Abstract

Tulisan ini membahas Critical Legal Studies sebagai sebuah studi kritis terhadap hukum yang menentang mazab formalisme hukum. Sebagai sebuah studi kritis, Critical Legal Studies tak hanya menampung pemikiran-pemikiran hukum yang marxis, tapi juga liberal-radikal dan postmodernisme. Tulisan ini juga membahas kritik mendasar teori hukum-komunikasi dari Jürgen Habermas terhadap Critical Legal Studies dan kemudian kritik mendasar feminisme terhadap Jürgen Habermas. Tulisan ini ditutup dengan pemikiran Carol Smart yang membarui argumentasi Critical Legal Studies

Abstract

This paper examines the tension between private and public sphere in deciding women’s role against ecological crisis. State, companies, traditional tribe-based women alliance, village women have their own perception and definition in projecting to save the ecology. Private sphere is where women construct their identity, transmitted ecological spirit to their children, according their phantasy of beauty and fashion based on ecological-friendly product, etc. Public sphere is where women campaign explicitly against company that destroy their environment as form of ecological and gender injustice. The urge to protect the ecology, for women, means the dealing of the tension between domestic and public spheres.

Abstract

Pancasila cannot be an ideology. Because an ideology―as an absolute truth―will deny other ideologies. So to believe in Pancasila as an ideology is to believe that one day Pancasila will be eliminated by other ideologies. However, the impossibility of Pancasila becoming an ideology will not diminish its nobility. After all, Pancasila―which was raised in the debate on the basis of an independent Indonesian state between Islamic and nationalist groups―is a historical text. It will not be erased from the history of the Indonesian nation-state. Pancasila―which emerged from the debate at BPUPKI―is a story about how individuals in a pluralistic society want to live as a nation in the same country.
