<![CDATA[ABSTRACT Inheritance law arises as a result of the existence of a legal event that is death. Therefore, the problem of inheritance becomes a very important issue in human life as living creatures as well as social beings. Departing from these problems, the formulation of the problem in this study is how the distribution of inheritance systems, the process of implementing the distribution of inheritance to the indigenous Samin community who are Muslim in Margomulyo Village, Kec. Margomulyo, Kab. Bojonegoro. This research uses the empirical juridical method. From the results of the study it was concluded that the division of inheritance in the Samin Customs did not recognize the word inheritance, but was known as a relic. The distribution of inheritance in adat is carried out with kinship and does not differentiate between men and women. Oleh karena itu masalah waris menjadi perihal yang sangat penting dalam kehidupan manusia sebagai makhluk hidup sekaligus makhluk sosial. Berangkat dari permasalahan tersebut rumusan masalah dalam penelitian ini bagaimana sistem pembagian warisan , proses pelaksanaan pembagian warisan pada masyarakat Adat Samin yang beragama Islam di Desa Margomulyo, Kec. Margomulyo, Kab. Bojonegoro. Penelitian ini menggunakan metode yuridis empiris. Dari hasil penelitian tersebut ditarik kesimpulan bahwa pembagian warisan pada Adat Samin tidak mengenal kata warisan, namun dikenal dengan sebutan tinggalan. Pembagian warisan pada adat ini dilakukan dengan kekeluargaan dan tidak membedakan antara laki-laki dan perempuan.Kata Kunci : Warisan, Pembagian, Adat Samin]]>
