Abstract

AbstractThis article examines the comparison of Imam Abu Hanifah's views and Civil Law regarding murder as a barrier to receiving inheritance. The aim is to find out the views of Imam Abu Hanifah and the civil law regarding murder as a barrier to receiving inheritance, in terms of similarities and differences in their views. This research is normative with a qualitative approach, and is supported by secondary data sources from fiqh books and the Civil Code, which are then analyzed using qualitative descriptive to describe the research results.The results of the study show that: First, the opinion of Imam Abu Hanifah regarding murder is one of the barriers for someone to get an inheritance which clearly states the type of murderer, namely murder with qisas and/or kaffarah sanctions, namely intentional murder, intentional similar murder, murder by mistake and murder considered is wrong, while the civil law code also explains that murder can prevent heirs from receiving an inheritance, in article 838 paragraph 1. Second, the similarity between the two in the concept of determining murder as a barrier to receiving an inheritance is an additional punishment for those who commit murder. and the loss of the right of the heirs to inherit. Meanwhile, the difference lies in the type of murder, according to Imam Abu Hanifah, murder that causes a person to be prevented from receiving an inheritance, namely all murders with qisas and kaffarah sanctions, namely intentional killing, intentional similar killing, killing by mistake and murder is considered wrong, and according to civil law any type of murder can prevent a person from inheriting.Keywords: Abu Hanifah; Civil law; Inheritance Barrier; Murder.

Abstract

AbstractThis study aims to examine Muḥammad Syaḥrūr's thoughts on QS al-Nisā/4:11 about the division of inheritance for boys and girls. This research is a qualitative research using a multidisciplinary approach or a comprehensive approach, but because the study leads to Muḥammad Syaḥrūr's legal thinking regarding inheritance, the emphasis is specifically on the Islamic Law approach which is then supported by several other disciplines, including the interpretive, historical, sociological approaches. , juridical, and hermeneutics. Syaḥrūr's thoughts on inheritance, show several important findings: First, there are three principles of inheritance law limitations which are explained as limits that have been set by Allah and also do not go outside the limits in the inheritance verses; Second, the theory of udūd Syaḥrūr has implications for the collapse of the old view that parts of inheritance cannot be changed at all. However, Muḥammad Syaḥrūr's findings are just the opposite, that these parts can change and are dynamic; Third, another uniqueness of Syaḥrūr's thinking is when he reconstructs Islamic inheritance law which is carried out by getting out of the entanglement of literal texts of Islamic teachings to find contextual inheritance law. AbstrakPenelitian ini bertujuan untuk menelaah pemikiran Muḥammad Syaḥrūr terhadap QS al-Nisā/4:11 tentang pembagian waris anak laki-laki dan perempuan. Penelitian ini merupakan penelitian kualitatif dengan menggunakan pendekatan multidispliner atau pendekatan komprehensif, tetapi karena kajiannya mengarah kepada pemikiran hukum Muḥammad Syaḥrūr mengenai kewarisan, maka penekanannya terkhusus kepada pendekatan Islamic Law yang kemudian ditunjang dengan beberapa disiplin ilmu lainnya, di antaranya yaitu pendekatan tafsir, historis, sosiologis, yuridis, dan hermeneutika. Pemikiran Syaḥrūr mengenai kewarisan, menunjukkan beberapa temuan penting: Pertama, ada tiga prinsip batasan hukum waris yang dijelaskan merupakan batasan yang telah di tetapkan oleh Allah dan juga tidak keluar dari batasan dalam ayat-ayat waris; Kedua, teori ḥudūd Syaḥrūr berimplikasi pada runtuhnya pandangan lama bahwa bagian-bagian waris sama sekali tidak bisa diubah. Namun, temuan Muḥammad Syaḥrūr justru sebaliknya, bahwa bagian-bagian itu bisa saja berubah dan bersifat dinamis; Ketiga, keunikan lain dari pemikiran Syaḥrūr yaitu ketika ia merekontruksi hukum waris Islam yang dilakukan dengan keluar dari jeratan teks-teks literal ajaran Islam untuk menemukan hukum waris yang kontekstual.

Abstract

This study examines the power of a notarial grant deed as an authentic deed in the settlement of inherited land ownership disputes. This study aims to find out how the strength of a notary grant deed which has perfect evidentiary power is related to legal practices that occur in society where there are still many cases of cancellation of a notary grant deed by judges in court. This study is a normative legal research/doctrinal approach which is carried out by analyzing legislation or other legal materials related to the strength of a notary grant deed as an authentic deed in the settlement of inherited land ownership disputes. The results of this study illustrate that basically a notary grant deed has perfect evidentiary power which technically functions to provide guarantees of protection and legal certainty to grantors, grantees, heirs, and related parties. However, in reality the strength of proof of a notary grant deed in court is weak when there are deficiencies in its manufacture which cause the grant deed to be canceled by the judge. The weakness of the grant deed in the evidentiary process so far is because the data included in the deed is not comprehensive so that there are still legal loopholes that have the potential to cause disputes, both from the aspect of legal substance that has not been synchronized between various types of legislation, the role of the legal structure (Notary/PPAT) which has not been maximized in seeing the motivation and prerequisites of the applicant, and the legal culture factor of the community who does not yet have an adequate understanding of the legal mechanism for implementing grants.
