<![CDATA[ Konflik norma yang terdapat dalam ketentuan peraturan dalam Pasal 9 Huruf G Peraturan Presiden Nomor 12 Tahun 2021 Dengan Lampiran Bab I Huruf E Penggunaan Anggaran Nomor 8 Peraturan Menteri Dalam Negeri Nomor 77 Tahun 2020 sama-sama memberlakukan suatu ketentuan terkait dengan kedudukan pejabat pembuat komitmen dalam pengadaan barang dan jasa. Dari ketidak harmonisan pemberlakuan norma demikian, membuat permasalahan hukum dalam pembentukan peraturan terjadi tumpah tindih dan inkonsistensi. Permasalahan tersebut salah satunya dalam pembentukan peraturan presiden yang sama-sama sinkron dengan peraturan menteri dalam negeri terkait pejabat pembuat komitmen, disebabkan oleh proses pembentukan peraturan perundang-undangan yang mengabaikan pentingnya pendalaman materi, koordinasi, sinkronisasi dan harmonisasi dengan peraturan perundangundangan lain. Penulisan ini dilatarbelakangi dengan adanya permasalahan terkait kedudukan pejabat pembuat komitmen dengan adanya konflik norma dalam Pasal 9 Huruf G Peraturan Presiden Nomor 12 Tahun 2021 Dengan Lampiran Bab I Huruf E Penggunaan Anggaran Nomor 8 Peraturan Menteri Dalam Negeri Nomor 77 Tahun 2020. Dserta terkait peran pemerintah kota/kabupaten dalam pengguna anggaran pada kedudukan pejabat pembuat komitmen dalam pelaksanaan pengadaan barang dan jasa. Jenis penelitian yang dilakukan dalam penulis ini penelitian yuridis normatif. Penelitian yuridis normatif yaitu penelitian yang dapat diartikan sebagai suatu prosedur ilmiah untuk menemukan kebenaran berdasarkan logika keilmuan hukum dari sisi normatifnya. Sedangkan jenis pendekatan dalam penelitian ini menggunakan beberapa pendekatan Pendekatan Perundang-Undangan, dan Pendekatan Konseptual.Kata-Kunci: Konflik Norma, Pejabat Pembuat Komitmen. The conflict of norms contained in the provisions of the regulations in Article 9 Letter G Presidential Regulation Number 12 of 2021 With Attachment Chapter I Letter E Budget Use Number 8 Regulation of the Minister of Home Affairs Number 77 of 2020 both enforces a provision related to the position of the official making the commitment in procurement goods and services. From the disharmony in the application of such norms, there are legal problems in the formation of regulations, overlapping and inconsistencies. One of these problems is in the formation of a presidential regulation that is equally synchronous with the regulation of the minister of home affairs regarding commitment-making officials, due to the process of forming laws and regulations that ignores the importance of material deepening, coordination, synchronization and harmonization with other laws and regulations. This writing is motivated by the existence of problems related to the position of commitment-making officials with conflicts of norms in Article 9 Letter G of Presidential Regulation Number 12 of 2021 With Attachment Chapter I Letter E Use of Budget Number 8 Minister of Home Affairs Regulation Number 77 of 2020. As well as related to the role of city governments / district in the budget user at the position of the official making the commitment in the implementation of the procurement of goods and services. The type of research conducted in this author is normative juridical research. Normative juridical research is research that can be interpreted as a scientific procedure to find the truth based on the logic of legal scholarship from the normative side.
