Abstract

Naturalism is one of the main topics that explore the philosophical discourse. This article intends to discuss the philosophical problems of naturalism in jurisprudence. The argumentations of naturalism have affected the configuration of methodological debate in jurisprudence; between the descriptive approach and the evaluative approach. By reviewing the project of naturalism in metaphysics and epistemology and then scrutinizing how the ideas of naturalism work in jurisprudence, this article will exhibit a contribution of the philosophy of science to the scientific reflection of law. The development of naturalism creates challenges and chances at once for methodological tracing in the philosophy of law.

Abstract

This article is the result of an explorative study on methodological issues in Indonesian legal science.  It uses a literature review to trace current debate on three interrelated issues concerning legal scholarship, legal development and legal pluralism. Each of these issues will be juxtaposes to contemporary legal discourse. Separately the issue of legal scholarship will be just apose to the praxis of legal research methodology and legal education; legal development to “law and development” paradigm; legal pluralism to rule of law. The author follows the legal thinking tradition employed by influential legal scholars: Paul Scholten, Soediman Kartohadiprodjo and B. Arief Sidharta. The standing of other prominent legal authors such as Mochtar Kusuma-Atmadja and Soetandyo Wignyosoebroto, to the extent that their ideas are relevant to this article, will be briefly discussed.

Abstract

Ronald Dworkin was a contemporary American legal theorist whose ideas of the nature of law had strikingly compelled legal positivists to amend a number of their basic tenets. In this paper, Dworkin’s pivotal legacy on troika of jurisprudence, legal theory, and philosophy of law will be assessed, in the light of interpretive nature of legal practice undertaken by their officials or professionals. Thus, it will demonstrate three focal points of his legal thought, i.e. the idea of anti-positivism, legal reasoning as moral reasoning, and legal (in)determinacy. Those are exhibited in Dworkin’s final oeuvre, Justice for Hedgehogs, which refers to the notable Classical Greek metaphor made famous by Sir Isaih Berlin on the picture of law and morality: the fox and the hedgehog. Dworkin drew on this metaphor to accentuate his long-standing commitment on the unity of law and morality. Accordingly, this article will situate Dworkin in Indonesia jurisprudential problem in the context of legal pluralism. My primary intention is to examine the transposition of the Dworkinian concept of jurisprudence to the concept of Indonesian legal science. To that end, a comparative glance is inevitable, and it will make the case for several impediments to use Dworkin’s thoughts in the legal ambiguity and uncertainty in Indonesia. Abstrak Ronald Dworkin adalah seorang teoretikus hukum Amerika kontemporer dengan gagasan-gagasan yang memaksa para tokoh positivis hukum untuk mengamandemen beberapa corak dasar teorinya. Di dalam tulisan ini, warisan Dworkin yang paling penting mengenai ilmu, teori, dan filsafat hukum akan diulas berdasarkan hakikat interpretatif praktik hukum sebagaimana digeluti oleh para pengemban hukum profesional. Di sini akan diajukan tiga pokok pemikiran hukum Dworkin, yakni paham anti-positivisme, penalaran hukum sebagai penalaran moral, dan ke(tidak)pastian hukum. Kesemuanya itu tampak di dalam karya Dworkin yang terakhir, Justice for Hedgehogs, yang merujuk pada metafora Yunani Klasik tentang Sang Rubah dan Sang Landak yang diperkenalkan oleh Sir Isaiah Berlin. Dworkin menggunakan metafora ini untuk menegaskan komitmen lamanya tentang kesatuan hukum dan moralitas. Dalam pada itu, artikel ini akan mendudukkan Dworkin ke dalam masalah keilmuan hukum Indonesia dengan konteks pluralisme hukum. Maksud utamanya adalah untuk menyelidiki transposisi konsep filsafat hukum Dworkinian ke konsep ilmu hukum Indonesia. Untuk itu, telaah dengan sentuhan komparatif menjadi tak terhindarkan, dan dengannya hendak dinyatakan bahwa terdapat sejumlah tantangan dalam menggunakan pemikiran Dworkin di dalam ambiguitas dan ketidakpastian hukum di Indonesia.

Abstract

This article investigates the phenomena of electoral politics and culture of social media in the context of Indonesian law and society through a case study of Jakarta Gubernatorial Election in 2017. The main argument of this article is that the connection between electoral politics and culture of social media shows a fallacious logical thinking in the form of bias and ad populum reasoning. Those two forms of fallacy refer to sectarian politics and ideological polarization. In analyzing the fallacious thinking in some events of the 2017 Jakarta Gubernatorial Election, this article also shows how emotion, anxiety, and hate operate within the reasoning of the relation of the Indonesian state and society. This article primarily aims at identifying the argumentative situation in the case of the 2017 Jakarta Gubernatorial Election, which contains the fallacious thinking. In the end, the ultimate aim is to evaluate an implication that stems from that identification for an adequate conception of legal reasoning in the Indonesian context.

Abstract

Abstrak: Tulisan berikut membahas pemikiran hukum Anglo-Amerika yang dikenal sebagai filsafat hukum. Dua pokok yang dibahas adalah masalah metodologi dan debat Hart/Dworkin. Inti pertanyaan yang dikaji di sini berkenaan dengan hakikat filsafat hukum. Untuk itu lang- kah yang diambil adalah dengan menelusuri situasi debat Hart/ Dworkin dan sesudahnya sebagai suatu debat metodologis dan kemudian menggunakannya untuk mengurai pertanyaan tadi. Debat tersebut telah memicu suatu palingan metodologis dalam filsafat hukum analitik yang lantas mengubah fokus dan makna dari kegiatan melakukan filsafat hukum, yakni dari refleksi atas hakikat hukum (dan hubungannya dengan moralitas) menjadi refleksi atas hakikat kegiatan itu sendiri. Ber- dasarkan telaah kritis terhadap konstelasi dan tren populer dari sejumlah yang ide yang dikembangkan seputar eksistensi debat Hart/Dworkin, termasuk publikasi terbaru teks kuliah Dworkin di Harvard Law Review yang menanggapi Postscript Hart, tulisan ini mengemukakan argumen bahwa wacana filsafat hukum kontemporer menyentuh ranah kritik ter- hadap dua tesis metafisis, epistemologis, dan etis yang tampak sejajar, yakni dikotomi fakta dengan nilai dan pemisahan hukum dengan moralitas. Kata-kata Kunci: Metodologi filsafat hukum, debat Hart/Dworkin, hukum dan moralitas, filsafat hukum analitik, palingan metodologis, metodologi normatif, metodologi deskriptif. Abstract: This paper presents an exploration of the Anglo-American legal thought, better known as jurisprudence. A subject matter of it is two interrelated themes, i.e. the problem of methodology and the “Hart/Dworkin debate”. The main question addressed here concerning the nature of jurisprudence. It takes an inquiry to the Hart/Dworkin debate situation and its aftermath as a methodological debate and whilst use it to scrutinize that question. The debate has been stirred up the so called methodological turn in analytical jurisprudence, thus vary the focus and meaning of the activity of doing jurisprudence, from a reflection of the nature of law (and its relationship to morality) to a reflection of the nature of that activity itself. Based on the critical examination of constellation and popular trend of some ideas which developed around the existence Hart/Dworkin debate, including the recent publication of Dworkin’s lost text in Harvard Law Review replying to Hart’s Postscript, this paper argues that the contemporary discourse of jurisprudence attains the significance of a criticism of two kinds of metaphysical, epistemological, and ethical theses which are apparently parallel, i.e. the fact/value dichotomy and the separation of law and morality. Abstract

Phenomenology of Perception is one of the main philosophical works of a France phenomenological philosopher, Maurice Merleau-Ponty. In this book, Merleau-Ponty elaborates his reflection on the nature of the body based on the perception of the world. In “Sense Experience,” which is part of Phenomenology of Perception, explains the bodily experience and its relation to human’s mode of being in the world. This part is important to look upon, for it serves as the basis for Merleau-Ponty’s phenomenological thought on perception. In “Sense Experience”, while affirming his critique on empiricism and intellectualism, Merleau-Ponty also reflects the meaning of sense experience, the unity of the sense, the analytical attitude, the nature of the body, and the ambiguity of sense experience itself. Two key ideas surface from “Sense Experience,” that is, sense experience with and through the body, and bodily experience with and through the world. One might speak of the world, yet one is part of it. It is the body that allows such ambiguity.
