Abstract

Perilaku pelaku ekonomi selalu akan dinamis seiring dengan kondisi bisnis yang dilakukannya. Maka saat dua orang atau lebih mengadakan transaksi ekonomi, harus diproteksi hak dan kewajiban masing-masing orang yang melakukan transaksi tersebut. Di antara sekian bentuk transaksi yang menyisakan masalah di antara pelaku ekonomi adalah tidak dipenuhinya kewajiban yang telah disepakati kedua belah pihak. Dalam transaksi utang piutang ini biasanya terjadi ketika debitur tidak bisa memenuhi kewajibannya untuk mengembalikan utang sesuai kesepakatan. Dalam kondisi demikian biasanya dilakukan penyitaan terhadap aset-aset yang dimiliki oleh debitur sebagai pengutang. Dalam hal demikian Shah Wali Allah memberikan solusi bahwa pada prinsipnya orang yang muflis (atau bangkrut) diberi kesempatan sampai ada kemungkinan ia dapat mengembalikan utangnya atau mendapatkan kelapangan. Dan ketika ia mempunyai harta untuk mengembalikan utang maka harta tersebut dapat diambil untuk diserahkan kepada orang yang memberikan utang. Sedangkan orang-orang yang menyembunyikan hartanya untuk menghindar dari kewajiban mengembalikan harta maka ia dapat dipenjara dan diberi sanksi oleh penguasa. The behaviour of the doers of economy is always dinamic in line with the condition of bussiness done. In a case that two or more people are conducting economy transaction, it needs to be protected related to their right and responsibility. Among the kinds of transaction activities, the remain problem is an aspect related to unfulfillness of the doer’s responsibility based on the made agreement among them. In a transaction related to dedt and credit, the debitor usually cannot fulfill his/her responsibility to return his/her debt based on his/her agreement with the creditor. In such a condition, the creditor conducts a confiscation toward assets possessed by the debitor. Referring to this phenomenon, Shah Wali Allah gives a solution in which an individual who is bankrupt given opportunity untill he or she has property to return his or her debt. When they are has property, then immediately hand in it to the creditor. Meanwhile, those who prefer to keep their property to return their debt, they can be jailed and be given santion by the authority person.

Abstract

Shah Wali Allah adalah ulama yang hidup pada masa pra modern abad 17 di India. Seorang tokoh yang mempunyai perhatian yang utuh dalam menyelesaikan problematika umat Islam yang ada di sekitarnya. Salah satu upaya pembaruan yang digagas olehnya adalah usaha untuk mempertemukan berbagai aliran keagamaan yang tumbuh dan berkembang di India. Konsep mazhab oleh Shah Wali Allah adalah hasil dialektika kehidupannya dalam menyelesaikan problematika krisis multidimensi yang dialami oleh umat Islam Indo-Pakistan India. Yaitu adanya deferensiasi antarkelompok keagamaan, tak terkecuali mazhab dalam hukum Islam. Pemikiran ini berusaha memberikan tawaran-tawaran konsep berijtihad, ber-mazhab dan taklid. Pemikiran tentang mazhab yang tertuang dalam kitab al-Ins}a>f fi Asba>b al-Ikhtila>f, walaupun dalam pengelompokan terhadap tahapan-tahapan sejarah lemah, tetapi pemikiran tersebut adalah produk genuine pembaruan hukum Islam dari Shah Wali Allah yang dalam perspektif sosiologis dapat dikategorikan sebagai upaya pemurnian ajaran Islam saat menghadapi krisis dengan solusi rasionalisasi tradisi ber-mazhab. Shah Wali Allah is an theologian who lived in before modern, precisely in 17 century in India. He is a prominent figure who devotes his live to solve Islamic followers problems surround him. One of his efforts is to meet some religion paths which grow up in India. The concept of mazhab proposed by Shah Wali Allah is the result of dialectic of his life in solving multi dimension of crisis experienced by Islamic followers of Indo-Pasistan India. The problem is the emergence of differentiation among group of religion followers, including mazhab in Islamic law. This thinking offers concept of doing ijtihad, mazhab, and taklid. The thinking of mazhab which is presented in book of al-Insaf fi Asbab al-Ikhtilaf, although in grouping the phases of history is weak, however the thinking is genuine product of Shah Wali Allah in renewing Islamic law. This product in sociological perspective can be categorized as an effort to purify Islamic teachings when it is up against crisis with rationalization of tradition in doing mazhab as the Solutions

Abstract

ABSTRACTSeeing from the prespectives of Deewes, the Prophet’s and Shahabah’s era constitute the era of developing the foundation of Islamic law. In other words, this era is considered as the genuine era of Islamic law implementation which employs the normative and rational approach to the text of Qur’an and Hadits. It can be said, then, that the phylosophy of Islamic law has been practiced since the era of the Prophet. In that era the development of Islamic law occurs in line with the cases in the community. This fact proves that there is a dialectic between the normative value of the text and social structure of the community in which the Islamic law applys. It shows that empirical experience is considered in the development of Islamic law. As the result, in the era of genuine implementation of Islamic law, the basis of Islamic law development is the texts of Quran and Hadits, rationalism of Ijma-Qiyas, and empirical approach of the sociological condition during the era of the Prophet and Shahabah.Keywords: Filsafat, History, Islamic

Abstract

The most discussed form of Islamic state system is khilafah. Therefore, this current study discusses the philosophy of khilafah from the perspectives of ontology, epistemology, and axiology. From the perspective of its ontology, it turns out that khilafah is a dynamic terminology in the history of Islamic politic. It can be traced from the history that the Islamic political system changes according to the social condition and the ruling regime. It may be called khilafah, imamah or mulk (kingdom). In other meanings, it can refer to religious theocracy, monarchy-oligarchy, or democracy in the form of nation state. Whatever the name of the Islamic state system is used, all Islamic state must be directed to achieve the maslahah. According to the scholars of the maqashid al-syariah, the maslahah is measured using the five universal standards of principles (kuliyat al-khams). They are ensuring the freedom of religion (hifdz al-din), ensuring the life (hifdz al-nafs), ensuring the creativity and freedom of thinking and speak (hifdz al-‘aql), securing the property (hifdz al-mal), and ensuring the sustainability of offspring and human dignity (hifdz al-nasl wa al-‘irdl).                Keywords: Islamic law Khilafah, Politic, Maslahah

Abstract

Every method and approach in Islamic Studies currently available to us has weaknesses in looking at religious data. For that reason, efforts to find better and more integrative method are needed. One of the approaches that might be useful for Islamic Studies is historical approach. Sufism in the meantime, has become an important part of the history of Islam. Nonetheless, it is only recently that Sufism?as well as its origin, change and development- become a subject of historical study. Hagiography has also become a new trend in the historical study of Sufism. And one of the Sufis whose hagiography has become an important subject of study is that of Ahmad Yasafi, a Sufi of 16th ? 17th century. Hagiography is a kind of written sources that narrate the life of a supposedly holy man and the legends related to him. According to Devin Dewees, the hagiography of Ahmad Yasawi portrays the man?s personal and communal life, his patronage with the ruler, the rituals of his tar?qah, and the legends related to him and his order. This article ?using historical approach- is a descriptive account of Ahmad Yasawi?s hagiography.

Abstract

In speaking of Islamic studies, we need to remember two things. First is the approach by which we elaborate certain point from certain perspective. In Islamic studies?like in any other studies?approaches vary. Different approaches would bring different conclusions. However, as long as an approach is academically sound and acceptable and meets all standards required, any conclusion resulted thereon is deemed correct and justifiable. Hence, no single conclusion is considered right while the other is wrong. Islamic studies should therefore acknowledge that academic truth is not singular but plural on the ground that there are many approaches toward many conclusions. It is this notion that we want to discuss here. We are interested in exploring the notion of intellectual truth. We hold that differences in opinion should be accepted as natural. Second is, that there is no fundamental differences in the basic value of sciences of any kinds. In other words, what is popularly known as Western science and Islamic science does not in principle differ. Science is science. There cannot be a dichotomy between Islamic or non-Islamic science. Dichotomy in science is not acceptable. Science belongs to all culture, tradition and religion. It does not know particularity. It is universal. Islamic studies should understand this, and use all tools, approaches, methodologies?albeit Western?for their improvement. It is toward these issues that this paper is destined.
