<![CDATA[ABSTRACTThe choice of the theme is motivated by the many processes of buying and selling land through auctions that occur in the community, so it is necessary to know about the mechanism for the transfer of property rights to land and to seek things that become obstacles to the transition process. Based on this background, this paper raises the formulation of the problem as follows: 1. What is the mechanism for transferring ownership rights to land through auction based on Government Regulation Number 24 of 1997 at the National Land Agency of Gresik Regency? 2. What are the obstacles in the transfer of land ownership rights through auctions and what are the efforts to overcome them? The method used by the author is empirical juridical with a sociological approach. The data sources used are primary and secondary data sources. Data collection techniques were carried out through field techniques by means of interviews, observations, and documentation and data analysis techniques using qualitative analysis. The mechanism for the transfer of land ownership rights is divided into nine stages by fulfilling predetermined conditions, and if there are obstacles there are several steps that can be taken.Key words: Land Ownership, Auction, Land RegistrationABSTRAKPilihan tema tersebut dilatar belakangi oleh banyaknya proses jual beli tanah melalui lelang yang terjadi dimasyarakat, sehingga perlunya diketahui tentang mekanisme peralihan hak milik atas tanah serta mengupayakan hal-hal yang menjadi penghambat proses peralihan tersebut. Berdasarkan latar belakang tersebut, karya tulis ini mengangkat rumusan masalah sebagai berikut: 1. Bagaimana mekanisme peralihan hak milik atas tanah melalui lelang berdasarkan Peraturan Pemerintah Nomor 24 Tahun 1997 di Badan Pertanahan Nasional Kabupaten Gresik? 2. Apa saja hambatan dalam peralihan hak milik atas tanah melalui lelang dan bagaimana upaya untuk mengatasi hal tersebut? Metode yang digunakan penulis adalah yuridis empiris dengan pendekatan sosiologis. Sumber data yang digunakan adalah sumber data primer dan sekunder. Teknik pengumpulan data dilakukan melalui teknik lapangan dengan cara wawancara, observasi, serta dokumentasi dan teknik analisis data menggunakan analisis kualitatif. Mekanisme peralihan hak milik atas tanah dibagi menjadi sembilan tahap dengan memenuhi syarat yang telah ditentukan, dan apabila terjadi hambatan terdapat beberapa upaya yang dapat dilakukan.
