<![CDATA[Penelitian ini bertujuan untuk menganalisis dan mengetahui efektivitas pemidanaan tindak pidana korupsi pada dana desa dan faktor-faktor apakah yang mempengaruhi efektivitas pemidanaan tindak pidana korupsi pada dana desa. Penelitian ini dilaksanakan dalam wilayah hukum kabupaten gowa tepatnya di Kepolisian Resor Gowa. Hasil Penelitian ini menunjukkan bahwa efektivitas pemidanaan tindak pidana korupsi pada Dana Desa terhadap putusan Nomor: 51/Pid.Sus-TPK/2019/PN. Mks dan Putusan Nomor: 53/Pid.Sus-TPK/2019/PN. Mks terhadap masing-masing terdakwa dengan putusan 1 (Satu) tahun 10 (Sepuluh) bulan pidana penjara dan denda Rp50.000.000,00. (Lima Puluh Juta Rupiah) merupakan putusan yang tidak efektif. Dikarenakan Tindak Pidana Korupsi merupakan kejahatan Luar Biasa (Extra Ordinary Crime), terdakwa sepatutnya dihukum seberat-beratnya. Dianjurkan untuk memiskinkan terdakwa dengan mengambil seluruh property agar mereka dan yang lainnya, harus mempertimbangkan sebelum melakukan hal serupa. Faktor-faktor yang mempengaruhi efektivitas pemidanaan tindak pidana korupsi yaitu faktor substansi hukum, faktor struktur hukum dan faktor budaya hukum yang sangat berpengaruh terhadap pemidanaan tindak pidana korupsi pada dana desa. This research aims to analyze and determine the Effectiveness of Conviction in the corruption of Village Funds and the factors influencing the effectiveness of conviction in the corruption of village funds. This research was conducted in the jurisdiction of Gowa District precisely in Gowa District Police. The results of this study reveal that the effectiveness of convictions in the corruption of village funds against the verdict Number: 51/Pid.Sus-TPK/2019/PN. MKS and Verdict Number: 53/Pid.Sus-TPK/2019/PN. MKS against each defendant with a verdict of 1 (One) year 10 (Ten) months imprisonment and a fine of Rp50,000,000,00 (Fifty Million Rupiah) is an ineffective verdict. This is because the crime of corruption is an extraordinary crime, the defendant should be sentenced as severely as possible. Impoverishing him/her by taking his entire property is advised so that they, and others, will have to ponder into consideration before doing a similar action. Factors that are affecting the effectiveness of convictions in the corruption of village funds are legal substance factors, legal structure factors, and cultural factors that have a profound effect on the funding corruption crimes in village funds.]]>
