Abstract

Tujuan penelitian menganalisis eksistensi prinsip restorative justice dalam pelaksanaan proses penyelesaian tindak pidana di Kepolisian Resort Kota Besar Makassar dan faktor yang mempengaruhi. Penelitian ini menggunakan data primer yang diperoleh dari penelitian lapangan. Hasil penelitian ini menunjukkan bahwa: Efektivitas penerapan restorative justice dalam pelaksanaan proses penyelesaian tindak pidana di Kepolisian Resort Kota Besar Makassar berdasarkan Surat Edaran Kapolri Nomor: SE/8/VII/2018 tentang Penerapan Keadilan Restoratif (Restorative Justice) dalam Penyelesaian Perkara Pidana masih kurang efektif dikarenakan jumlah presentase kasus pidana umum yang terselesaikan melalui restorative justice dari tahun 2019-2021 terus menurun setiap tahunnya. Faktor Yang Mempengaruhi Penerapan Prinsip Restorative justice Dalam Proses Penyelesaian Tindak Pidana di Kepolisian Resort Kota Besar Makassar antara lain faktor substansi hukum, faktor struktur hukum, faktor sarana dan prasarana, faktor lingkungan masyarakat dan faktor budaya hukum. The research objective to analyze the existence of the principle of restorative justice in the implementation of the criminal act settlement process at the Makassar City Police Resort and the influencing factors. This study uses primary data obtained from field research. The results of this study indicate that: The effectiveness of the application of restorative justice in the implementation of the process of resolving criminal acts at the Makassar City Police Resort based on the Circular Letter of the Chief of Police Number: SE/8/VII/2018 concerning the Application of Restorative Justice in the Settlement of Criminal Cases is still less effective This is because the percentage of general criminal cases resolved through restorative justice from 2019-2021 continues to decline every year. Factors Influencing the Application of Restorative Justice Principles in the Criminal Acts of Settlement Process at the Makassar City Police Resort include factors of legal substance, factors.
