners and ingratatedness. The use of vulgar language over time has been sparse even though such crude manners are very important asa courtesy and respect for an older person. In reality, most communities in general are mostly children who are drowning in weak Javanese. This assistance uses the PAR (Partysipatory Action Research) method, which is a research methodology that invites individuals and communities to participate actively by participating in activities in the same construction or facility with the knowledge they have. In its implementation there are several stages, namely analyzing problems, preparing program planning, program implementation and program evaluation. Efforts to develop and maintain the Javanese language can be done through formal and non-formal education. The development of Javanese language through formal education is carried out to children from elementary school (SD) in Kedungbanjar village, Sambeng.

Abstract

: Gadai adalah suatu hak yang diperoleh seseorang yang berpiutang atas suatu barang bergerak atau tidak bergerak yang diserahkan kepadanya oleh seorang yang berutang atau oleh seorang lain atas namanya, dan memberikan kekuasaan kepada orang yang berpiutang itu untuk mengambil pelunasan dari barang tersebut secara didahulukan dari pada orang-orang yang berpiutang lainnya, dengan pengecualian biaya untuk melelang barang tersebut. Tujuan penelitian ini adalah untuk menjelaskan praktek gadai yang dilakukan oleh masyarakat di desa Karang Kedawung Kabupaten Jember dari sudut pandang hukum Islam. Penelitian ini adalah penelitian kualitatif deskriptif. Teknik observasi, wawancara dan dokumentasi adalah teknik yang dilakukan untuk mengumpulkan data yang dibutuhkan di dalam penelitian ini. Hasil penelitian ini menunjukkan bahwa pemanfaatan barang gadai (sawah) tidak sesuai dengan hokum Islam karena mereka mengikuti adat kebiasaan yang sudah lama ada yaitu gadai identik dengan pemanfaatan barang gadai.
