Abstract

This study aims to describe the issuance of Law Number 3 of 2006 concerning the Religious Courts which has increased the authority of the Religious Courts. The mandate of the law instructs religious courts to not only accept, examine, decide, and adjudicate marriage and inheritance cases, but also have the authority to resolve sharia economic disputes. This research uses a normative juridical research method. Normative juridical research is research that examines various laws and regulations that apply or are applied to a particular legal problem. Normative juridical law research is often referred to as doctrinal law research. From the results of this study, it is explained in the explanation of article 49 letter (i) of Law Number 3 of 2006 concerning Religious Courts. This indicates that apart from the religious judiciary, it is not allowed to accept, examine, decide, and adjudicate sharia economic cases. The absolute authority of the religious court has been patented by the decision of the Constitutional Court no. 93/PUU-X/2012 which stipulates that sharia economic disputes are the absolute authority of the religious courts. The Constitutional Court's decision at the same time eliminates dualism in the judicial environment to resolve sharia economic dispute cases. Abstract

The strategy of waqf management and development determines the size of the productivity. Therefore, Nazhir's strategy in its management is an interesting thing to study, considering the many potential waqf in Langsa City, especially in East Langsa District which is still less productive. This paper intends to discuss Nazhir's strategy in managing productive waqf, the obstacles faced, as well as the efforts that can be taken in its management, as well as good analysis from the institutional, management and management aspects of productive waqf in order to have development and be useful for the wider community. The results of the study show that the nazhir strategy is in accordance with Law Number 41 of 2004. The findings show that there are three obstacles in managing productive waqf, namely: the nazhir paradigm which is still traditional, nazhir's creativity which is still reduced to direct waqf to a more productive sector, and low productivity. not optimal. Nazhir's efforts to manage productive waqf include establishing partnerships with other parties, promoting unproductive waqf land through recitations or community meetings, building a good image of waqf results, and holding trainings to develop the capabilities of the nazhirs. Three aspects that must be considered and are milestones in the progress of waqf, namely aspects of waqf institutions, accounting aspects, and auditing aspects.

Abstract

Various problems faced by mankind today require the presence of religion as a solution. Religion is not only used as a symbol of piety alone, but conceptually is able to show an effective way of solving problems. Such demands can be answered when the understanding of religion that has been using a normative theological approach is also supported by other approaches that can operationally provide answers to problems that arise, one of which is a sociological approach. The urgency of the sociological approach in understanding religion is understandable because there are many religious teachings related to social problems. It is hoped that with a sociological approach, religion will be understood easily, because religion was revealed for social purposes
